THE NCDOT PROPOSES TO WIDEN I-85 TO AN 8-LANE FACILITY FROM NORTH OF SR 2528 (SOUTH OF US 601) TO NORTH OF SR 1002, SOUTHWEST OF SALISBURY, ROWAN COUNTY, TIP NO. I- 2511 CA, STATE PROJECT NO. 8.1631503. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show that the NCDOT proposes to improve and widen Interstate 85 in Rowan County from approximately 0.5 mile south of US 601 (Jake Alexander Boulevard) to 0.5 miles north of SR 1002 (Bringle Ferry Road). The project will involve widening the existing facility to an 8-lane facility, 4lanes in each direction separated by a 46-foot median and will also involve the reconstruction of interchanges and service roads to accommodate the proposed widening. The proposed project will not result in any fill and/or excavation within jurisdictional wetlands. However, the project will impact open surface waters of 9 separate unnamed tributaries to Town Creek. Impacts to surface waters of Town Creek are NCDOT is proposing to bridge the creek. Impacts to surface waters will result from the discharge of fill material into 0.13 acre of intermittent stream channels with minimal aquatic functions, the discharge of fill material into 2,772 linear feet of perennial streams and will involve the relocation of 2,163 linear feet of streams within the project limits. The existing median for the project is 46 feet. NCDOT proposes to mitigate for the stream channel impacts at a 1:1 ratio. The project will mitigate for the 2,772 linear feet of impacts to jurisdictional waters of the United States through relocation and restoration of 1,691 linear feet on-site. The mitigation for the remaining 1,081 linear feet of stream channel impacts will occur off-site within the Yadkin Basin at Shepherd's Tree Mitigation Site in eastern Iredell County by restoring 1,081 linear feet of perennial stream channel. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. 3 The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDWQ for certification. 4 Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Water Quality (NCDWQ), Salisbury Street, Archdale Building, Raleigh, North Carolina. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, the devices shall be removed and the natural grade restored within 30 days after the Division of Land Resources has released the project. NCDOT and its contractors and/or agents shall not excavate, fill, or perform mechanized land clearing at any time in the construction or maintenance of this project within waters and/or wetlands, except as authorized by this Certification, or any modification to this Certification. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this Certification without appropriate modification. If this occurs, compensatory mitigation will be required since it is a direct impact from road construction activities. 4. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 5. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 6. Compensatory mitigation shall be performed for 2,772 linear feet of jurisdictional stream impacts. We understand that you have chosen to complete onsite mitigation to restore 1,691 feet of stream to offset for these impacts. The balance of 1,081 feet of compensatory mitigation will occur off- site at the Shepherd's Tree Mitigation Site in eastern Iredell County. 7. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality upon completion of the project. The project has a let date of November 2000. NEPA Documentation An Environmental Assessment (EA) was approved by the Federal Highway Administration (FHWA) on December 12, 1994. The EA explains the purpose and need for the project, provides a description of the project and characterizes the social, economic, and environmental effects of the project. After the EA was approved and circulated, a Public Hearing on the location and design was held on March 28, 1995. On August 30, 1995, the Finding of No Significant Impact (FONSI) was approved. Copies of the EA and FONSI have been provided to the regulatory review agencies involved in the approval process. Additional copies will be provided upon request. Environmental Commitments NCDOT has made several environmental commitments for the proposed project outlined in the FONSI. The commitments pertaining to environmental permits required for Section CA of this project: • Permits: Impacts to Waters of the U.S. will be in the form of surface water impacts at stream crossings. It is anticipated that these impacts will meet the criteria for Department of the Army tN" Section 404 Individual Permit. Also, an Individual Section 401 Water Quality Certification will be required from the N.C. Division of Water Quality. • Schedule: The sched*currently calls for a November 21, 2000 let date with an availability date of December 27, 2000. It is expected the contractor will choose to start the construction at that time. All materials will be removed by the contractor and disposed of off-site. Demolition and Removal: NCDOT Best Management Practices for Bridge Demolition and Removal (Draft) will be adhered to during the life of the project. These practices establish a consistent, environmentally sound approach to the demolition and removal of bridges to North Carolina's public road systems. These guidelines are an addendum to (and not a replacement for) NCDOT Best Management Practices for the Protection of Surface Water. The primary objective of these guidelines shall be to protect the water quality and aquatic life of the affected environment in the vicinity of the project. Endangered Species rr e. Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered, and Proposed Threatened are protected under, provisions of Section 7 and Section 9 of the Endangered Species Act. As of December 20, 1999, a two federally protected species are listed for Rowan County, bald eagle (Haliaeetus leucocephalus) and Schweinitz's sunflower (Helianthus schweinitzii). Both species receive Biological Conclusions of No Effect. An Updated Water Resources and Protected Species Review, dated March 20, 2000, is attached. Cultural Resources An NCDOT staff architectural historian surveyed the project area on July 2, 1992. No structures were found to be over fifty years old. These findings were presented in the EA and were reviewed with the State Historic Preservation Office (SHPO) on June 8, 1995. The SHPO has concurred with these findings. The SHPO has reviewed the proposed project regarding the identification of archaeological sites. In a letter dated August 26, 1992, the SHPO recommends no further archaeological investigation. Findings are further detailed in the EA. Project Let Schedule For construction purposes, the widening and improving of Interstate 85 has been broken down into four sections. Table I reflects the project breakdown, section termini, and project let dates. A map depicting the sections associated with TIP No. I-2511 is attached. NCDOT received the necessary permits for impacts to Waters of the U. S. by Sections BA and BB, which will be completed in September 2000 and August 2001, respectively. Section CB is being completed under separate design and construction contracts. Accordingly, the permit drawings for each section were independently prepared. The NCDOT believes that this section can be considered independent of the remaining sections because it meets the following objects of "independent utility" as defined by the FHWA: • this section of the project connects logical termini since it ties into an existing alignment; • this section of the project is of sufficient length that environmental matters have been addressed on a broad scope (EA and FONSI); • this section of the project has independent significance such that it is usable and of reasonable expenditure even if no other improvements are made in the area; and, • this section of the project does not restrict consideration of alternatives for other reasonable foreseeable transportation improvements. Jurisdictional Status Construction of the proposed project will necessitate impacts to Waters of the United States. Surface waters of Town Creek and several tributaries thereof, will be affected by the extension of culverts and pipes at stream crossings, stream relocation, and temporary fill utilized in the widening of the interstate, as well as improvements to service roads. A jurisdictional stream determination was conducted on November 17, 1999 and verified verbally on January 7, 2000 by NC Division of Water Quality (NCDWQ) representative, John Hennessy, who is familiar with the project area. On January 5, 2000 USACE field representative Jean Manuele provided guidance to differentiate between perennial streams, intermittent streams, and stormwater channels. No wetlands were located within the CA Section of this project. Impacts to Waters of the United States The I-2511 project is in the Yadkin-Pee Dee River Basin, Hydrologic Unit 03040103: There are a total of ten jurisdictional stream crossing sites on this section. These are labeled Sites 1 through 10 (see Sheets 1 through 21) in the attached permit application. Impacts to jurisdictional areas of this section consist of 0.13 ac fill in surface waters (streams), 2,772 feet of existing channel filled, and 2,163 feet of relocated channels. Impacts to this section are summarized in Table 2 and outlined in the summary sheet for Section CA (Sheet 20 of 21). 3 Table 2. Development is ongoing in the vicinity of Town Creek, primarily around the Innis Road intersection (Site 5). Therefore, the NCDOT proposes a mitigation ratio of 1:1 for all of the degraded perennial streams impacted. Compensatory mitigation will be required for 2,772 feet of stream impacts in Section CA. Onsite mitigation via naturalized relocated channels totals 1,691 feet. Segments of relocated stream are located at Sites 1,5, and 8. The NCDOT proposes to naturalize the relocated streams at Sites 5 and 8. (See attached permit drawings.) The vegetated buffer will be extended as far as the right of way or other design features allow, up to 50 feet. These sites are discussed below: Site 5: Stream impacts at this site result from the redesigned interchange of I-85 and SR 1006 (Innis Road). A naturalized relocated stream will flow from south and east of the interchange (850 feet) underneath I-85 through the northwest quadrant of the interchange (426 feet). Sinuosity has been designed to occur where space will allow (see sheets 8 and 9 of the attached permit drawings). A comparison between existing stream characteristics at this site and the proposed relocated stream characteristics can be found on Sheet 11 of the attached permit drawings. NCDOT will apply natural fiber matting with live stakes and revegetate with native shrub plantings. A total of 932 feet of existing stream channel will be impacted at this site and 1,276 feet of the stream will be relocated. NCDOT will claim on-site mitigation for this relocated stream at a 1:1 ratio. Accordingly, there will be a surplus of 344 feet of naturalized stream channel, which will be applied to nearby stream impacts for this project. • Site 8: The unnamed tributary impacted at this Site flows parallel to the highway along the southern side. Widening the interstate will necessitate channel relocation, moving the stream further south southeastward, parallel to the new road and the impacted stream. The naturalized portion of the relocated channel will total 415 feet. Sheet 14 of the attached permit drawings illustrates the location 4 of the relocated stream relative to the highway. fiber matting with live stakes and shrub plantings of the relocated stream with the existing stream. Compensatory Mitigation Sheet 16 illustrates the design, locating the natural . Sheet 17 details and compares the characteristics Compensatory mitigation will be required for the project impacts to Waters of the United States. At the proposed 1:1 ratio, stream mitigation for Section CA totals 2,772 feet. As detailed above, onsite mitigation will restore 1,691 feet of stream. Therefore, the balance of 1,081 feet of compensatory stream mitigation will occur off-site. The NCDOT proposes to mitigate for impacts to streams using the Shepherd's Tree Mitigation Site in eastern Iredell County. The planning document for this mitigation site is dated February 1, 1999. KCI Consultants is in the process of incorporating agency comments and will submit a finalized plan in April 2000. This mitigation site has sufficient mitigation credit to accommodate the compensatory requirements from this project. There are over 123 acres of wetland restoration, 8 acres of wetland enhancement, 8,790 feet of stream restoration (perennial), 2,550 feet of stream restoration (intermittent), and 2,223 feet of stream enhancement (perennial). Four other TIP projects have proposed to utilize credits at the Shepherd's Tree Mitigation Site. TIP No. R-2239C in Wilkes County (Action ID# 199920833, permit application dated May 5, 1999), TIP No. R-2568A in Davidson County (Action ID# 199700601), permit application dated September 14, 1999), TIP No. R-2530A in Stanley County (Action ID# 199600725, permit application dated June 21,1999), and TIP No. R-2530A (permit application dated June 21, 1999). If all four projects are approved as proposed, there will be 4,179 feet of available stream mitigation (perennial) at Shepherd's Tree Mitigation Site, which covers the 1,081 feet of perennial stream mitigation required by 1-2511CA. The City of Salisbury has implemented several stream improvement projects within the city limits. Several of these improvement projects have been conducted on Town Creek tributaries adjacent in the I-2511 CA project vicinity. Currently, the NCDOT is organizing a feasibility study to review potential mitigation opportunities through the City of Salisbury. However, in the interest of time, this application proposes to utilize the Shepherd's Tree Mitigation Site. Nevertheless, NCDOT will pursue these local sites with the intention of "near-site" stream mitigation. If and when it becomes necessary, NCDOT will supply a supplement to this permit application, detailing the mitigation design. Underground Storage Tanks and Hazardous Materials As of August 1995, fourteen operational and four non-operational facilities with the potential for underground storage tank (UST) involvement were identified over the entire distance of the I-2511 project (all sections). Several of these sites will be impacted during construction of Section CA and have been assessed by the NCDOT's Geotechnical Branch. In addition, I-85 currently crosses an abandoned city landfill located just north of Old Concord Road (SR 1002), as well as a former asphalt site near Jake Alexander Blvd. (U.S. 601). These sites have also been assessed and acquisition recommendations for all sites have been made to the NCDOT's Right-of-Way Unit. Utilities Any relocation of public utilities along the project will be coordinated with the appropriate utility or local government agency. Floodway Modifications Since Town Creek flows adjacent to the project, the floodplains and floodways of Town Creek will be effected by this project. During the design phase of the widening and improving of 1-85, the NCDOT coordinated with the Federal Emergency Management Agency and local authorities and filed application for the necessary CLOMAR permits. Permits will be issued within the next two weeks. Mitigation The USACE adopted, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. The purpose of this policy is to restore and maintain the chemical, biological, and physical integrity of the Waters of the United States. Mitigation of wetland and surface water impacts has been defined by the CEQ to include: avoiding impacts, minimizing impacts, rectifying impacts, reducing impacts over time, and compensating for impacts (40 CFR §1508.20). Executive Order 11990 (Protection of Wetlands) and DOT Order 5660.I A (Preservation of the Nations Wetlands), emphasize protection of the functions and values provided by wetlands. These directives require that new construction in wetlands be avoided as much as possible and that all practical measures are taken to minimize or mitigate impacts to wetlands. The NCDOT is committed to incorporating reasonable and practicable design features to avoid and minimize wetland impacts, and to provide full compensatory mitigation of remaining wetland impacts. Avoidance measures were taken during the planning and EA/FONSI phases; minimization measures were incorporated as part of the project design. Avoidance All Waters of the U.S. not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts. Minimization techniques were implemented as follows: 6 • Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands. • Rip Rap: The NCDOT Hydraulics Unit has reduced the amount of rip rap in all stretches of relocated channel. • Natural Stream Design: Where possible, relocated streams have been naturalized, utilizing natural materials, such as natural fiber matting, live stakes, and native shrub plantings and improving channel sinuosity. On Site 5 the "naturalized channels" create a more favorable stream design than currently exists on the streams being impacted. Compensation Mitigation is generally accomplished through a combination of methods designed to replace wetland functions and values lost as a result of construction of the project. Compensation may take the form of mitigation banking, contributions to wetland trust funds, or replacing lost wetland functions and values on-site. Replacing lost wetland functions and values may be accomplished through creating, restoring, enhancing, or preserving similar functions and values in constructed or improved wetlands. When practical, replacement wetland standards are to provide new wetlands either preceding the wetland losses or concurrently with the losses so that wetlands are functioning at all times during the construction process. A total of 2,772 feet of existing channel will be impacted by 1-2511 Section CA construction. Segments of relocated channel totaling 2,163 feet are located at Sites 1, 5, and 8. All of these relocated channel segments, except for Site 1 (which totals 472 feet), will provide on-site mitigation as these relocated segments will be naturalized, approximating existing stream conditions. Therefore, the amount of on-site stream mitigation at a 1:1 ratio is 1,691 ft. The amount of relocated stream segments approximating existing stream conditions subtracted from the total existing channel impacted is the amount of stream impact that will require off-site compensatory mitigation. Accordingly, a total of 1,081 of stream loss impacts will require off-site compensatory mitigation at the proposed mitigation ratio of 1:1. As previously noted on page 4 of this application, NCDOT intends to utilize the Shepherd's Tree Mitigation Site to provide mitigation for stream loss resulting from the proposed I-2511CA project. Summary Application is hereby made for a Department of the Army Section 404 Individual Permit as required for the above-described activities. We anticipate an Individual Section 401 Water Quality Certification will apply to this project, and are providing seven copies of the application to the North Carolina Department of Environment and Natural Resources, Division of Water Quality. In addition, in compliance with Section 143-215.3D(e) of the North Carolina Administrative Action (NCAA) we have enclosed a check for $475.00 to act as payment for processing the Section 401 permit application. Construction of Section CA of the proposed TIP Project No.I-2511 will result in no fill in wetlands, no excavation in wetlands, 0.13 acres of fill in surface water (stream), 2,772 feet of existing channel filled, and 2,163 feet of relocated channel. On-site mitigation will be implemented through relocated channels, of which a total of 1,691 feet will be naturalized. The remaining 1,081 feet of stream impacts will be debited from the Shephard's Tree Mitigation Site in eastern Iredell County (planning document dated February 1, 1999). Due to the degraded nature of the urban streams being impacted, the NCDOT proposes off-site mitigation at a ration of 1:1. 7 Thank you for you assistance with this project. REFERENCES: (1) EA approved December 7, 1994. (2) FONSI approved August 29, 1995. The following memorandum provides information to assist in the preparation of a FHWA Construction Consultation for the proposed project. It addresses water resources and federally-protected species potentially impacted by the project and serves to update the previously submitted Environmental Assessment (EA) with respect to these two issues. WATER RESOURCES Water resource classifications have not changed since the EA was approved. Town Creek and its tributaries are part of the Yadkin-Pee Dee River Basin. The Division of Water Quality (DWQ) best usage classification for Town Creek (DEM Index No. 12-115-3; Date 09/01/74) is Class C. Class C refers to waters suitable for aquatic life propagation and survival, fishing, wildlife, secondary recreation and agriculture. Any stream that is not named in the schedule of stream classifications carries the same classification as that assigned to the stream segment to which it flows. Hydrologic characteristics and existing aquatic communities of this water resource have been described in the referenced EA. Neither High Quality Waters (HQW), Water Supplies (WS-1 or WS-II), nor Outstanding Resource Waters (ORW), occur within 1.6 km (1.0 mile) of the project area. PROTECTED SPECIES Since the EA was written, the bald eagle has been added to the list of federally protected species for Rowan County. As of December 20, 1999, two species are afforded federal protection in Rowan County, under the provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended. The U.S. Fish and Wildlife Service (FWS) lists the bald eagle as threatened and Schweinitz's sunflower as endangered. Descriptions and biological conclusions for these species follow. Bald Eagle (Haliaeetus leucocephalus) Threatened Animal Family: Accipitridae Date Listed: 3/11/67 Distribution in N.C.: Anson, Beaufort, Brunswick, Carteret, Chatham, Chowan, Craven, Dare, Durham, Guilford, Hyde, Montgomery, New Hanover, Northhampton, Periquimans, Richmond, Stanley, Vance, Wake, Washington. Adult bald eagles can be identified by their large white head and short white tail. The body plumage is dark-brown to chocolate-brown in color. In flight bald eagles can be identified by their flat wing soar. Eagle nests are found in close proximity to water (within a half mile) with a clear flight path to the water, in the largest living tree in an area, and having an open view of the surrounding land. Human disturbance can cause an eagle to abandon otherwise suitable habitat. The breeding season for the bald eagle begins in December or January. Fish are the major food source for bald eagles. Other sources include coots, herons, and wounded ducks. Food may be live or carrion. There is no suitable habitat in the project vicinity for the bald eagle. BIOLOGICAL CONCLUSION: NO EFFECT Schweinitz's sunflower (Helianthus schweinitzii) Endangered Plant Family: Aster (Asteraceae) Listed: May 7, 1991 Best Search Time: late summer through frost (August - November) Schweinitz's sunflower is a long-lived perennial, flowering from late August to frost. The yellow disk and ray flowers are formed on small heads (involucre less than 1.5 cm across). The leaves are rather thick and stiff in texture. The upper leaf surface is scabrous (rough) while the lower surface is covered with distinctive dense, soft white hairs. The leaves are opposite on the lower stem and alternate near the flowers. Lower stem leaves average 10-20 cm (3.9 - 7.9 in) long and 1.5 to 2.5 cm (0.6 - 1.0 in) wide while upper leaves are half this size. The leaves are five to ten times as long as wide and sessile to short petiolate. The plants have purple stems that grow to an average height of 2.0 m (6.6 ft) with the top one-third of the stem branching. The stems are at least sparsely strigose or hirsute below the inflorescense. Reproduction is accomplished both sexually (by seed) and asexually (by tuberous rhizome). Schweinitz's sunflower is endemic to the Piedmont physiographic province of North Carolina and South Carolina. Charlotte, NC is considered to be the center of this species' distribution. This plant has a purple stem, scabrous upper leaf surface, with dense, soft, white hairs on the lower leaf surface. The flower head is small (less than 1.5 cm not, including the petal width) with yellow disk and ray flowers. It is believed that this species formerly occupied prairie-like habitats or post oak-blackjack oak savannas that were maintained by fire. Current habitats for this species include roadsides, power line clearings, old pastures, woodland openings, and other sunny or semi-sunny situations. Schweinitz's sunflower is known from a variety of soil types but is generally found growing on shallow, poor, clayey and/or rocky soils, especially those derived from mafic rocks. In the few sites where Schweinitz's sunflower occurs in relatively natural vegetation, the natural community would be considered a Xeric Hardpan Forest (Schafale and Weakley 1990). This species is threatened by fire suppression, urbanization such as residential and industrial development, highway construction, and roadside and utility right of way maintenance. In 1988 the NC Natural Heritage Program initiated a cooperative effort with NCDOT and the USFWS to prevent the mowing of H .schweinitzii populations during the flowering and fruiting period of August through October. Additionally, these populations should not be mowed during any part of the growing season extending from April through October. The biological conclusion rendered in the EA remains valid. BIOLOGICAL CONCLUSION: NO EFFECT Federal Species of Concern (FSC) are those plant and animal species, which may or may not be listed in the future. Theses species were formerly candidate species, or species under consideration for listing for which there was insufficient information to support a listing of Endangered, Threatened, Proposed Endangered, or Proposed Threatened. Federal Species of Concern are not afforded federal protection under the ESA and are not subject to any of its provisions, including Section 7, until they are formally proposed or listed as Threatened or Endangered. Organisms which are listed as Endangered (E), Threatened (T), Significantly Rare (SR), or Special Concern (SR) by the North Carolina Natural Heritage Program (NCNHP) list of rare plant and animal species are afforded state protection under the State Endangered Species Act and the North Carolina Plant Protection and Conservation Act of 1979; however the level of protection given to state listed species does not apply to NCDOT activities. Three FSC are listed for Rowan County. The following table lists Federal Candidate and State listed species, the species state status (if afforded state protection) and the existence of suitable habitat for each species in the study area. The species is also either rare throughout its range or disjunct in North Carolina from a main range in a different part of the country or the world.
