Box 250 North Wilkesboro, NC 28659 Dear Mr. Slaughter: You have our approval, in accordance with the attached conditions and those listed below, to impact 90 linear feet of unnamed tributaries to Cain Mill Branch in order to replace Bridge No. 139 on SR 1160 in Yadkin County. The project must be constructed in accordance with your application dated February 19, 2002 (received February 21, 2002). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ in writing and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. NCDOT is encouraged to use existing on-site vegetation and materials for streambank stabilization and to minimize the use of rip rap. ' 2. The pipes shall be designed and constructed so that it can be installed one foot below streambed grade to enable waters to transport sediment and ensure passage of all aquatic life. The dimension, pattern, and profile of the stream and floodplain above and below the structure shall not be modified by widening the stream channel or reducing the depth of the stream. Disturbed floodplain benching should be restored to natural geomorphic conditions in front of the concrete headwall and upstream and downstream of the second, stormwater flow pipe. 3. All work shall be performed during low flow conditions. 4. Disturbance of the stream channel must be limited to only what is necessary to perform the culvert installation. Heavy equipment must be operated from the banks rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The existing structure is a 14-foot long single sp'an•bridge with timber abutments. The proposed new crossing consists of (2) 50'x 66" x 51" CSPAs with a concrete headwall. Pipe #2 will carry stormwater only. Miscellaneous rip-rap impacts will total 40 linear feet or less. New stream impacts = 90 In. feet. The replacement of the existing bridge with the proposed CSPAs will require temporary dewatering. An impervious sandbag dike will be constructed approximately 20 feet upstream of the existing culvert to create a small pool. Clean water will temporarily be pumped around the construction area and will be discharged into a buffer area located approximately 90 feet downstream of the sandbag dike. Any dirty water located inside the construction area will be pumped into a silt bag. The dewatered area will total approximately 450 square feet or 0.01 acres. Once the new structure is in place, the impervious dike will be removed and preconstruction streambed elevations will be restored. Construction of this project will necessitate impacts to waters of the United States in the Yadkin River Basin. The culvert in question will carry an unnamed tributary to Cain Mill Branch (Class: Q. The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on February 14, 2002. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The existing bridl?e must be replaced due to its condition. The replacement CSPA lengths will be the minimum needed to create a safe crossing. By utilizing the erosion control measures as shown in the attached drawings, adverse impacts to streams in the area will be minimized. All appropriate BMPs will be used during construction. Page 7 of 12 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o. enr. state.nc.us/ncwetlands/strmgide. html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option. TO: Jean Manuele, USACOE Raleigh Field Office FROM: Maryellen Haggard, DOT Permit Coordinator Habitat Conservation Program DATE: February 26, 2002 SUBJECT: NCDOT bridge replacement of No. 139 on SR 1160 over unnamed tributary to Cain Mill Branch, Yadkin County The North Carolina Department of Transportation (NCDOT) is requesting a concurrence letter from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. Biologists on staff with the NCWRC have reviewed the proposed improvements and are familiar with habitat values of the project area. These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the Clean Water Act of 1977 (33 U.S.C. 466 et seq.). NCDOT proposes to replace Bridge No. 139 with (2) 50'x 66" x 51" CSPAs with a concrete headwall. The culvert instillation plus bank stabilization will impact 90 linear feet of an unnamed tributary to Cain Mill Branch. This project has the potential to impact the unnamed tributary through off-site sedimentation during construction and blockage of aquatic life movements through improper placement of the culvert. While our preference would be to replace the bridge with another spanning structure, we will not object to the project as proposed provided that the following conditions are implemented: Disturbance of the stream channel must be limited to only what is necessary to install the culvert. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 2. The pipes should be constructed so that all water flows through only one cell during low flow conditions. At least one pipe should be buried one foot into the substrate. The second pipe should be placed on the floodplain bench and function only when the stream channel is at flood stage. Stream Bridge No. 139, SR 1160 2 February 26, 2002 conditions above and below the "active" pipe should be maintained at pre- construction channel widths and depths to provide sediment transport and aquatic life movement. Where disrupted, natural floodplain benching should be restored. 3. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 4. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization, to minimize the use of riprap (or hard stabilization methods) and to maximize the use of native vegetation for stabilization and shade. 5. Work must be accomplished so that wet concrete does not contact stream water. 6. Only clean, tear-free sandbags should be used as temporary fill for dewatering, and should be removed without excessive disturbance of the natural stream bottom when construction is completed. The streambed should be returned to pre-construction conditions upon removal of the sandbags. Thank you for the opportunity to review and comment on this project during the early planning stages.
