Box 250 North Wilkesboro, NC 28659 Dear Mr. Slaughter: You have our approval, in accordance with the attached conditions and those listed below, to impact 125 linear feet of unnamed tributaries to Little Bugaboo Creek in order to upgrade SR 2012 (Tharpe Road) to paved standards in Wilkes County. The project must be constructed in accordance with your application dated 25 October 2001 (received 29 October 2001) and additional information received 16 November 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. . This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ in writing and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the7fitture) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Temporary or permanent herbaceous vegetation must be planted on all bare soil within 15 days of ground-disturbing activities to provide long term erosion control. 2. All structures required for this project shall be installed in such a manner that the original stream profiles are not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (widths and depths) are to be maintained above and below locations of culvert extensions to provide sediment transport and passage of aquatic life. Culverts shall be buried one foot, or to a depth at least 20% of their size, into the substrate. Any existing pipes that are perched, shall be removed and installed to provide passage of aquatic life. If bedrock is encountered which prevents the burial of pipes in the streambed, please contact the resource agencies [DWQ, WRC, USFWS] to discuss options other than blasting. 3. All work shall be performed during low flow conditions. 4. Disturbance of the stream channel must be limited to only what is necessary to perform the culvert installation. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. All pipes > 48 inches in diameter will be buried 1 foot. This will facilitate fish passage. This is one of our BMPs on all jurisdictional pipes and as such, applies to all of our permit requests. WRC usually includes this condition in their comments to the Corps as well, thus making it a condition of the 404 permit. Regarding item two (2) in your letter: I have reviewed the stream classification for the impacted waters on this project again. According to the BIMS report, which I accessed via the internet..... Little Bugaboo Creek is class: C "From source to a point 0.4 miles upstream of the mouth". Little Bugaboo Creek is class: WS-IV "From a point 0.4 miles upstream of the mouth to Big Bugaboo Creek". Tharpe road crosses Little Bugaboo Creek approximately 2 miles upstream of the mouth. As a result, it appears to me that these should be considered class: C waters. Total project length is approximately 1.25 miles. This project will require the replacement of one (1) intermittent cross line and one (1) bridge as shown below: 1) Replace existing 50'. x 36" CSP at station 2+80 with a 65' x 24" CSP. 2) Replace existing Bridge #500 at station 20+60 with a 60'x 142"x 91" arched pipe. Miscellaneous rip-rap impacts will total 50 linear feet or less. New stream imp ts =1251n. feet. Construction of this project will necessitate impacts to waters of the United States in the Yadkin River Basin. The above noted cross line at station 2+80 carries an intermittent unnamed tributary to Little Bugaboo Creek. The above noted bridge at station 20+60 crosses a perennial unnamed tributary to Little Bugaboo Creek. (Class: Q. The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on October 11, 2001. The subject project has been determined to have no effect on any listed threatened or endangered plant or animal species. According to the NCDOT web site, the NCDOT Historical Architecture Section has reviewed this project and determined that there are no NR/SL/DOE properties along this roadway that will be impacted by the proposed project (see attachment). An impervious sandbag dike will be constructed upstream of the existing bridge to create a small pool. Clean water will temporarily be pumped around the construction area and will be discharged into a buffer area. Any dirty water located inside the construction area will be pumped into a silt bag. The dewatered area will total approximately 320 square feet or 0.008 acres. Once the new structure is in place, the impervious dice will be removed and the stream will flow freely through the new arched pipe. Since this is an existing roadway, the minor modifications proposed in this application should not remove or degrade existing water quality uses. Any widening of the existing roadway will be directed away from any adjacent creek whenever possible with minimum fill placed in any buffer area. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control measures, a marked county map, a marked topography map and photographs. By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with the North Carolina Wildlife Resources Commission comment directly to you concerning the 404 Nationwide Permit application with a copy sent to me. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The existing roadway must be widened to achieve an acceptable section width, thus increasing public safety. The existing pipes must be replaced for the same reason. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete.
