The project shall be constructed according to your application dated March 18, 2002 and any conditions listed below. This approval shall act as your Authorization Certificate as required within the Tar-Pamlico River Riparian Area Protection Rules (15A NCAC 2B .0259). In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control. This approval is only valid for the purpose and design that you described in your application dated March 18, 2002. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. If you do not accept any of the conditions of this authorization, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Manuele NCDOT Coordinator Subject: Nash County Proposed Pipe Replacement on Sr- 1168 located at unnamed tributary of Turkey Creek , Preconstruction Notification for NWP #3/33 State Project No. 5.3232 (DWQ Minor Permit Fee $200) The North Carolina Department of Transportation (NCDOT) proposes to replace existingl@ 103"x 71"x 40' corrugated metal pipe arch (CMPA) with 1@ 117"x 79"x 40'(CSPA) with aluminum headwalls located on UT to Turkey Creek on SR 1128 near Middlesex. The purpose of this letter is to provide notification to the U.S. Army Corps of Engineers (COE) under Nationwide Permit, NWP #3, Maintenance Activities,NWP 33, Temporary Dewatering.This letter shall also provide courtesy notification to the North Carolina Department of Environment and Natural Resources (NCDENR) Division of Water Quality (DWQ) according to concurrence requirements for Water Quality Certification. Impacts to the waters of the United States The proposed pipe replacement will require minimal impacts to waters the Waters of the of the United States in the Tar River Basin. The minimum necessary amount of riprap will be placed adjacent to the headwalls in order to protect them from erosive scour during high water events. The existing 143"x 71" pipe will be remove only after dewatering the site. The stream flow is diverted by a pump around the work site back into the stream channel below the cofferdam.Water pumped from the dewatered work zone is pump into a Silt Bag, or a vegetated area-prior to entry back into the stream channel. No staging of construction equipment or storage of construction supplies will be allowed in or near wetlands or surface waters. Minimization: Sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be enforced during project construction. Continued coordination will occur with maintenance forces and the Environmental Officer during construction to minimize impacts to waters of the U.S. at these sites. Compensatory Mitigation: Construction of the project will result in only minimal impacts to waters of the U.S. Impacts have been minimized to the maximum extent possible during this stabilization project. Riparian Buffer Impacts The proposed pipe replacement project involves work within Zone 1 of a UT to Turkey Creek that is subject to the Tar/Pamlico Riparian Buffer Rule. According to the Table of Uses (15A NCCAC 02B.0233 (6) in the rule, road crossings (pipe replacements) is allowable with notification. Dewatering The NCDOT proposes to temporarily dewater the work zone in the immediate vicinity of the proposed project. This will involve the temporary placement of sheet metal cofferdams, or silt curtains located inserted upstream and down stream around the base of the slopes temporaily damming the flow in the stream to prevent any disturbed sediments from impacting turbidity levels in the stream in order to minimize temporary increases in turbidity due to construction.Vegetation and buffer zones impacts will be minimal during this process. Permit Issues The purpose of this letter is to provide notification under Section 404 Nationwide Permit (NWP) 3, Maintenance Activities for the of the U.S. Notification to the COE for the use of NWP 33 to temporaily dewater jurisdictional waters during the subject maintenace pipe replacement is provided as a courtesy for this project. Also, courtesy notification to the North Carolina division of Water Quality (NCDWQ) for Section 401 Water Quality Certificate (WQC) No. 3258 is provided for this project. NCDOT will comply with all conditions associated with the applicable NWP and WQC. Additionally, the purpose of this letter is to request authorization under a Section 404 NWP 33 to temporarily dewater the immediate work zone during the pipe replacement project. The 401 WQC No. 3114 (which corresponds to NWP 33) does not require written concurrence from the NCDWQ as NCDOT intends to comply with conditions for the WQC. Summary Temporary impacts to the stream channel will be the minimum necessary to effectively make the repairs, and all appropriate sediment and erosion control measures will be utilized. Temporary impacts to the riparian buffer will not exceed 1500 square feet and any vegetation removed will be restored within six months. NCDOT proposes to replace the existing pipe due to its structual condition in Nash County meeting current hydraulics design specifications.The existing stream channel will not be widened or significantly altered by the proposed project. NCDOT will need to remove a tree stump that is currently causing a scour down stream located in the middle of the stream to improve the streams hydraulics. The project is located in the Tar/Pamlico River Basin.Impacts associated with pipe replacement are allowable with notification under the Tar/Pamlico Riparian Buffer Rule.The NCDOT asks that the dewatering of the work zone be authorized under a Section 404 NWP 33.The NCDOT will adhere to all applicable Section 404 NWP's and Section 401 WQC's conditions. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.htmi. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option.
