We propose to increase pipe diameter on seven existing culverts on UT's to Grassy Creek. There will be no extension of pipes on jurisdictional waters. The pipe length at Site 6 will be reduced by 10 linear feet from existing. No stream relocation will be performed for the project. Existing channel morphology will be maintained upstream and downstream of the culvert. With the exception of the locations where wetlands are adjacent to the roadway, the culverts will be placed below existing streambed elevation. Riparian vegetation will be reestablished along disturbed areas associated with the culvert extension. Stormwater will be diverted through grass-lined ditches or vegetated buffers prior to entering streams. No significant effect on federally listed species (threatened or endangered) or their habitats is anticipated. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts., It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http•//h2o enr stite.nc.us/nc wetlands/stnnside.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Attached please find a survey plat with bottom contour elevations and associated cross sections for the area. The survey was performed on January 6, 2003. In addition, included in the package are three aerial photographs for your reference. These photographs depict the affected area prior to construction of the trestle, shortly after construction was completed, and after the trestle was removed. The survey plat and cross sections are depicted in metric units due to the survey control system for this project being metric. By utilizing the project survey control system we will be able to perform future monitoring as necessary. Our survey indicates that the trench is approximately 620 feet in length and averages approximately 60 feet in width. The water depth varies between eight and ten feet in depth. The normal water depth in this region averages 4 feet. There is also a deep depression located at the end of the former trestle. Our staff, prior to the removal efforts, noticed this depression. It formed over the life span of the trestle due to barge and tugboat turning movements. The survey also shows nearly the same volume of fill distributed around the vicinity of the trench. The total area of cut and fill is approximately 8.2 acres. The fill material is distributed around the disturbed area at an average depth of one foot. It should be noted that surveying the existing sound bottom and comparing against a theoretical original sound bottom generated these volumes. The original condition was developed by using average elevations from both north and south of the affected area. We trust this information will assist your efforts in making a determination of restoration and mitigative efforts. Attached please find a survey plat with bottom contour elevations and associated cross sections for the area. The survey was performed on January 6, 2003. In addition, included in the package are three aerial photographs for your reference. These photographs depict the affected area prior to construction of the trestle, shortly after construction was completed, and after the trestle was removed. The survey plat and cross sections are depicted in metric units due to the survey control system for this project being metric. By utilizing the project survey control system we will be able to perform future monitoring as necessary. Our survey indicates that the trench is approximately 620 feet in length and averages approximately 60 feet in width. The water depth varies between eight and ten feet in depth. The normal water depth in this region averages 4 feet. There is also a deep depression located at the end of the former trestle. Our staff, prior to the removal efforts, noticed this depression. It formed over the life span of the trestle due to barge and tugboat turning movements. The survey also shows nearly the same volume of fill distributed around the vicinity of the trench. The total area of cut and fill is approximately 8.2 acres. The fill material is distributed around the disturbed area at an average depth of one foot. It should be noted that surveying the existing sound bottom and comparing against a theoretical original sound bottom generated these volumes. The original condition was developed by using average elevations from both north and south of the affected area. We trust this information will assist your efforts in making a determination of restoration and mitigative efforts. LYNDO TIPPETT SECRETARY Dear Sir: Included with this letter are the documented conversations and letters that took place between NCDOT's resident engineer and the contractor Balfour Beatty. The topic of these conversations was the technique used to remove the trestle. Balfour Beatty believed their techniques were allowable under the permit. NCDOT informed them they had to immediately stop the operations that were going on and find another way to remove the trestle. The contractor did not stop and proceeded to carry out prop washing with the tugboat in order to gain access to the trestle. Once I became aware of this situation I notified Mike Bell with the COE on Oct. the 29. After this notification to the COE was made I did not hear any response from the regulatory agencies until Dec. 13 when Bill Arrington with the DCM called me to schedule a meeting to discuss the situation on-site. At the meeting on Dec. 19 DCM notified NCDOT that they are going to issue NCDOT a violation of the CAMA permit for the bridge. NCDOT provided all the documentation to DCM showing our attempts to stop the contractor and the phone call record to the COE. NCDOT recognized that the violation had to be sent to us rather than the contractor, since it was under our permit. NCDOT agreed to survey the dredged area to get a measurement on the volume of material that was dredged and to begin an effort to restore the area. Midgett, PE Resident Engineer During a visit to the site at approximately 1:00 p.m., I noticed Balfour Beatty working to remove the temporary load out trestle on the Manns Harbor shoreline. Balfour had a Manitowoc 4100 crane and barge positioned at the end of the trestle and was using a clam bucket to excavate a work channel to facilitate moving the barge closer to shore. I saw the crane dig several loads of material and cast it to the side of the barge into the sound. I telephoned the foreman, Mr. Tyrone Williams, and instructed him to cease his operations because they were in violation of the project environmental permits. The crane stopped working within five minutes. I received a telephone call several minutes later from Mike Hillyer, project manager. He was not on site, but in Wilmington supervising another NCDOT project which Balfour Beatty has a contract. He asked me why we had stopped the work and I informed him it was in violation of the permits and he needed to find a way to comply with permit conditions during the trestle removal. However, we have encountered difficulties in removing the trestle pipe pile due to the build up of silt around the pilings. In order to overcome this problem we would propose to use a clam bucket to displace the material around the pipe pile. The pile would then be extracted by conventional means and once the removal operation is complete, we would use the clam bucket to return the Sound bottom to its original condition. The construction of the trestle was authorized under section c. of the permit revision received by BBCI on September 24, 1998. We believe its use has served both BBCI and the Department (as the permit") extremely well. BBCI has an adequate means to get materials and resource in and out of the Project. The Department has seen a reduction of the temporary wetlands impacts as shown on the plans at time of bid by 0.73 acres. You propose in your letter to utilize a crane operated clam bucket to overcome difficulties in removing the trestle pipe pile due to the build up of silt around the pilings. You propose to remove this material with the clam bucket, extract the pile via a vibratory hammer, and then use the clam bucket to return the Sound bottom to its original condition. As we discussed by telephone yesterday, excavation of the Sound bottom with the clam bucket is in violation of our existing environmental permits. The movement of material from one place to another on the sound floor constitutes double handling and dredging. Neither of which is permissible under our existing permits. Furthermore the use of a tugboat to prop wash the material out of the way is a violation of the same conditions with the only difference being the methodology. We therefore request that you cease and desist your efforts to move this material out of your way. We do acknowledge that this area has silted in and as such, the water depths are not as deep as they were when the trestle was originally installed. The silt deposits are most likely a direct result of the trestle's impedance to natural sand migrations. But complying with the permit requirement to remove the trestle does not obviate the necessity of compliance with other permit conditions during the prosecution of the work. The Department is obliged to pursue a permit modification if requested by Balfour Beatty. We will not waive the contract requirements for completion during the period of review by the environmental agencies. As with past requests, in order for the modification request to be successful, it will have to be shown why the excavation is the only method available for completing the work. (i.e.: there are no alternate equipment setups that are capable of working in this area.) If you wish to pursue this modification, please advise. On Thursday Oct 24 they shuffled materials and equipment around on barges in attempt to lessen draft of the equipment. They did not work on Trestle removal on Friday. During a site visit on Friday I noticed Mike Hillyer had come back to the project from Wilmington. He had not been on site all week. On Monday, October 28, 1 worked in the Elizabeth City Office. Pablo Hernandez informed me that the equipment had somehow been moved closer to the shore over the weekend. We did not have inspectors on site over the weekend. I spoke with Mike Hillyer on Monday afternoon and informed him that we had spoken with the Corps of Engineers and our Permit Officers and concluded that we would be wasting our time in pursuing a dredging permit modification on his behalf because there were other options available to him. In order to gain permit approval we would have to show that we had minimized the effort. Since he could utilize sectional barges or other means dredging was not the least damaging alternative. Mr. Hillyer disagreed with me and ended the conversation. Mr. Hillyer told me he was still in Manns Harbor on Monday and had been on site over the weekend. These activities are in direct violation of Project environmental permits and previous written directives from the Engineer to suspend this activity. As we discussed by telephone on Monday, October 21, 2002 the Department has explored the possibility of a Permit Revision for this activity. However, the permit modification application must demonstrate that less environmentally damaging methods are not available. It appears that Balfour Beatty has chosen not to explore alternate methodology, and has instead, willfully proceeded with dredging in defiance of the permits and Department written directives. In attendance were Ms. Beth Burns, NC Division of Marine Fisheries (DMF); Clay Willis, Randy Midgett, Bob Capehart and Pablo Hernandez representing the Department of Transportation (DOT); Roy Brownlow, Bill Arrington and myself representing the Division of Coastal Management (DCM). The purpose of the onsite meeting was to investigate unauthorized development (excavation of a channel) from the aforementioned property approximately 600 feet into Croatan Sound. Department of Environment and Natural Resources. This requirement is imposed by N. C. General Statute (herein abbreviated N. C. G. S.) 113A-118. Information I have indicates that the DOT is legally responsible for the unauthorized excavation of a channel, approximately 50 feet wide by 600 feet long to -10' normal water level deep and the resulting deposit of fill in the Croatan Sound extending from the staging/casting site at the northwest corner of the Virginia Dare Bridge into the Croatan Sound. The channel excavation and the resulting deposition of spoil materials on the bottom of the Croatan Sound occurred within Estuarine Waters and Public Trust Areas which are Areas of Environmental Concern. No permit was issued to the DOT for this unauthorized development; therefore, I conclude that you are in violation of the Coastal Area Management Act. I request that you immediately CEASE AND DESIST any further unauthorized activities within designated Areas of Environmental Concern. The development that you have undertaken is not consistent with applicable standards and you will be required to restore the affected areas to their former conditions. A civil assessment of up to $2,500 may be assessed against any violator. Each day that the development described in this notice is continued or repeated may constitute a separate violation, which is subject to an additional assessment of up to $2,500. An injunction or criminal penalty may also be sought to enforce any violation per N.C.G.S. 113A-126. It is the policy of the Coastal Resources Commission to levy a minimum civil assessment of $500 not to exceed $2,500 against violations of this type. This is done to recoup some of the costs of investigating violations and/or to compensate the public for any damage to its natural resources. Whether a higher amount will be assessed depends on several factors, including the nature and area of the resources that were affected and the extent of the damage to them. If the requested restoration is not undertaken and completed satisfactorily, a substantially higher civil assessment will be levied and a court injunction will be sought ordering restoration. Based upon N. C. Administrative Code 7H - State Guidelines for Areas of Environmental Concern, the activities you have undertaken are not consistent with these regulations and could not have been permitted via the CAMA permit process. In order to better quantify the impacts to the resources and determine appropriate restoration and mitigation requirements, I am requesting that the DOT survey the unauthorized excavated and filled areas in the Croatan Sound and provide the DCM with a survey plat by January 18, 2003. This survey should show the current elevations of the disturbed areas and the adjacent areas not disturbed by the unauthorized dredging and spoiling activities. Once this information is received, we will develop and notify the DOT of restoration and mitigative efforts required for the project to be in compliance with CAMA. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
