According to the public notice, the North Carolina Department of Transportation (NCDOT) is proposing to fill S.43 acres of riverine wetlands and 770 linear feet of perennial stream for the relocation of 2.4 miles of US 64 between near Williamston, Martin County, North. Carolina. The U.S. Environmental Protection Agency, Region 4 Wetlands Section (EPA), has reviewed this proposal; and believes that the mitigation ratio should, at a minimum, be 2:1 for forested wetland restoration. A typical mitigation site is monitored for five years. For forested swamp restoration, the planted trees will certainly require longer than five years to become a typical mature forested wetland. Because of the temporal lag in functions of the mitigation site and the risk of failure, EPA does not believe that 1:1 mitigation ratio is adequate. Further, the project should not be authorized until the mitigation plan is approved. Thank you for the opportunity to comment on this project. Director o -c NORTH CAROLINA 401 WATER QUALITY CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500. This certification is a modification to Certification No. 3281 issued to the North Carolina Department of Transportation on April 11, 2000. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. Should your project change, you are required to notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: 1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of two manuals. Either the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices). The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit without appropriate modification of this permit. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities; 5. Additional compensatory mitigation is not required from the NC Division of Water Quality for this modification. 6. As you are aware, this project was authorized under Department of the Army Permit No. 199601404 on July 2, 1996 and again on July 10, 2000. During the construction of this project a need to modify the referenced permit has been identified. A temporary construction work pad is needed to set the steel girders at bent No. 3 for the bridge on ramp A. Each girder is 6' high with 1'6" flanges. The distance from CL of bearing to CL of bearing is 127.88'- 132.09'. This varies due to the bridge being located in a curve. These girders are spliced together using large bolts. The girder lengths are 87.49'- 90.39'. The weight of the girders is approximately 37,9841b-39,244 lb. It will require three cranes to set the girders. There will be two 100-ton cranes on each end of the girder to lift it into place. One of these cranes will have to be in the wetland . area at the end of the girder. There will be a 50 ton crane used to hold the girder on the caps until a second girder is set in place with the two 100 ton cranes. The steel diaphragms will then be bolted to stabilize the girders. The NCDOT has evaluated several options for setting the bridge girders. Utilizing the existing embankment was evaluated. However, the contractor does not think the work can be done safely off of the top of the embankment because the boom of each 100-ton crane would have to be extended too far in order to reach the girder for lifting it into place. The cranes would have to lean over the embankment for 40'-45', while supporting close to 40,000 lbs of steel girder. The NCDOT believes the only safe way to set the girders is to access this area with 4' of fill so that a level and stable construction area can be established. The total area needed for the temporary work pad is 1,759.39 square feet (0.04 acres). The placement of the girders is expected to take a maximum of 60 days. The amount of settlement will be less than 0.15'. This is based on the settlement gauge readings at an adjacent end bent. The total settlement was 0.15' for an earthen embankment that was 24.5' high with a 6 month waiting period. After construction of the girders is complete, all material will be removed and the area restored to natural ground. Since this will be a temporary activity within an extremely small area, the NCDOT does not propose mitigation for this activity. Please find. enclosed the revised construction drawings for the proposed construction access. The NCDOT hereby requests that Permit No. 199601404 be modified to reflect the changes described above. By copy of this letter, the Department is also requesting that the North Carolina Division of Water Quality revise the Section 401 Water Quality Certification Accordingly. The cranes would have to lean over the embankment for 40'-45', while supporting close to 40,000 lbs of steel girder. The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Field observations showed that the larger permitted 66" pipe would require more fill (in height) needed to cover the pipe at the ramp crossing. This pipe is proposed to be changed from a single 66" pipe to two 136 linear feet of 48" RCP in a dual line setup. The total length will be 136 linear feet of impact (at this pipe) with a maximum of 10 linear feet of rip rap at the outlet. Already permitted stream impacts occur at pipe 180 (located on page 5 of 12 of your modification sheets) the stream will be impacted for 244 linear feet with an additional 10 linear feet of rip-rap to prevent scour. The total length of impact (both permitted and proposed) is less than 550 linear feet of impact. The NC DOT has provided compensation for 770 linear feet of impact within the original permit, well above the actual stream impacts. There are no other stream impacts in this project. All other rip-rap proposed will occur within the blackwater swamp areas and therefore should be viewed as wetland impacts, not streams and has been compesated as such. The rip-rap will be placed a maximum of 10 linear feet from the pipe and the impact is listed within the table provided in the permit modifications. As stated previously, the stream excavation on page 5 of 12 of the modification sheets will not be performed. Field adjustments to alignment and grade on the crossline pipe will eliminate the need for channel excavation. This should be added as a special condition within the permit modification. WRP has accepted the additional 2.86 acres of additional wetlands to be compensated in a 2:1 ratio, making for a total of 5.72 acres of wetland restoration within the Roanoke River basin (HUC 03010107). It was readily apparent that 3' was not sufficient to install a 66" (5.5' culvert) • NCDOT Roadway Design and Hydraulics Units were contacted to correct the problem. • It was the design recommendation an alternate design of two 48" culverts be installed in lieu of the single 66" culvert. The two 48" culverts have the same flow characteristics as the originally planned 66" culvert, and were deemed necessary to handle the flow through the area while allowing adequate cover over the pipe and a 12" bury of the flowline. • The stream in this areas flows across a wide area, and not in a definitive channel. The permit application was deficient in the following areas: • The proposed impacts to streams may be inaccurate. The proposed modification lists no additional impacts to streams. However, the drawings presented in the proposed modification show areas of rip rap placement in the streams that was not previously permitted. Any additional impacts to streams will necessitate appropriate steam mitigation, since the original impacts for the same stream segment were greater than 150 linear feet, • The proposed modification shows the channelization of a stream at pipe No. 180. The original Certification does not show the proposed excavation of the stream. • The application indicates that the NC Wetlands Restoration Program (WRP) will accept the wetland mitigation for the proposed impacts. However, no correspondence from WRP agreeing to accept the mitigation has been received. Until we have documentation from WRP that guarantees the proposed mitigation will be accepted, we do -have a complete mitigation plan. • The proposed mitigation is for bottomland hardwood wetlands (PF06). The proposed impacts for project are to cypress-gum (blackwater type) swamp forests. We are not convinced that bottomland hardwood mitigation represents in-kind replacement for this type of lost wetlands. Permanent impacts will occur due to (A) change in median width from 46 feet to 60 feet within jurisdictional wetlands, (B) fill of slope from a 2:1 to 3:1 and rip-rap installation as part of the best management practices (C) earth fill for ramp 3C and ramp 3A, (D) mechanized land clearing, (E) wetland delineation realignment and (F) proposal for wetland compensation. We have provided a table that summarizes the amount of proposed wetland impact for each modification, five figure pages referring to page locations within the project and a vicinity map, 12 pages of modified permit drawings, a copy of a letter to WRP stating a need for wetlands compensation, and a check to Department of Water Quality-for permit costs. Note: the original permit drawing sheet numbers are different from the modified sheets. Section A: Change in Median Width This project's permit held a special condition (e) that states "the median width for the proposed highway will be 46-feet at all locations where the highway crosses jurisdictional waters". In the original 1996 permit, the project was designed for a typical 60-foot median, including wetlands, and was never redesigned in the 2000 permit to minimize these wetland impacts, a difference of 0.22 acres. The DOT proposes to use the 60-foot median as shown in the existing permit drawings (page 1,2,3,4,5 of the modifications). Since the 1996 and 2000 permit drawings show these wetlands as P.O. Section B: Fill of Slope from 2:1 to 3:1 and Best Management Practices Best management practices such as a more gradual slope and rip-rap below the pipes is proposed to prevent slope failure and erosion. Currently, the permit authorizes only 2:1 slopes on all shoulders and ramps to minimize initial wetland fill (page 1,2,3,4,5,6,9,11 & 12). The 3:1 slopes although it does have a greater initial impact, will provide for a more stable shoulder, and thereby minimizing long-term impact to the wetlands overall. The use of the 3:1 slope will impact 0.50 acres of wetlands. Rip-rap is proposed to be placed around permitted pipes (pages 1,2,3,4,5,6,9,and 11) at the discharge end of these pipes and will impact 0.08 acres of wetlands. One ditch will be removed (page 5) to minimize wetland impacts and to allow water to dissipate over the vegetation before reaching the wetland. Section C: Earth Fill For Ramp 3C and Ramp 3A Although the entire area was surveyed and studied by environmental planners to establish study corridors to avoid wetland impacts, Ramp 3C and Ramp 3A could not avoid wetland impact. Four wetland crossings are unavoidable due to the fact that these are floodplains that run perpendicular to the project. These impacts were not calculated for in the original permit. The ramp 3C will impact 0.56 acres of bottomland (PF06) wetlands dominated by cypress (Taxiodium distichum) and blackgum (Nyssa sylvatica) (page 7 & 8). The ramp 3A will impact 0.49 acres of bottomland (PF06) wetlands composed of red maple (Acer rubrum) and sweetgum (Liquidambar styrij7ua) (Page 10). Section D: Mechanical Land Clearing Mechanized land clearing provides a buffer for the project to allow for project access for positioning best management practices such as silt fences and in cases of unavoidable impacts such as wetland fill from slope failure or erosion damage. Trees are cut, but vegetation is allowed to re-establish after project is completed. Total impact proposed due to mechanized clearing is 1.22 acres (all pages). Section E: Wetland realignment with Field Observations and Road plans On page 6, wetlands were realigned with field observations and road plans. The original permit drawings show the entire intersection within wetlands. Field observations showed this to bean upland area. The wetland boundary was redefined as the area in which a thick organic layer overlaid sand. The new line is defined by a sharp contrast in the amount of organic layer on top of sandy/clay soils. This area in the southwest quadrant has been re-delineated as upland making a net decrease in wetland impacts of 0.50 acres. Section F. Compensation A total of 2.86 acres of PF06 bottomland wetland impacts within the Roanoke River basin are proposed to be impacted by this modification to the original permit. The NC DOT will provide compensation for these impacts in a 2:1 ratio as required by the Division of Water Quality and US Corps of Engineers making for a total of 5.72 acres of compensation through the VW program. The NCDOT is requesting modification to the Department of the Army Permit No. 199601404 issued July 10, 2000. Permanent impacts will occur due to (A) change in median width from 46 feet to 60 feet within jurisdictional wetlands, (B) fill of slope from a 2:1 to 3:1 and rip-rap installation as part of the best management practices (C) earth fill for ramp 3C and ramp 3A, (D) mechanized land clearing, (E) wetland delineation realignment and (F) proposal for wetland compensation. We have provided a table that summarizes the amount of proposed wetland impact for each modification, five figure pages referring to page locations within the project and a vicinity map, 12 pages of modified permit drawings, a copy of a letter to WRP stating a need for wetlands compensation, and a check to Department of Water Quality-for permit costs. Note: the original permit drawing sheet numbers are different from the modified sheets. Section A: Change in Median Width This project's permit held a special condition (e) that states "the median width for the proposed highway will be 46-feet at all locations where the highway crosses jurisdictional waters". In the original 1996 permit, the project was designed for a typical 60-foot median, including wetlands, and was never redesigned in the 2000 permit to minimize these wetland impacts, a difference of 0.22 acres. The DOT proposes to use the 60-foot median as shown in the existing permit drawings (page 1,2,3,4,5 of the modifications). Since the 1996 and 2000 permit drawings show these wetlands as P.O. Box 850, Edenton, NC 27932 - Phone: (252) 482-7977 Fax: (252) 482-8722 impacted by the 60-foot crossing, the wetlands have already been compensated within the original mitigation at the Huskanaw mitigation site. Section B: Fill of Slope from 2:1 to 3:1 and Best Management Practices Best management practices such as a more gradual slope and rip-rap below the pipes is proposed to prevent slope failure and erosion. Currently, the permit authorizes only 2:1 slopes on all shoulders and ramps to minimize initial wetland fill (page 1,2,3,4,5,6,9,11 & 12). The 3:1 slopes although it does have a greater initial impact, will provide for a more stable shoulder, and thereby minimizing long-term impact to the wetlands overall. The use of the 3:1 slope will impact 0.50 acres of wetlands. Rip-rap is proposed to be placed around permitted pipes (pages 1,2,3,4,5,6,9,and 11) at the discharge end of these pipes and will impact 0.08 acres of wetlands. One ditch will be removed (page 5) to minimize wetland impacts and to allow water to dissipate over the vegetation before reaching the wetland. Section C: Earth Fill For Ramp 3C and Ramp 3A Although the entire area was surveyed and studied by environmental planners to establish study corridors to avoid wetland impacts, Ramp 3C and Ramp 3A could not avoid wetland impact. Four wetland crossings are unavoidable due to the fact that these are floodplains that run perpendicular to the project. These impacts were not calculated for in the original permit. The ramp 3C will impact 0.56 acres of bottomland (PF06) wetlands dominated by cypress (Taxiodium distichum) and blackgum (Nyssa sylvatica) (page 7 & 8). The ramp 3A will impact 0.49 acres of bottomland (PF06) wetlands composed of red maple (Acer rubrum) and sweetgum (Liquidambar styriflua) (Page 10). Section D: Mechanical Land Clearing Mechanized land clearing provides a buffer for the project to allow for project access for positioning best management practices such as silt fences and in cases of unavoidable impacts such as wetland fill from slope failure or erosion damage. Trees are cut, but vegetation is allowed to re-establish after project is completed. Total impact proposed due to mechanized clearing is 1.22 acres (all pages). Section E: Wetland realignment with Field Observations and Road plans On page 6, wetlands were realigned with field observations and road plans. The original permit drawings show the entire intersection within wetlands. Field observations showed this to be an upland area. The wetland boundary was redefined as the area in which a thick organic layer overlaid sand. The new line is defined by a sharp contrast in the amount of organic layer on top of sandy/clay soils. This area in the southwest quadrant has been re-delineated as upland making a net decrease in wetland impacts of 0.50 acres. Section F. Compensation A total of 2.86 acres of PF06 bottomland wetland impacts within the Roanoke River basin are proposed to be impacted by this modification to the original permit. The NC DOT will provide compensation for these impacts in a 2:1 ratio as required by the Division of Water Quality and US Corps of Engineers making for a total of 5.72 acres of compensation through the WRP program. The NCDO is requesting modification to the Department of the Army Permit No. 199601404 iss d July 11, 1996. We have provided a table that summarizes the existing (permitted) 'mpact area, proposed (modified) permanent impact area, and proposed (mo 'fied) mechanized clearing area, four pages of vicinity maps, 12 pages of modified permit a ings, a copy of a letter to WRP stating a need for wetlands compensation, and a check to Department of Water Quality for permit costs. Note: the original permit drawing sheet numbers are different from the modified sheets. Permanent impacts will occur due to rip-rap installation or change in slope, usually from a 2:1 slope to a 3:1 as part of the modern best management practices. In addition, the impacts of the construction of ramp 3A were not included in the original permit. Mechanized clearing will be temporary impact but is needed for installation of best management practices and the buffer zone. Special Condition e. was not met in the design phase and was not realized prior to the contract being awarded. This condition affects wetlands shown on sheets 2,3,4, and 5 of the permit drawings. The median will consist of a 36-foot ditch section with an 8-foot grassed shoulder, totaling 52 feet. This area was included in the original permit mitigation. There are four separate floodplains (page 1,2,3,4) located in the northwest section of the project in close proximity to the railroad tracks. Pipes already permitted will be placed perpendicular to the proposed road to allow water equilibrium on both sides of the road. Best management practices need to be provided in the form of rip-rap around the discharge end of pipes and ditches and a 3:1 fill slope rather than the originally permitted P.O. In the southern quadrants of the intersection crossing the existing US 64 (page 5), rp-rap needs to be placed at the end of five (5) permitted pipes. Installation of rip-rap on pipe #178 and # 180 will impact wetlands as part of installation of best management practices. On page 6, wetlands were realigned with field observations and road plans. The original permit drawings show the entire intersection within wetlands. Field observations showed this to be an upland area. The wetland boundary was redefined as the area in which a thick organic layer overlaid sand. The new line is defined by a sharp contrast in the amount of organic layer on top of sandy/clay soils. The already permitted pipes will be stabilized with rip-rap. An area in the southwest quadrant of the new section has been re-delineated as upland: Tulip poplar, sweetgum, sycamore, pine, ebony spleenwort, honeysuckle, Virginia creeper, and wax myrtle. The ramp for 64 east will impact bottomland (PF06) wetlands dominated by cypress (Taxiodium distichum) and blackgum (Nyssa sylvatica). (Page 7,8,9, and 10). Currently only 15,609 square feet of the 64,534 square feet of permanent wetland impacts are permitted for the 64-entrance ramp. Ramp shoulders will consist of a 3:1 slope. The ramp for 64 west (Page 11& 12) will impact an additional 11,442 square feet of wetlands due to the flatter slope. Equalizer pipes will connect wetlands on both sides of road to balance hydrology and rip-rap will be placed at pipe discharge side for erosion control. Rip-rap will not be placed in bottom of pipe to allow for animal migration. Proposed wetland impacts through these permit modifications will be 1.6 acres of PF06 bottomland wetlands within the Roanoke River basin. The NC DOT will provide compensation for these impacts in a 2:1 ratio as required by the Division of Water Quality and US Corps of Engineers making for a total of 3.2 acres of compensation through the WRP program. The Corps and DWQ will be notified via a letter from WRP. The balance of wetland mitigation has been previously provided through the preservation of 27.15 acres of riverine wetlands at the Huskanaw Swamp Mitigation Site, 2500 feet of riverine stream compensation credits, and compensation credits of 5.43 acres of wetland impacts (PF01) through the Wetland Restoration Program (WRP).
