The North Carolina Department of Trans- T is withdrawing the prior The existing bridge length is 20 feet long x 20 feet wide and the stream channel bed at the bridge is -?6 feet wide. The bottomless arch structure is to be installed at the existing bridge location. It is proposed that temporary cofferdams will be placed along the natural existing benches under the bridge to retain these benches during construction and to direct streamflow through the work site during footing installation. The footings are to be installed behind the existing bridge abutments; therefore, the impacts associated with the bottomless concrete arch are comparable to the existing impacts of the bridge. It is also proposed that a six-inch high riprap faced floodplain bench will be constructed at the inlet and outlet of the bottomless concrete arch. These constructed benches are to be Nationwide #14 permit application and g of a NWP #3, Maintenance and NWP #33, Temp Coness, an atering. NCDOT proposes the use of a 24' wide by 'high coness arc lvert on 36' long footings with inlet and outlet head at Brithe double line of 50' long CMPA previously authorized. Mr. John Hendrix Page 2- Bridge #231, SR 1338 August 16, 2002 connected to the existing natural benches (retained during construction) to maintain normal channel dimensions before, after and through the structure. Riprap on filter fabric will also be used around the headwalls for structure protection. The bridge abutments are to be removed and the area impacted by the temporary construction and dewatering activities will be restored to their preconstruction condition upon project completion. As noted in the previous permit application dated l/19/01, there were no threatened or endangered species observed within the project area. Enclosed are copies of the previous 401 and 404 authorizations for this project. Also enclosed is a copy of the "No comment" letter issued by the N.C. State Historic Preservation Office for the replacement of Bridge #231, SR 1338, Lincoln County. Please note that the previous application for Bridge #231 replacement erroneously indicated that the classification of Carpenter Creek as being a WS-IV watershed. Carpenter Creek is actually classified Class C waters (15A NCAC 2B.0308, p. 25). I have enclosed a PCN application, a sketch of planned activities, and location maps relative to the proposed project. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. If full-size plans are reduced to a small scale such that the final version is illegible, the applicant will be informed that the project has been placed on hold until decipherable maps are provided. 1. This bridge replacement proiect (replacement with a double barrel 50-foot long CMPA with associated riprap was previously authorized by a Nationwide 14 permit Action ID 200130430- issued 5/7/010 and the DWQ Project Number 010091- issued 1/25/01) NCDOT is withdrawing this original permit request submitted on 1/19/01 and is submitting a permit request for the use of a Nationwide #3 and #33 for the construction of the 24' wide x 6' high concrete bottomless arch on 36' long footings at this location. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. This project was originally designed and authorized under NW #14 for the installation of a double, 50' long CMPA. NCDOT has reevaluated the project and has subsequently chosen the alternative lower impact design of a 24' wide x 6' high bottomless. concrete arch on 36' long footings The footings are to be installed behind the existing age abutments• therefore impacts associated with this structure are comparable to the existing impacts of the bridge. VIIL Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetiands/strmy,ide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions Page 9 of 12 and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. The NCDOT proposes to replace existing spanning bridges with concrete box culverts or CMPA at the above sites. Removal of the existing bridges should not be allowed to impact waters. At the SR1338 site, a double line of CMPA (112"x75") 50' long will be installed. At SRI 180 site two- (2) 50' long concrete box culverts (14'x9') will be installed. While our preference would be to replace the bridges with spanning structures, we will not object to the use of culverts provided the following conditions are implemented: 1. The culverts should be designed and constructed large enough so that they can be installed approximately one foot below streambed grade so that all waters can flow through uninterrupted and without damming or freefalling on either end during low flow conditions to maintain aquatic life passage. Where two barrels will be installed, only the main barrel should receive base flow whenever practicable. The other barrel should only receive flows during storm events. The dimension, pattern, and profile of the natural stream and floodplain above and below the lower barrel should be mimicked throughout the project as practicable by not widening or shallowing natural stream conditions. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 3. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 4. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 5. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization when practicable.
