Gilmore, P.E., Manager Planning and Environmental Branch North Carolina Department of Transportation 1548 Mail Service Center Raleigh, North Carolina, 27699-1548 Dear Mr. Gilmore: You have our approval, as described in your application dated January 2, 2002, and in accordance with the attached conditions and those listed below, to place fill material in 0.06 acres of wetlands and 17 linear feet of streams for the purpose of widening and improving NC 42 at the intersection of NC 42 and US 70 in Johnston County. The project shall be constructed in accordance with your application dated January 2, 2002. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This certification corresponds to the Nationwide Permit Number 14 issued by the Corps of Engineers. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control. Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). ). This approval shall expire with the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Stormwater shall be directed to sheetflow at nonerosive velocities through the protected stream buffers. 2. Manuele NCDOT Coordinator Subject: Proposed Widening of NC 42 at intersection with US 70 in Clayton, Johnston County. State Project No.6.317084 (DWQ Minor Permit Fee $200) Dear Ms. Manuele; The North Carolina Department of Transportation (NCDOT) proposes to widen NC 42 by approximately four feet to the south side in order to provide an additional turn lane from US 70 eastbound, onto NC 42 eastbound. The proposed impacts fall within the footprint of the future proposed NC 42 widening (TIP Project U-3825). Wetland and stream impacts have been delineated in the project area for U-3825, and have been used to calculate impacts for this project. Total project length is approximately 2900 feet or 0.067 miles. The proposed widening of NC 42 has been identified as a necessary safety improvement, needed to reduce traffic congestion for eastbound traffic turning from US 70 onto NC 42. The left turn lane on US 70 frequently has over one mile of vehicles waiting to turn at this intersection during peak traffic volumes, creating an unsafe situation. Funds have been allocated to correct this problem, for the interim period, until U-3825 construction is completed in 2005. It is anticipated that NCDOT could obtain authorization to make minimal interim impacts for the subject project from the USACE Post Office Box 3165, Wilson, North Carolina 27895-3165 and DENR/DWQ under Nationwide Permit 1.4 and Water Quality Certification Number 3289. Impacts to Waters of the United States Construction of the project will necessitate minimal impacts to waters of the United States in the Neuse River Basin. The project crosses two unnamed ephemeral tributaries to the Neuse River, which are shown in the following table. Impacts to the stream from construction will result from extension of the existing pipes with collars at the outlet ends. Total impacts will include less than 50 square feet or less than 0.01 acres of surface waters, and an additional impact of less than 20 linear feeX,of stream channel. Length (ft.) 18+50 42 85 42 90 36+00 18 48 18 60 According to the wetland delineation conducted in April, 2001, by Jill Holmes of the Project Development and Environmental Analysis Branch of NCDOT, approximately 0.06 acres of wetlands associated with roadside shoulder and ditch construction are anticipated due to the subject project. The appropriate Wetland Determination Data Forms are included as Attachment A for the impact areas. "Wetland K" is located at Station 36+00. Waters of the U.S. Mitigation Avoidance: All wetlands or surface waters not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in or near wetlands or surface waters. Minimization: The side slopes have been steepened to the extent possible at jurisdictional sites. Sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be strictly enforced during project construction. Continued coordination will occur with maintenance forces and the Environmental Officer during construction to minimize impacts to waters of the U.S. at these sites. Compensatory Mitigation: Construction of the project will result in 0.06 acres of impacts to waters of the U.S. Impacts have been minimized to the maximum extent possible during the design process. Riparian Buffer Impacts The construction of the project involves two road crossings of ephemeral channels that are not subject to the Neuse Riparian Buffer Rule. Mr. Steve Mitchell of the Division of Water Quality, on October 25, 2001 conducted a stream determination, at the crossings listed above. Both channels were determined to be not subject to the Neuse River Riparian Buffer Rules. , 41 Dewatering No temporary dewatering or temporary access will be required during the construction of the subject project. Regulatory Review According to the attached letter from the State Historic Preservation Office (SHPO), dated June 7, 1999, there are no structures of historical or of architectural importance located within the planning area for R-3825. Since the subject project footprint falls entirely within that of R-3825, no further coordination should be required. (See Attachment B.) The archeological site (31 JT342), noted in the above-referenced letter, is located outside of the subject project footprint, and was found to be ineligible for inclusion of the National Register of Historic Places. Please references Attachment C for the referenced letter from the SHPO, dated March 22, 2001, and reference map for the site. Ms. Jill Holmes, Environmental Specialist for the Project Development and Environmental Analysis Branch of NCDOT, reviewed the subject project, for the presence of listed threatened and endangered species. The subject project has been determined to have no effect on any listed threatened or endangered plant or animal species. Permit Issues The purpose of this letter is to request authorization under Section 404 Nationwide Permit (NWP) 14, Linear Transportation Crossings. Also, notification to the North Carolina Division of Water Quality (NCDWQ) for Section 401 Water Quality Certificate (WQC) No. 3289 is required for this project. NCDOT will comply with all conditions associated with this NWP and WQC. Summary NCDOT proposes to widen NC 42 eastbound for approximately 2900 feet, to provide an additional turn lane from US 70 eastbound in Clayton, in Johnston County. Impacts associated with the extension of the existing pipes at two crossings at this project include 50 square feet (<0.001 acres) of additional fill in surface water and 20 linear feet existing channel impacted. Approximately 2850 square feet (0.06 acres) of wetland impacts are anticipated as a result of the subject project. The project is located in the Neuse River Basin. Both stream channel crossings were determinc(rto be not subject to the Neuse River Riparian Buffer Rule, by DWQ. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, buildirig'ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Page 9 of 12 I . Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. IX. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option. Wetlands are associated with this stream. NC: 42 crosses UT #N I approximately 0.6 mi (1.0 km) cast of the intersection of NC 42 and US 70.' Dominant vegetation included a giant cane, greenbrier, netted chain fern (Wooclivur(liu oreohaa), blackberry, river birch, and black cherry. 4.2.1 Federally-protected Species Picoides horealis (Red-Cockaded Woodpecker) Endangered Animal Family: I icidae Date Listed: 13 October 1970 BIOLOGICAL CONCLUSION NO EFFEC'F Potential habitat for the RCW is located within the project study area. A known population was visited on 13 December 2000. Red-cockaded woodpeckers, ideal habitat, and active cavities were observed. A survey for red-cockaded woodpeckers in the potential habitat areas at the project site was conducted on 8 March 2001 by Jared Gray and Jill Holmes. No red- Cockaclcd \\oodpcckers were observed. nor \Nere nesting cavities. or any other evidence that they C7 - may be using the project study area. A review of the NI IP database of Rare Species and Unique Habitats on 15 November 2000 revealed no known occurrences of the red cockaded woodpecker within 1.0 mi (1.6 km) of the project study at-ca. Therefore it can be concluded that construction of this project will not impact this species. Alasmidonta heterodnn (Dwarf Wedgemussel) Endangered Animal Family: Unionidac Date Listed: 14 March 1990 BIOLOGICAL CONCLUSION UNRESOLVED Potential habitat for the dwarf wedgemussel is located within the project study area. A survey for the dwarf wedgemussel will need to be conducted. E•lliptio steinstansana (Tar Spinymussel) Endangered Animal Family: Unionidac Date listed: 27 June 1985 13101,0GICAL CONCLUSION UNRESOLVED Potential habitat for the tar Spinymussel is located within the project study area. A survey will need to be conducted. Rhus inichanxii (Michaux's Sumac) Endangered* Plant Family: Cashew (Anacardiaceae) Date Listed: 28 September 1989 Best Search 'T'ime: June (May through October) Potential habitat for Michaux's sumac is present within the project study area. A known population was observed prior to the site visit. A plant by plant survey for Michaux's sumac where habitat existed along the project corridor was conducted on 25 May 2001 by Jill Holmes and Jared Gray. No individual plants or populations of Michaux's sumac were observed. A review of the North Carolina Natural Heritage Program database of Rare Species and Unique I labitats on 15 November 2000 revealed no known occurrences of this species within 1.6 km (1.0 mi) of the project study area.
