You have our approval, in accordance with the attached conditions and those listed below, to
permanently impact 68 linear feet and temporarily impact 30 linear feet of unnamed tributaries to
South Prong Stinking Quarter Creek in order to upgrade SR 3344 (Lineberry Road) in Guilford
County. The project should be constructed in accordance with your application dated May 1, 2002
(received May 13, 2002). After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Nos. 3366 and 3375 corresponding to the U.S. Army Corps of
Engineers Nationwide Permit Numbers 33 and 14. In addition, you should acquire any other federal,
state or local permits before you proceed with your project including (but not limited to) Sediment
and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will
expire with the accompanying 404 permit unless otherwise specified in the Water Quality
Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us, in writing, and send us a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, or if stream impacts exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For
this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
NCDOT shall use Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) and Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A
NCAC 413 .0024) must be implemented prior to any ground-disturbing activities to minimize
impacts to downstream aquatic resources. Temporary or permanent herbaceous vegetation shall
be planted on all bare soil within 10 days of ground-disturbing activities to provide long term
erosion control.
Riparian vegetation must be reestablished within the construction limits of the project by the end
of the growing season following completion of construction.
NCDOT is encouraged to use existing on-site vegetation and materials for stream bank
stabilization and to minimize the use of rip rap.

SUBJECT: Guilford County, Upgrade of Lineberry Road (SR 3344) from an unpaved secondary
road to a paved secondary road.
The North Carolina Department of Transportation (NCDOT) proposes to upgrade Lineberry Road
(SR 3344) from an unpaved to a paved secondary road to reduce future maintenance needs and
increase traffic safety. This activity will result in impacts to streams due to the replacement and
extension of crossline pipes to facilitate travel lane and shoulder widening. Total project length is
1.01 miles. The replacements, which are occurring in US waters within the Cape Fear River Basin,
are as follows:
RCP = reinforced concrete pipe; CMP = Corrugated metal pipe; CMPA = Corrugated metal pipe arch.

Permanent impacts will result from stream enclosure and placement of rip rap energy dissipaters
above the ordinary high water mark. Rip rap energy dissipaters will be placed on each side of the
newly installed pipes (the downstream energy dissipater will be located within the confines of the
silt screen). The placement of a rock silt screen downstream from each pipe outlet will result in 10
linear feet of temporary impact per crossing. Within 15 working days of the of the pipe replacement
activities the rock silt screen will be entirely removed, and natural stream contours will be restored
and seeded. On-site detours will not be provided due to the short duration of the pipe replacement
activities.
Required mitigation is not anticipated, as the impacts do not exceed 150 feet. The project
is not located in a High Quality Water. The project will not impact an Essential Fisheries Habitat.
No Threatened or Endangered species were observed during field surveys conducted by Len Smith
for species known to occur in Guilford County.
Records from the NCDOT Historic Architect indicate that no National Register, Study List, or
Determination of Eligibility properties are located within the project area.
Secondary impacts will be minimized by strict enforcement of Best Management Practices for the
protection of surface waters, restrictions against the staging of equipment in or adjacent to waters of
the US, and coordination with the Division Environmental Officer.
The NCDOT anticipates that the pipe replacement activities will be authorized under Nationwide
Permit 14. This letter is a request for authorization under General Water Quality Certification
#3375 from the NC Division of Water Quality. Enclosed, please find seven (7) copies a Pre-
Construction Notification package for you review. Construction is anticipated to begin
as soon as practicable following authorization and take 6 weeks to complete.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Pipe replacement and widening activities are necessary to increase travel lane and shoulder width
to current construction standards Impacts will be minimized by strict enforcement of Best
Management Practices for the protection of wetland and surface waters, restrictions against the
staging of equipment in or adjacent to waters of the US, and coordination with the Division
Environmental Officer.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
littl2://h2o.enr.state.ne.us/ncwetlands/stn-ngide.btmi.

Construction Sequence and Erosion Control Plan for Replacement of
Pipe with Pipe Using a Pump Around - Guilford County, SR 3344
Work to begin as soon as practicable following authorization.
Construction is anticipated to take 4 weeks.
1. Install a rock silt dam downstream of the work area to prevent incidental sediment
loss.
2. Install ABC aggregate or a less intrusive dewatering device to allow dewatering of
the work area.
3. Install pumps to divert flow around the work area.
4. Remove one existing line of 36' long 36" RC pipe.
5. Excavate to sufficient depth to allow 20% burial of the pipe, place base stone, and
single line of 60' long 48" CM pipe.
6. Backfill the new line of pipe and place rip rap only as needed.
7. Starting from the downstream end, remove the dewatering structure and restore the
natural stream contours.
8. Notify landscape department for final seeding.
9. Silt fences to be placed as site conditions require.
10. A 10' X 15' dirt bag will be used to remove excess water in the hole where the new
pipe is being replaced.
11. Site conditions and weather may alter these plans.
12. A method less intrusive than a pump around system may be utilized if site conditions
allow.

Secondary Roads Rural Paving Program. We have map-checked all submitted roads at the NC State
Historic Preservation Office (SHPO) for the following currently designated historic property types:
National Register (NR), Study List (SL), and Determined Eligible (DOE) properties. Based on the map-
check reviews, we are writing (1) to inform you of the current historic compliance status for your SR Rural
Paving Program; (2) to notify you of the SR projects that definitely will require our fieldwork; (3) to
provide you with information that can be included (or attached) in your cover letter for a Pre-Construction
Notification.
If coordination is required, the NCDOT staff architectural historian will notify the Division/District
Maintenance Engineers to start a mitigation effort involving environmental commitment agreeable to all
parties. Documentation will be coordinated by the staff architectural historian with the Division
Environmental Officer.
