Dear Mr. Gilmore:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 80 linear feet of streams for replacing Bridge Number 212 with a arch pipe on SR 1325 in
Granville County. The project shall be constructed in accordance with your application dated February 6,
2002. After reviewing your application, we have decided that this till is covered by General Water Quality
Certification Number 3289. This certification corresponds to the Nationwide Permit Number 14 issued by
the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you
proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and
Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit, unless
otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby
responsible for complying with all the conditions. If total wetland tills for this project (now or in the future)
exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to
remain valid, you must adhere to the conditions listed in the attached certification.
1.) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of
Completion Form" to notify DWQ when all work included in the 401 Certification has been completed.
The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the
Division of Water Quality upon completion of the project.
2.) For the 80 linear feet of streams being impacted due to site dewatering activties, the site shall be graded
to its preconstruction contours and revegetated with native vegetation.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions
are final and binding unless you ask for a hearing.

PAMLICO/RANDLEMAN BUFFER RULES
This General Certification is issued in conformity with the requirements of Section 401, Public Laws 92-
500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ)
Regulations in 15A NCAC 2H, Section .0500 and 15A NCAC 2B .0200 for the discharge of fill material to
waters and wetland areas as described in 33 CFR 330 Appendix A (B) (14) of the Corps of Engineers
regulations (i.e., Nationwide Permit No. 14 and Regional General Permit 198200031) and for the Neuse,
Tar-Pamlico and Randleman Buffer
Rules (15A NCAC 2B .0233, .0259 and .0250). The category of activities shall include any fill activity for
road crossing and is limited to fill less than one-third of an acre. This Certification replaces Water Quality
Certification Number 2177 issued on November 5, 1987, Water Quality Certification Number 2666 issued
on January 21, 1992, Water Quality Certification Number 2732 issued on May 1, 1992 and Water Quality
Certification Number 3103 issued on February 11, 1997. This WQC is rescinded when the Corps of
Engineers re-authorizes Nationwide
Permit 14 or Regional General Permit 198200031 when deemed appropriate by the Director of the DWQ.
The State of North Carolina certifies that the specified category of activity will not violate applicable
portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in
accordance with the conditions hereinafter set forth.
Conditions of Certification:
1. Proposed till or substantial modification of wetlands or waters (including streams) under this General
Certification requires application to and prior written concurrence from the Division of Water Quality;
2. In accordance with North Carolina General Statute Section 143-215.3D(e), any application for a 401
Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit,
one payment to both agencies shall be submitted and will be the higher of the two fees;
3. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be required for impacts to
streams and/or wetlands. In addition, buffer mitigation may be required for any project with Buffer
Rules in effect at the time of application. A determination of buffer, wetland and stream mitigation
requirements shall be made for any Certification for this Nationwide Permit. The most current design
and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval
as required in those protocols;
4. For any project involving a stream re-alignment, a stream relocation plan must be included with the 401
application for written DWQ approval. Relocated stream designs should include the same dimensions,
patterns and profiles as the existing channel, to the maximum extent practical. The new channel should
be constructed in the dry and water shall not be turned into the new channel until the banks are
stabilized. Vegetation used for bank stabilization shall be limited to native woody species, and should
include establishment of a 30 foot wide wooded and an adjacent 20 foot wide vegetated buffer on both
sides of the relocated channel to the maximum extent practical. A transitional phase incorporating coir

fiber and seedling establishment is allowable. Also, rip-rap may be allowed if it is necessary to maintain
the physical integrity of the stream, but the applicant must provide written justification and any
calculations used to determine the extent of rip-rap coverage requested. If suitable stream mitigation is
not practical on-site, then stream impact will need to be mitigated elsewhere;
Impacts to any stream length in the Neuse, Tar-Pamlico and Randleman River Basins requires written
concurrence from DWQ in accordance with 15A NCAC 2B.0233, 15A NCAC 2B .0259 and .0250 and
15A NCAC 2H .0500. New development activities located in the protected 50-foot wide riparian areas
(whether jurisdictional wetlands or not) within the Neuse, Tar-Pamlico and Randleman River Basins
shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0233,
15A NCAC 2B .0259 and .0250. All new development shall be located, designed, constructed, and
maintained to have minimal disturbance to protect water quality to the maximum extent practicable
through the use of best management practices. Activities listed as "exempt" from these rules do not need
to apply for written concurrence under this Certification;
6. Placement of culverts and other structures in waters, streams, and wetlands must be placed below the
elevation of the streambed to allow low flow passage of water and aquatic life unless it can be shown to
DWQ that providing passage would be impractical. Design and placement of culverts and other
structures including temporary erosion control measures shall not be conducted in a manner that may
result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down stream
of the above structures. The applicant is required to provide evidence that the equilibrium shall be
maintained if requested in writing by DWQ. Additionally, when roadways, causeways or other fill
projects are constructed across FEMA-designated floodways or wetlands, openings such as culverts or
bridges must be provided to maintain the natural hydrology of the system as well as prevent constriction
of the floodway that may result in destabilization of streams or wetlands;
7. If this Certification is used to access building sites, all lots owned by the applicant must be buildable
without additional fill beyond that allowed under other General Certifications. Deed restrictions must be
placed on the remaining wetlands and streams on these lots to restrict future wetland and stream till.
DWQ shall be sent copies of all deed restrictions applied to these lots;
8. That appropriate sediment and erosion control practices which equal or exceed those outlined in the
most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual"
or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the
Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full
compliance with all specifications governing the proper design, installation and operation and
maintenance of such Best Management Practices in order to assure compliance with the appropriate
turbidity water quality standard;
9. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural
grade restored within two months after the Division of Land Resources has released the project;
10. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the
state until the concrete has hardened;

11. This Certification shall be utilized for roads from natural high ground to natural high ground. The
Certification for Nationwide Permit 18 may not be used in conjunction with this Certification to create
high ground for road access;
12. If an environmental document is required, this Certification is not valid until a Finding of No
Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse. All
water quality-related conditions of the FONSI or ROD shall become conditions of this Certification;
13. That additional site-specific conditions may be added to projects proposed under this Certification in
order to ensure compliance with all applicable water quality and effluent standards;
14. When written concurrence is required, the applicant is required to use the enclosed "Certification of
Completion Form" to notify DWQ when all work included in the 401 Certification has been completed;
15. Concurrence from DWQ that this Certification applies to an individual project shall expire three years
from the date of the cover letter from DWQ or on the same day as the expiration date of the
corresponding Nationwide Permit 14 and Regional General Permit 198200031 whichever is sooner.
Non-compliance with or violation of the conditions herein set forth by a specific fill project may result in
revocation of this Certification for the project and may also result in criminal and/or civil penalties.
The Director of the North Carolina Division of Water Quality may require submission of a formal
application for individual certification for any project in this category of activity, if it is determined that the
project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing
uses of the wetland, stream or downstream waters are precluded.
Public hearings may be held for specific applications or group of applications prior to a Certification
decision if deemed in the public's best interest by the Director of the North Carolina Division of Water
Quality.

The North Carolina Department of Transportation (NCDOT) plans to replace
Bridge No. 212 over an unnamed tributary to Grassy Creek on SR 1325 in Granville
County. Construction of the project will necessitate impacts to waters of the United
States. Application was made for a Department of the Army Section 404 Nationwide
Permit (NWP) 14 and NWP 33 and North Carolina Division of Water Quality (NCDWQ)
Section 401 Water Quality Certification (WQC) No. 3289 and WQC No. 3114 by permit
application dated February 6, 2002.
An automated payment procedure has recently been implemented between the
NCDOT and NCDWQ. This procedure will enable the Division to apply for the 401
WQC without submitting a check for this permit application. This new procedure will
provide payment to the NCDWQ by charging the permit application fee directly to the
appropriate NCDOT work order.
The NCDOT work order for this project is 5.3752007. Project impacts are less
than one acre of cumulative wetland/water impacts and less than 150 linear feet
cumulative impacts to streams; therefore. please note that a fee of $200.00 is renuired_for

The North Carolina Department of Transportation (NCDOT) plans to replace
Bridge No. 212 over an unnamed perennial tributary to Grassy Creek on SR 1325 in
Granville County (Figures 1 and 2). The existing one-span bridge (1@ 187") was
constructed in 1956 and has a timber floor on timber joist piles. This bridge is currently
in poor condition; it is structurally deficient with a sufficiency rating of 53 out of 100
points. It has been determined that this structure must be replaced. The proposed
replacement structures are 2 @ 128" x 83" corrugated metal pipe arches that are 60 feet
long (Figure 2).
Impacts to Waters of the United States
Construction of the project involving replacement of the existing bridge will
necessitate impact to waters of the United States in the Roanoke River basin. Here the
project study area crosses an unnamed perennial tributary to Grassy Creek (DWQ Index
No. 23-2-(1)) and Best Usage Classification C. -
Bridge Demolition and Removal
Bridge No. 212 has a timber floor covered with broken asphalt on timber joist
piles. The bridge will be removed under-Case 3, where there are no special restrictions
beyond those outlined in Best Management Practices for Bridge Demolition and
Removal. The bridge construction site will be dewatered during construction, thus
precluding the dropping of bridge components into live water.

Bridge Replacement
Impacts to the perennial tributary at the project from the replacement of the
existing bridge with two corrugated metal pipe arches (including a headwall at the inlets
and minimal amounts of rip rap to protect the structure) include 80 feet existing channel
impacted and 0.02 acre fill in surface water (Figure 3). Bedrock has been identified in
the streambed at the proposed location of the pipe. All reasonable and practicable efforts
will be made to bury the pipe as low as possible during project construction.
Dewaterina
The NCDOT will dewater the perennial stream during the construction of the
project. This will involve the placement of sheet piling in the stream channel
approximately 10 feet upstream of the proposed pipe inlets and approximately 10 feet
downstream of the proposed pipe outlets. To maintain water flow during construction,
water upstream of this impervious structure will be temporarily pumped out and
conveyed downstream of the structure. The stream will be dewatered less than three
weeks. This will result in temporary impacts to the surface water. Temporary impacts
to the perennial stream from this activity will result in the dewatering of 0.02 ac of stream
bed and 80 linear feet stream channel. The sheet piling will be removed after
construction.
Waters of the U.S. Mitigation
Avoidance: All wetlands or surface waters not affected by the project will be
protected from unnecessary encroachment. No staging of construction equipment or
storage of construction supplies will be allowed in or near wetlands or surface waters.
Minimization: Strict enforcement of sedimentation and erosion control by Best
Management Practices for the protection of wetlands and surface waters will be enforced
during project construction. Continued coordination will occur with maintenance forces
and the Environmental Officer during construction to minimize impacts to waters of the
United States.
Compensatory Mitigation: Construction of the project will result in only minimal
impacts to waters of the United States. Impacts have been minimized to the maximum
extent possible during the design process. Due to minimal impactsrcompensatory
mitigation for impacts to waters of the United States will not be provided for this project.
Protected Species
Plants and animals with federal classifications of Endangered, Threatened,
Proposed Endangered and Proposed Threatened are protected under provisions of Section
7 and Section 9 of the ESA. As of February 27, 2001, there are four federally protected
species listed for Granville CMMty. They include bald eagle (Haliaeetus leucocephalus),

dwarf wedgemussel (Alasmidonta heterodon), smooth coneflower (Echinacea laevigata)
and harperella (Ptilimnium nodosum).
bale eagle--Biological Conclusion: No Effect
Although it is possible that eagles may occasionally fly over the project, the lack
of appropriate habitat for feeding, nesting, roosting and perching, makes it unlikely that
eagles use specific sites at the project. No bald eagle foraging or nesting or other activity
was observed at the project study area during the site visits on September 14, 2001,
November 30, 2001 and February 1, 2002. Impacts to bald eagle will not occur from
project construction.
dwarf wedgemussel --Biological Conclusion: No Effect
A mussel survey was conducted at the site by NCDOT Division Environmental
Officer Chris Murray and NCDOT Biologists Jeff Burleson and Sharon Snider on
February 1, 2002. The survey was conducted at the bridge site and for a distance of 350
feet downstream and 450 feet upstream. Survey methodology included wading using
visual (batiscope) and tactile methods along the banks and throughout the stream. During
the 4.5 man-hour survey, Pyganodon sp. and Elliptio sp. were observed. Given the
survey results, it can be determined that impacts to the dwarf wedgemussel will not occur
from project construction.
Smooth coneflower--B io logical Conclusion: No Effect
Suitable habitat for smooth coneflower sumac is present along the irregularly
maintained roadside shoulder. A plant-by-plant survey was conducted during the site
visit on September 14, 2001 by NCDOT Division Environmental Officer Chris Murray.
No populations of smooth coneflower were observed during the site visit. Impacts to
smooth coneflower will not occur from project construction.
harperella--B io logical Conclusion: No Effect
Suitable habitat for harperella is not present at the site, as the unnamed perennial
tributary to Grassy Creek is not characterized as a rocky stream. Impacts to harperella
will not occur from project construction.
Permit Issues
Construction of the project will necessitate impacts to waters of the United States.
-Application is hereby made for a Department of the Army Section 404 Nationwide
Permit (NWP) 14 and NWP 33 and DWQ Section 401 Water Quality Certification
(WQC) No. 3289 and WQC No. 3114.

Summary
NCDOT proposes to replace Bridge No. 212 over an unnamed perennial tributary
to Grassy Creek in Granville County. The proposed replacement structures are 2 @
128" x 83" corrugated metal pipe arches that are 60 feet long. Impacts to the perennial
tributary from the replacement of the existing bridge with the corrugated metal pipe
arches (with a headwall at the inlets and minimal amounts of rip rap to protect the
structure) include 80 feet existing channel impacted and 0.02 acre fill in surface water.
Temporary impacts to the perenial stream from dewatering will result in the dewatering
of 0.02 acre of stream bed and 80 linear feet of stream channel.
The NCDOT asks that the construction of this project be authorized under a
Section 404 NWP 33 and NWP 14 and WQC No. 3289 and 3114. The NCDOT will
adhere to all applicable Section 404 NWP and Section 401 WQC conditions. A pre-

This form is to be used for projects qualifying for any of the U.S. Army Corps of Engineers' (USACE)
Nationwide, Regional or General Permits as required by Section 404 of the Clean Water Act and/or
Section 10 of the Rivers and Harbors Act, and for the North Carolina Division of Water Quality's
(DWQ) associated General 401 Water Quality Certifications. This form is also to be used for any
project requiring approval under any Riparian Buffer Rules implemented by the N.C. Division of Water
Quality. This form should not be used if you are requesting an Individual 404 Permit or Individual 401
Water Quality Certification. The USACE Individual Permit application form is available online at

The USACE is the lead regulatory agency. To review the requirements for the use of Nationwide,
Regional or General permits, and to determine which permit applies to your project, please go to the

offices listed at the end of this application. The website also lists the responsible project manager for
each county in North Carolina and provides additional information regarding the identification and
regulation of wetlands and waters of the U. S.
The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant
which 401 Certification will apply until the 404 Permit type has been determined by the USACE.
Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at
http,//h2o.enr.state.ne.us/ncwetlands to read about current requirements for the 401 Water Quality
Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The
applicant is also advised to read the full text of the General Certification (GC) matching the specific 404
Permit requested. In some cases, written approval for some General Certifications is not required,
provided that the applicant adheres to all conditions of the GC. Applicants lacking access to the internet
should contact DWQ's Central Office in Raleigh at (919) 733-1786.
Trout Waters Coordination - Special coordination with the North Carolina Wildlife-Resources
Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five
counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC
regional coordinator (listed by county on the last page of this application).

CAMA Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on
the last page of this application) the applicant should also contact the North Carolina Division of Coastal
Management (DCM) at (919) 733-2293. DCM will determine whether or not the project involves a
designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency.
In such cases, DCM will require a Coastal Area Management Act (CAMA) Permit and will coordinate
the 404/401 Permits.
USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms,
photos, etc. to the applicable USACE Regulatory Field Office (addresses are listed at the end of this
application). Upon receipt of an application, the USACE will determine if the application is complete as
soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant
to address information needs for all USACE Nationwide, Regional or General permits, as well as
information required for State authorizations, certifications, and coordination. Fully providing the
information requested on this form will result in a complete application for any of the USACE

401 Water Quality Certification or Buffer Rules - All information is required unless otherwise stated
as optional. Incomplete applications will be returned. Submit seven collated copies of all USACE
Permit materials to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center,
Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401
Certification, then a non-refundable application fee is required. In brief, if project impacts include less
than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to
streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is
required. A check made out to the North Carolina Division of Water Quality, with the specific name of
the project or applicant identified, should be stapled to the front of the application package. For more

attached with the application unless the applicant is a federal agency in which case the check may be
issued from a separate office. In such cases, the project must be identifiable on the U.S. Treasury check

the application fee does not apply, and the applicant should clearly state (in a cover letter) that only
Buffer Rule approval is sought in writing. Wetlands or waters of the U.S. may not be impacted prior to

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and

finapcial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
