Conner, P.E., Division Engineer NCDOT, Division 1 PO Box 850 Edenton, NC 2793' Dear Mr. Conner: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.37 acres of wetlands and 73 linear feet of streams for the purpose of widening and paving SR 1401 in Gates County. The project shall be constructed in accordance with your application dated December 10, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This certification corresponds to the Nationwide Permit Number 14 issued by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit, unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification. 1.) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401Wetlands Unit of the Division of Water Quality upon completion of the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. The North Carolina Department of Transportation (NCDOT) proposes to upgrade SR 1401 (Flatbranch Road) from SR 1400 (Ethel Parker Road) to NC 37 in Gates County. SR 1401 is an unpaved roadway that will be upgraded to a paved roadway. Total project length is 3.0 miles. Transportation and highway laws of North Carolina (G.S. 136-44.6, 136-44.7, 136- 44.7A, 136-44.8, and 136-44.9) require the NCDOT to develop annual work programs for construction and maintenance of secondary roads. These general statutes specifically set forth requirements for annual construction and paving of existing unpaved roads. Paving of these roads is perfonned in priority order as established by the NCDOT for each unpaved road within a given county. This number is based on characteristics of each road, including number of homes, schools, churches, businesses, industries, recreational facilities, traffic counts, presence of school bus routes, and value as a thoroughfare. Flatbranch Road is scheduled to be paved in the 2001- 2002 Secondary Roads Construction Program. The purpose and need is to provide a safe, efficient roadway serving as the access to the five houses and agricultural fields located on SR 1401. The new roadway width and the eventual addition of pavement will greatly increase the safety of the traveling public. SR 1401 currently consists of a gravel surface. Maintenance activities are also considered. Gravel roads require re-grading a minimum of 10 to 15 times per year. This may be increased depending on weather patterns and traffic usage. The frequency of maintenance is reduced after conversion from a gravel to a paved travel surface. Impacts to Waters of the United States PIIENT l11 RECEIVED Streams Construction of the project will necessitate impacts to waters of the United States in the Chowan River Watershed. Two tributaries of Bennetts Creek will be crossed by this project and the pipe located at replaced (Table 1). The jurisdictional impacts are located on the site plans and 113 Airport Dr., Suite 100, Edenton, NC 27932 - Phone: (252) 482-7977 Fax: (252) 482-8722 labeled Site A and Site B The 29 foot x 18 inch reinforced concrete pipe located at Site A will be replaced with a 40 foot x 18 inch corrugated metal pipe. This pipe will be extended 12 feet to allow for a road shoulder. At Site B the existing pipe will be removed and a new pipe will be placed at the new location of the road alignment. Both the original and proposed pipes will be 61 feet by 60 inch corrugated metal pipes. Total impacts to the streams from construction will total approximately 73 linear feet of existing channel. The channel will be not be widened at either location. Pipes will be buried 3.6 feet at Site A and 12 feet at Site B, 20% of the proposed pipe diameter. Table 1: Impacts to associated streams. The jurisdictional sites are located on the site plans and labeled Site A and Site B (Table 2). Direct impacts to the wetlands from construction will total 16,117.26 square feet (0.37 acres) of fill in wetlands from construction of a road shoulder and excavation of a new ditch. Roadside ditches will be reinstalled at present ditch elevation, therefore no ellipse equation calculations were performed. Table 2: Direct impacts to wetlands due to fill. All wetlands or surface waters not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in or near wetlands or surface waters. Minimization: NC DOT designed a 50 foot right of way rather than using the standard 60 foot right of way to minimize impacts to wetlands. The side slopes have been steepened to the extent possible at jurisdictional sites. Strict Enforcement of sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be enforced during project construction. Continued coordination will occur with maintenance forces and the Environmental Officer during construction to minimize impacts to waters of the U.S. at these sites. Compensatory Mitigation: The construction of the project will result in greater than 0.10 acres of total impacts to waters of the U.S., therefore mitigation is required. Wetland impacts will be compensated using on site mitigation with removal of existing roadbed at Site 3 and at the Dismal Swamp mitigation site located in Gates County. The Dismal Swamp mitigation site is composed of riparian hardwood wetlands dominated by baldcypress, sweetgum, and red maple. This site is a restoration site outside of the Chowan Watershed, therefore compensation was calculated using a 3:1 ratio. Table 3. Proposed Wetland Compensation for wetland impacts. Dewatering The NCDOT will not dewater during the construction of the project. Regulatory Review State Historic Preservation Office has notified NC DOT that there is no known National Register or Study-listed properties within the subject projects Area of Potential Effects. Permit Issues The purpose of this letter is to request authorization under Section 404 Individual Permit. Notification for the use of this nationwide permit (NWP) to the United States Army Corps of Engineers (USACE) is required for this project. NCDOT will comply with all conditions associated with this NWP and WQC. Summary NCDOT proposes to upgrade and pave SR 1401 in Gates County. Impacts associated with two pipe replacements and road relocation include 73 linear feet of stream charmel impacted. Pipes will be buried a 20 % of pipe diameter below existing stream bed level. Two (2) wetland sites will be impacted (0.37 acres) in order to construct a road shoulder and new roadside ditches and to provide a more gradual turn on the road. These wetlands consist of riverine hardwood swamps Wetlands will be compensated for at the Dismal Swamp mitigation bank, located in Gates County making a total compensation of 0.95 acres. On site mitigation by removing the existing roadbed for approximately 400 linear feet will provide 0.08 acres of wetland restoration. The project is located in the Chowan River Basin. The NCDOT will adhere to all applicable Section 404 NWPs and Section 401 WQCs conditions. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Initial review of the site identified five wetland areas adiacent to SR 1401. Small shiftinu of the road alignment avoided 2 Netlands within the DOT right of way. Wetland impacts were further minimized by utilizing a 50-foot instead of a 60-foot right of way. Impacts due to pipe replacement were unavoidable due to the need to lengthen the pipe and shoulder for safety_ reasons. Based on NC DOT road safety standards, the road at site 4 was Page 7 of 12 determined to be too sharp of a curve to pave in present location. Therefore, the road was shifted east to allow for a more gradual road contour, the direction of riparian wetlands. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwctlands/stnn.zide.litm1. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. SR 1401 is located within the Chowan River Watershed. Compensation of wetland losses will include on-site remediation utilizing the exiting roadbed located at site four. This roadbed will be graded to existing adjacent wetland elevation and planted with baldeypress and other wetland trees found within same vegetation community. This should restore approximately 0.08 acres of wetlands. Further compensation of 0.58 acres will be provided by Dismal Swamp Mitigation site in Gates County. Total compensation is therefore 0.08 acres on-site mitigation (1:1 ratio), and 0.87 acres at Dismal Swamnp Mitigation site (3:1 ratio) for a total of 0.95 acres of compensation. Page 8 of 12 2.
