Dear Mrs. Manuele:
The NC Department of Transportation is scheduled to grade, drain, base and pave SR 1508 in
Alleghany County. The existing '14 foot wide gravel road will be widened to 18 feet and paved.
Total project length is approximately 0.53 miles. Impervious surface area will increase by 0.26
acres or 8%. This project will require the replacement of two (2) wet cross lines as shown below:
1) Replace existing 34'x 18" CMP at station 4+17 with a 60'x 24" CMP.
2) Replace existing 32'x 18" RCP at station 11+50 with a 60'x 24" CMP.
Miscellaneous rip-rap impacts will total 20 linear ft. or less. New stream impacts = 74 In. ft.
Construction of this project will require impacts to waters of the United States in the New River
Basin. Both of the above noted wet cross lines carry different unnamed tributaries to Crab Creek
(Class: C, Trout). The Division 1 i Environmental Officer reviewed this project for the presence
of threatened and endangered species on July 25, 2002. The subject project will have no effect on
any federally listed endangered plant or animal species. Historic compliance work will be
scheduled and concurrence with the State Historic Preservation Office will be obtained if
required.
Since this is an existing roadway, the modifications proposed in this application should not

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact 74
linear feet of two unnamed tributaries to Crab Creek in order to improve SR 1508 (Stewart Road) in
Alleghany County. The project must be constructed in accordance with your application dated July 29,
2002 (received July 31, 2002). After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification No. 3375, corresponding to the U.S. Army Corps of Engineers
Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits
before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying
404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ in writing and submit a new application.
If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. NCDOT shall implement Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) prior to any ground-disturbing activities to minimize impacts to downstream aquatic
resources.
2. NCDOT shall abide by any trout conditions or moratoriums as determined by the North Carolina
Wildlife Resources Commission.
3. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
4 NCDOT is encouraged to use existing on-site vegetation and materials for stream bank stabilization
and to minimize the use of rip rap.
5. The dimension, pattern, and profile of the stream and floodplain above and below each structure shall
not be modified by widening the stream channel or reducing the depth of the stream.
6. All work shall be performed during low flow conditions.
7. Heavy equipment must be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.

8. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
9. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed. The responsible. party shall complete the attached form and return it to the 401/Wetlands
Unit of the NC Division of Water Quality upon completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The NCDOT proposes to grade, drain, base and pave the existing road. Biologists with
the North Carolina Wildlife Resources Commission are familiar with habitat values in the
area. These comments are provided in accordance with the provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North
Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25).
The road will be widened from 14' to 18' and two (2) wet cross lines will be replaced. A
34'x18" CMP will be replaced at station 4+17 with a 60'x24" CMP and a 32'x18" RCP
at station 11+50 will be replaced with a 60'x24" CMP. Crab Creek is a Division of
Water Quality Class C-Trout stream.
Based on the submitted information and our knowledge of the area, we will not object to
the project provided the following conditions are implemented:
1. Culverts 48" or larger should be buried approximately 1' into the streambed.
Culverts less than 48 inches in diameter should be buried to a depth equal to or
greater than 20% their size to allow for aquatic life passage. These
measurements must be based on natural thalweg depths. The dimension,
pattern, and profile of the stream above and below the lower cell should not be
modified by widening the stream channel or reducing the depth of the stream.
Riprap use should be minimized so that aquatic life passage is not deterred.

2. If concrete will be used, work must be accomplished so that wet concrete does
not contact stream water. This will lessen the chance of altering the stream's
water chemistry and causing a fish kill.
3. Heavy equipment should be operated from the bank rather than in the stream
channel in order to minimize sedimentation and reduce the likelihood of
introducing other pollutants into the stream.
4. Stringent erosion control measures should be installed where soil is disturbed
and maintained until project completion.

control. We encourage NCDOT to utilize onsite vegetation and materials for
streambank stabilization when practicable.

area. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the
erosion control measures outlined in the attachments to this application, downstream water
quality standards will be protected. All appropriate BMPs will be used during construction.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map and a marked topography map.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The existing roadway must be widened to achieve an acceptable section width, thus increasing
public safety. The existing pipes must be replaced for the same reason. By utilizing
the erosion control measures as shown in the attached drawings, adverse impacts to streams in
the area will be minimized. Since this is an existing roadway, the stream impacts cannot be
avoided However, the replacement pipe lengths will be the minimum needed to construct the
widened roadway. All appropriate BMPs will be used during construction.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
htt-p://h2o.enr.state.nc.us/ncwetlands/strrngide.html.
