Habitat Conservation Program
DATE: April 25, 2002
SUBJECT: North Carolina Department of Transportation (NCDOT), NCSR1604,
Unnamed Tributaries of Peak Creek and Cranberry Creek, Ashe County
NCDOT proposes to grade, drain, base, and pave primarily along the existing roadway of
Carson Woods Road. Biologists with the North Carolina Wildlife Resources
Commission are familiar with habitat values in the area. These comments are provided in
accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661-667d) and the North Carolina Environmental Policy Act
(G.S. 113A-1 through 113A-10; NCAC 25).
NCDOT proposes to replace and upsize several existing culverts while completing the
project. Miscellaneous riprap impacts are indicated to be 100 linear feet. Total new
stream impacts will be 230 linear feet. These creeks are Hatchery Supported Waters.
Rainbow and brown trout are anticipated to occur in the area.
Based on our review of the submittal and our knowledge of trout in the area, we will not
object to the project provided the following conditions are implemented:
1. Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the trout spawning seasons of October 15 through April 15
to protect the egg and fry stages of trout.
2. The use of riprap in the channel should be avoided to the extent practicable.
3. Culverts 48" or larger should be buried approximately F into the streambed.
Culverts less than 48 inches in diameter should be buried to a depth equal to
NCSR1604, Carson Woods Road 2 April 25, 2002
or greater than 20% their size to allow for aquatic life passage. The
dimension, pattern, and profile of the streams should not be modified by
widening the stream channel or reducing the depth of the stream. Previously
disturbed fioodplains and streams should be restored to natural geomorphic
conditions whenever practicable.
2. If any concrete will be used, work must be accomplished so that wet concrete
does not contact stream water. This will lessen the chance of altering the
stream's water chemistry and causing a fish kill.
3. Heavy equipment should be operated from the bank rather than in the stream
channel in order to minimize sedimentation and reduce the likelihood of
introducing other pollutants into the stream.
4. Stringent erosion control measures should be installed where soil is disturbed
and maintained until project completion.
5. Temporary or permanent herbaceous vegetation should be planted on all bare
soil within 5 days of ground disturbing activities to provide long-term erosion
control. We encourage NCDOT to utilize onsite vegetation and materials for
streambank stabilization when practicable.
Thank you for the opportunity to review and comment on this project during the early
planning stages. If you have any questions regarding these comments, please contact me
at 336/769-9453.

regulations. This approval will expire with the accompanying 404 permit unless otherwise specified
in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ in writing and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
"H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. NCDOT shall use Best Management Practices for the Protection of Surface Waters (NCDOT

Dear Mrs. Manuele:
The NC Department of Transportation is scheduled to grade, drain, base, and pave primarily
along the existing roadway of SR 1604 (Carson Woods Road) in Ashe County. The total project
length is approximately 2.8 miles. This project will require the replacement of seven (7) wet cross
lines as shown below:
1) Replace existing 36'x 30" CMP at station 5+83 with a 40'x 36" CMP.
2) Replace existing 27'x 36" CMP at station 34+39 with a 65'x 36" CMP.
3) Replace existing 32'x 24" CMP at station 48+69 with a 65'x 36" CMP.
4) Replace existing 51'x 18" CMP at station 62+83 with a 60'x 24" CMP.
5) Replace existing 27'x 24" CMP at station 92+31 with a 50'x 36" CMP.
6) Replace existing 75'x 30" CMP at station 97+51 with a 70'x 36" CMP.
7) Replace existing 17'x 18" CMP at station 117+36 with a 45'x 24" CMP.
Miscellaneous rip-rap impacts will total 100 linear ft. or less. New stream impacts = 230 linear ft.
Construction of the project will necessitate impacts to waters of the United States in the New
River Basin. The wet cross lines at stations 5+83, 34+39 and 48+69 carry different unnamed
tributaries to Peak Creek (Class: B, Trout +). The remaining wet cross lines carry different
unnamed tributaries to Cranberry Creek (Class: B, Trout +).

The Division I 1 Environmental Officer inspected this project for the presence of threatened and
endangered species on March 6, 2002. The subject project has been determined to have no effect
on any federally listed endangered plant or animal species. According to the NCDOT web site,
the NCDOT Historical Architecture Section has reviewed this project and determined that there
are no NR/SL/DOE properties along this roadway that will be impacted by the proposed project
(see attachment).
Since this is an existing roadway, the modifications proposed in this application should not
remove or degrade existing water quality uses. Any widening of the existing roadway will be
directed away from any adjacent creek whenever possible with minimum fill placed in any buffer
area. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the
erosion control measures outlined in the attachments to this application, downstream water
quality standards will be protected. All appropriate BMPs will be used during construction.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map, a marked topography map and photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me. Please note that a trout buffer zone
encroachment variance will be requested from stations 0+00 - 3+50.
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia
Van Der Wiele, NCDENR, Division of Water Quality, 401/Wetlands Unit, for her review. It is
requested that any comments related to the 401 certification be forwarded directly to me with a
copy sent to the US Army Corps of Engineers.
We would like to begin construction as soon as possible. If further information is required, please
let me know. Your early review and consideration will be appreciated.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Since this is an existing road, the maintenance impacts are unavoidable. The proposed project
impacts are minor in nature and should not remove or degrade existing water quality uses. Pipe
sizes used will be the minimum necessary to create a safe roadway. By utilizing the erosion
control measures outlined in the attachments to this application, downstream water quality
standards will be protected. All appropriate BMPs will be used during construction.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/n,cwetlands/strmgide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
No wetlands will be impacted. Stream impacts will not exceed 150 linear feet on any one
water body.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that
you would like to pay into the NCWRP. Please note that payment into the NCWRP must be
reviewed and approved before it can be used to satisfy mitigation requirements. Applicants
will be notified early in the review process by the 401/Wetlands Unit if payment into the
NCWRP is available as an option. For additional information regarding the application
process for the NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/NNrp/index.htm. If
use of the NCWRP is proposed, please check the appropriate box on page three and provide
