Box 250 North Wilkesboro, NC 28659 Dear Mr. Slaughter: You have our approval, in accordance with the attached conditions and those listed below, to impact 274 linear feet of Long Branch and its unnamed tributaries in order to improve SR 1570 (Huckleberry Ridge Road) in Ashe County. The project must be constructed in accordance with your application dated April 15, 2002 (received April 23, 2002). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3375, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ in writing and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. NCDOT shall use Best Management Practices for the Protection of Surface Waters (NCDOT March 1997 and Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A NCAC 4B .0024) must be implemented prior to any ground-disturbing activities to minimize impacts to downstream aquatic resources. Temporary or permanent herbaceous vegetation shall be planted on all bare soil within 10 days of ground-disturbing activities to provide long term erosion control. 2. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the trout spawning season of October 15 through April 15, or other conditions as determined by the North Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from sedimentation during construction. 3. Riparian vegetation must be reestablished within the construction limits of the project by the end of the growing season following completion of construction. 4. NCDOT is encouraged to use existing on-site vegetation and materials for stream bank stabilization and to minimize the use of rip rap. The dimension, pattern, and profile of the stream and floodplain above and below the structure shall not be modified by widening the stream channel or reducing the depth of the stream. 6. All work shall be performed during low flow conditions. 7. Heavy equipment must be operated from the banks rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 8. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 9. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the §401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Total project length is approximately 1.7 miles. This project will require the replacement of seven (7) wet cross lines as shown below: 1) Replace existing 43'x 18" CMP at station 4+67 with a 45'x 24" CMP. 2) Replace existing 25'x 18" CMP at station 13+25 with a 40'x 24" CMP. 3) Replace existing 27'x 18" CMP at station 14+27 with a 45'x 24" CMP. 4) Replace existing 50'x 48" CMP at station 27+97with a 75'x 48" CMP. 5) Replace existing 30'x 60" CMP at station 34+48 with an 80'x 60" CMP. 6) Replace existing 24'x 18" CMP at station 38+31 with a 40'x 18" CMP. 7) Replace existing 37'x 18" CMP at station 42+00 with an 85'x 24" CMP. Construction of this project will necessitate impacts to waters of the United States in the New River Basin. The cross line at station 14+27 carries Long Branch. Each of the remaining wet cross lines carry different unnamed tributaries to Long Branch (Class: B, Trout +). The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on March 6, 2002. The subject project has been determined to have no effect on any federally listed endangered plant or animal species. Since this is an existing roadway, the minor modifications proposed in this application should not remove or degrade existing water quality uses. Any widening of the existing roadway will be directed away from any adjacent creek whenever possible with minimum fill placed in any buffer area. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control measures, a marked county map, a marked topography map and photographs. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Since this is an existing road stream impacts cannot be avoided. By utilizing the erosion control measures as shown in the attached drawings, adverse impacts to streams in the area will be minimized. Pipe sizes used will be the minimum needed to construct the widened roadway. All appropriate BMPs will be used during construction. Page 7 of 12 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option. (2) As construction progresses, temporary and permanent erosion control devices shall be installed in a timely matter, according to any special permit requirements and or requirements set out in G. S. 113A-57. MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY Pursuant to G.S.113A-57 (3) provisions for a ground cover sufficient to restrain erosion must be accomplished within 15 working days or 30 calendar days following completion of construction or development, whichever period is shorter, except as provided in 15A NCAC 413.0024 (e). DESIGN STANDARDS IN SENSITIVE WATERSHEDS Pursuant to G. S. 113A-57 (3) provisions for a ground cover sufficient to restrain erosion must be provided for any portion of a land-disturbing activity in a HQW zone within 15 working days or 30 calendar days following completion of construction or development, whichever period is shorter. (3) All siltation and erosion control devices shall be properly maintained until no longer needed. (4) On projects performed by D.O.T. Maintenance Forces, request will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. (5) Any removal of siltation devices will be based on the condition of established ground cover of that area the device is serving. HIGH QUALITY WATERS 1. Uncovered areas are limited at any given time to a maximum total area of 20 acres. 2. Erosion and sedimentation control measures shall be designed to provide protection from the 25-year storm. 3. Large Type-A basins shall be designed and constructed with a settling efficiency of at least 70% for the 40 micron soil particle size transported by runoff from the 2-year storm. 4. Newly constructed channels shall be constructed with side slopes no steeper than 2:1, unless slopes are to be stabilized by methods other than vegetation 5. A ground cover sufficient to restrain erosion must be provided for any disturbed area. SECTION 10 42 RI-P RAP MATERIALS 1042-1 PLAIN RIP RAP. Stone for plain riji rap shall consist of field stone or rough unhev.,n quarry- stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer.. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet, the following requirements: 1. For Class I Rip Rap. Stone shall vary in weight from 5 to 200 pounds: At least 30 percent of the, total weight of the rip rap shall be in individual places lveighing a mininium of 60 pounds each. Bottom: Buffer zone encroachment area from station 14+00 - 22+00 on SR 1570, Ashe County. 0 ??OG?7 FILE COPY TO: Jean Manuele, USACOE Raleigh Regulatory Field Office FROM: Ron Linville, Regional Coordinator Habitat Conservation Program DATE: April 25, 2002 SUBJECT: North Carolina Department of Transportation (NCDOT), SR1570, Huckleberry Ridge Road, Unnamed Tributaries Long Branch, Ashe County These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). Biologists with the North Carolina Wildlife Resources Commission are familiar with habitat values in the area. The NCDOT proposes to grade, drain, base and pave the referenced road. NCDOT proposes to replace seven (7) CMPs while constructing and paving the existing road. Long Branch is classified as Class B, Trout + water. A minor buffer variance will be necessary from Stations 14+00-22+00 and 34+50-41+50. Impacts will occur to Long Branch and tributaries to Long Branch. We will not object to the project or the buffer zone encroachments as indicated in the submittal providing the following conditions are implemented: 1. Culverts 48" or larger should be buried approximately l' into the streambed. Culverts less than 48 inches in diameter should be buried to a depth equal to or greater than 20% their size to allow for aquatic life passage. Existing aquatic life passage should not be disrupted. To the extent practicable, no damming or freefalling of waters should occur on either end of the CMPs during low flow conditions. SR1570, Long Branch 2 April 25, 2002 2. The dimension, pattern, and profile of the streams should not be modified by widening the stream channel or reducing the depth of the stream. Previously disturbed floodplains and streams should be restored to natural geomorphic conditions whenever practicable. 3. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's watei?cheihistry' and causing a fish kill. 4. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds (15A NCAC 4B .0024). 6. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5 days of ground disturbing activities to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization when practicable instead of riprap.
