Dear Mrs. Manuele:
The NC Department of Transportation is scheduled to replace Pipe #2760 on SR 1159 in Ashe
County with a new pipe at the same location. No detour is proposed. The existing structure is a
40'x 84" CMP. The proposed new structure is a 60'x 84" CMP with a concrete headwall and
endwall.
Miscellaneous rip-rap impacts will total 40 linear feet or less. New stream impacts = 60 In. feet.
The replacement of the deteriorating pipe with the proposed new pipe will require temporary
dewatering. An impervious sandbag dice will be constructed approximately 20 feet upstream of
the existing culvert to create a small pool. Clean water will temporarily be pumped around the
construction area and will be discharged into a buffer area located approximately 100 feet
downstream of the sandbag dice. Any dirty water located inside the construction area will be
pumped into a sit bag. The dewatered area will total approximately 400 square feet or 0.009
acres. Once the new structure is in place, the impervious dice will be removed and
preconstruction streambed elevations will be restored.
Please note that the outlet end of the existing pipe is perched. The existing pipe is sitting on
bedrock. Burying the new pipe 1' below grade would require extensive blasting. Since fish
passage to the existing pipe is prohibited by small waterfalls downstream (see attached
photographs) we are proposing to place the new pipe at grade.

Construction of this project will necessitate impacts to waters of the United States in the New
River Basin. The pipe in question carries an unnamed tributary to the South Fork of the New
River (Class: WS-V, HQW). The Division I I Environmental Officer reviewed this project for the
presence of threatened and endangered species on March 6, 2002. Since the pipe in question is
located approximately 250 feet from the SFNR, particular attention was paid to the presence of
Virginia spiraea. Rhododendron and beech trees were observed in the vicinity of the existing
pipe. Virginia spiraea is not known to occur at this location and none was found. As a result, the
subject project has been determined to have no effect on any federally listed endangered plant or
animal species. Historic compliance work will be scheduled and concurrence with the State
Historic Preservation Office will be obtained if required.
The modifications proposed in this application should not remove or degrade existing water
quality uses. By utilizing the erosion control measures outlined in the attachments to this
application, downstream water quality standards will be protected.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map, a marked topography map and photographs.

the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The existing,Qme must be replaced due to its condition. The replacement vine length will be the
minimum needed to create a safe crossing. By utilizing the erosion control measures as shown in
the attached drawings adverse impacts to streams in the area will be minimized.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.

SUBJECT: NCDOT pipe replacement no. 2760 on SR 1159 over an unnamed tributary to
South Fork of the New River, Ashe County
The North Carolina Department of Transportation (NCDOT) is requesting a concurrence
letter from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit
from the U.S. Army Corps of Engineers. Biologists on staff with the NCWRC have reviewed
the proposed improvements and are familiar with habitat values of the project area. These
comments are provided in accordance with the provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the Clean Water Act of 1977 (33 U.S.C.
466 et seq.).
NCDOT proposes to replace the existing 40'x 84" CMP with a 60'x 84" CMP with a
concrete headwall and endwall. This action will impact 60 linear feet of an unnamed tributary to
South Fork of the New River. The current pipe is sitting on bedrock and small waterfalls occur
just downstream of the pipe. Burial of the new pipe would require extensive blasting. We
surveyed for fish 40' above and 40' below the pipe on March 21, 2002. We did not find any fish
until we got below the waterfalls. We found smallmouth and rock bass at the mouth of the
tributary, but the tributary does not provide good habitat for these species. Therefore, we do not
believe it is critical to blast in order to bury the pipe 1' into the streambed. We are concerned
with the potential of this project to impact the South Fork of the New River through off-site
sedimentation during construction. We will not object to the project as proposed provided that
the following conditions are implemented:
1. Disturbance of the stream channel must be limited to only what is necessary
to install the pipe. Heavy equipment should be operated from the bank
rather than in the stream channel in order to minimize sedimentation and
reduce the likelihood of introducing other pollutants into the stream.

2. Only clean, tear-free sandbags should be used as temporary fill for dewatering and
should be removed without excessive disturbance of the natural stream bottom when
construction is completed. The streambed should be returned to pre-construction
conditions upon removal of the sandbags.
3. Stringent erosion control measures should be installed where soil is disturbed
and maintained until project completion.
4. Temporary or permanent herbaceous vegetation should be planted on all bare
soil within 10 days of ground disturbing activities to provide long-term erosion
control. NCDOT should utilize onsite native vegetation and materials for streambank
stabilization, rather than excessive riprap (or hard stabilization methods).
5. All mechanized equipment operated near surface waters should be regularly inspected
and maintained to prevent contamination of stream waters from fuels, lubricants,
hydraulic fluids, or other toxic materials.
6. If concrete will be used, work must be accomplished so that wet concrete does not
contact stream water. This will lessen the chance of altering the stream's water
chemistry and causing a fish kill.
