ATTENTION: Mr. Eric Alsmeyer h NCDOT Coordinator Subject: Wayne County, Pipe replacement at Bridge Mainterance Site # 95- 2198 on SR 1744, 0.35 miles from NC 55, northeast of Mount Olive, at unnamed tributary to Northeast Cape Fear River in Cape Fear River Basin. Dear Mr. Alsmeyer: The North Carolina Department of Transportation (NCDOT) proposes to replace the existing corrugated metal pipe arch (CM.PA) located at the unnamed tributary to Northeast Cape Fear River on SR 1744, near Mount Olive. NCDOT proposes to replace two 60" diameter CMPA, 40 feet in length, with two CMPA, 87" wide by 63" tall and 60 feet in length with aluminum headwalls. The subject maintenance pipe replacement is necessary to meet current hydraulic design specifications and to upgrade degraded existing pipes. The proposed pipes will be slightly realigned to protect an adjacent landowner from further streambank erosion in close proximity to an existing outbuilding. No impacts to wetlands or riparian buffers are anticipated as a result of the proposed action. The existing stream channel will not be widened or significantly altered by the proposed proj ect. Temporary dewatering will occur during the pipe replacement activities in order to allow construction in the stream channel with minimal impacts to water quality. Sheet metal cofferdams are inserted downstream of the subject pipe or culvert, with an opening to allow drainage within the work area. Sheet metal cofferdams are then installed upstream of the subject pipe or culvert, temporarily damming the flow in the stream. The SECRETARY Post Office Box 3165, Wilson, North Carolina 27895-3165 final piece of sheet metal is then inserted to prevent and disturbed sediments from - impacting turbidity levels in the stream. The stream flow is diverted by a pump around the work-site and returned to the channel immediately downstream of the cofferdams. Water pumped from the dewatered work zone is pumped into a "Silt Bag" or across a vegetated area prior to allowing entry into the stream channel. Usually, the entire process from installation to removal is completed within two to five working days. Minimal impacts to the stream, riparian buffer zone or adjacent wetlands occur as the mechanical equipment works from the existing roadway, with the sheet metal lowered in place by the excavator from the roadway. Minimal vegetation is disturbed during this process and when removed, the sheet metal cofferdams are simply pulled out by the excavator. The construction of the project involves a road crossing of a stream that is located in the Cape Fear River Basin and which at the time of this application is not subject to any Riparian Buffer Rule. The subject project has been reviewed by the Environmental Officer for the presence of listed threatened and endangered species. The subject project has been determined to have no effect on any listed threatened or endangered plant or animal species. The construction of the project is authorized under Section 404 Nationwide Permit (NWP) 3, Maintenance. Notification for the use of this NWP to the USACE is required for this project, as the project requires additional riprap to be used to stabilize the stream banks and channel side slopes. By copy of this letter, courtesy notification to the North Carolina Division of Water Quality (NCDWQ) for Section 401 Water Quality Certificate (WQC) No. 3290 is provided for this project. NCDOT will comply with all conditions associated with this NWP and WQC. By copy of this letter, the North Carolina Department of Transportation (NCDOT) also requests authorization under Nationwide Permit # 33 to temporarily dewater jurisdictional waters during the subject maintenance pipe replacement. The subject project includes the replacement of two 60" diameter CMPA, 40 feet in length, with two CMPA, 87" wide by 63" tall and 60 feet in length with aluminum headwalls. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailedsite plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. All wetlands or surface waters not affected by the project wll be protected from unnecessary encroachment. VIII. Mitigation DWQ - In accordance with 15A NCAC 21-1 .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USAGE or DWQ to consider the application complete for processing. Any application Page 7 of 12 lacking a required mitigation plan or NCWRP concurrence shall be placed on hold 'as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at 13t112://h2o.enr_state.nc_us/ncwetl ,nds%strin?ide.htm_1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement.
