No. B-3084, COE Action I.D. 199920892 As you are aware, the U. S. Army Corps of engineers (USACE) authorized the North Carolina Department of Transportation to construct the new bridge under a Section 404 Nationwide Permit 23. The project involves replacing Bridge No. 7 over Big Hunting Creek and approaches on SR 2414. The new bridge will be built on new alignment 30 meters (100 feet) east of the existing structure. The new structure will be approximately 46 meters (150 feet) long and 6.6 meters (22 feet) wide. The bridge will include two 2.7 meter (9 foot) lanes and 0.6 meter (2 foot) offsets. Traffic will be maintained on the existing bridge during construction. There will be 113 meters (37 feet) of new approach work to the north and 137 meters (449 feet) of new approach work to the south. Thirty meters (100 feet) of pavement will be placed on either side of the bridge. The typical section for the approaches will include a travelway 5.4 meters (18 feet) wide and a 0.6 meter (2 foot) grass shoulder. An additional 1.0 meter (3 feet will be added to the shoulder width where guardrail is warranted. The project has not changed since the Nationwide 23 was issued. However, due to the proposed location of Bents 1 and 2, temporary cofferdams will need to be constructed to control the influx of water while these structures are built. A temporary causeway is also required and will be constructed in phases so that the creek will not be narrowed on both sides at the same time. The total combined impacts to surface waters will be 125.07 square meters (0.03 acres. Details of the project are provided in the attached drawings. The project has been let to construction. This project lies in a trout county, and concurrence from the N. C. Wildlife Resources Commission (NCWRC) is necessary. Comments from the NCWRC on the Section 404 Nationwide Permit 23 request have been attached to this letter. The NCDOT requests that the NCWRC provide any additional comments to the USACE. The NCDOT believes that the proposed work may be authorized under a Section 404 Nationwide Permit 33, and requests that the USACE authorize this work. The NCDOT will adhere to the general conditions of the 401 Water Quality Certification for this project; therefore, written concurrence from the N. C. Division of Water Quality is not required. The NCDOT also requests that the NCWRC provide comments to the USACE on this permit request. The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT proposes to replace Bridge No. 7 with a new bridge on new alignment 100 feet east of the existing structure over Hunting Creek. The new bridge will be approximately 150 feet long and 22 feet wide. There will be 370 feet of new approach to the north and 449 feet of new approach work to the south. The project will not impact wetlands. Impacts to Hunting Creek will be limited to those necessary for bridge construction and foundation test borings. The existing bridge and roadway approaches will be removed upon completion of the new alignment and revegetated with native flora. Based on the information provided by NCDOT, this project will not impact trout waters. However, the construction of the bridge has the potential to impact redbreast sunfish and smallmouth bass populations through off-site sedimentation during construction. The project should have minimal impacts on aquatic resources in Hunting Creek. Therefore, we will not object to the project as proposed provided the following conditions are implemented: 1. Instream work and initial land clearing within the 25 foot stream buffer zone should be prohibited during the redbreast sunfish/smallmouth bass spawning period of May 1- June 30 in order to protect the eggs and fry from off-site sedimentation. 2. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 3. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. If seeding is done after 1 October, then the NCDOT should return after 1 April the following year to reseed areas of poor germination, if necessary. 4. Once the old bridge is removed, streambanks should be reshaped to match existing streambank contours and revegetated with native flora (trees, shrubs, forbes) as noted in project plans. Native plants should match those found existing at the site. Fescue should not be used to reseed streambanks. Thank you for the opportunity to review and comment on this project.
