Box 250 North Wilkesboro, NC 28659 Dear Mr. Slaughter: You have our approval, in accordance with the attached conditions and those listed below, to impact 78 linear feet of Cobb Creek in order to replace Bridge No. 163 on SR 1325 in Watauga County. The project must be constructed in accordance with your application dated 31 October 2001 (received 8 November 2001). After reviewing your application. we have decided that this fill is covered by General Water Quality Certification No. 3289, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ in writing and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet. compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and am additional conditions listed below-. 1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the trout spawning season of October 15 through April 15, or as otherwise determined by the North Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from sedimentation during construction. NCDWQ understands that this project is an emergency repair and that the moratorium period cannot be adhered to. This requirement may be suspended by the NCWRC. 2. Stormwater must be directed to buffer areas or retention basins and must not be routed directly into streams. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm water sheet flow. 3. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [ 15A NCAC 4B .0024]. 4. Temporary or permanent herbaceous vegetation must be planted on all bare soil within 15 days of ground-disturbing activities to provide long term erosion control. 5. Existing stream dimensions (widths and depths) are to be maintained above and below locations of culvert extensions to provide sediment transport and passage of aquatic life. Culverts shall be buried one foot into the substrate. Where disturbed, natural floodplain benching shall be restored, including the portion in front and below culvert wingwalls so that base flow is directed through the culvert. All work shall be performed during low flow conditions. Disturbance of the stream channel must be limited to only what is necessary to perform the culvert installation. Heavy equipment must be operated from the banks rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the §401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Biologists on staff with the NCWRC have reviewed the proposed improvements and are familiar with habitat values of the project area. These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the Clean Water Act of 1977 (33 U.S.C. 466 et seq.). NCDOT proposes to replace Bridge No. 163 with a 48' long single barrel 12'x 7' reinforced concrete box culvert with wingwalls. This action will impact Cobb Creek. At the project location Cobb Creek supports a wild trout population. Cobb Creek is a tributary to Meat Camp Creek, which is also classified as trout waters and contains both wild brook and wild brown trout. Work done in the Cobb Creek has the potential to impact Meat Camp Creek through increased sedimentation and blockage of fish movements through improper placement of the culvert. While we would prefer that the bridge be replaced with another spanning structure we will not object to the project as proposed provided that the following conditions are implemented: 1. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the brown and brook trout spawning season of October 15 through March 31 to protect the egg and fry stages of trout from off-site sedimentation during construction. Stream conditions above and below:the culverv should be maintained at the appropriate widths and depths to provide sediment transport and aquatic life movement. Where disrupted, natural floodplain benching should be restored. This includes the area in front and below culvert wingwalls so that the base flow is directed through the culvert. 4. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 5. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. NCDOT should utilize onsite native vegetation and materials for streambank stabilization, rather than excessive riprap (or hard stabilization methods). Vegetation provides bank stabilization, as well as shade for cooler water temperatures, and riparian edge habitat. If riprap is used, it must be limited to the lower 1/3 of the streambank. 6. Miscellaneous rip-rap impacts will total 30 linear feet or less. New stream impacts = 78 In. feet. Construction of this project will necessitate impacts to waters of the United States in the New River Basin. The existing bridge crosses Cobb Creek (Class: C, Trout +). The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on October 22, 2001. The subject project has been determined to have no effect on any listed threatened or endangered plant or animal species. Historic compliance work will be scheduled and concurrence with the State Historic Preservation Office will be obtained if required. The installation of the concrete box culvert will require temporary dewatering. An impervious sandbag dike will be constructed upstream of the existing crossing to create a small pool. Clean water will temporarily be pumped around the construction area and will be discharged into a buffer area. Any dirty water located inside the construction area will be pumped into a silt bag. The dewatered area will total approximately 816 square feet or 0.019 acres. Once the new structure is in place, the impervious dike will be removed and the stream will flow freely through the new culvert. P. O. Box 250, N. The culvert length used will be the minimum necessary to create a safe roadway. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control measures, a marked county map, a marked topography map and photographs. By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with the North Carolina Wildlife Resources Commission comment directly to you concerning the 404 Nationwide Permit application with a copy sent to me. ** When submitting comments to the Corps, it is requested that WRC personnel consider that this culvert was initially going to be placed at a different location. However, the property owner at the initial site backed out of his right-of-way agreement after the box culvert had been ordered. Since the crossing at Bridge 9163 was a suitable alternate site we decided to replace the existing substandard bridge at this location with the culvert that had already been ordered. However, Cobb Creek is considered a trout water. As a result, if Cobb Creek does not support a significant wild trout population, it is requested that you consider not placing a trout moratorium period on this project. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The existing bridge must be- replaced due to its condition. By utilizing the erosion control measures as shown in the attached drawings, adverse impacts to streams in the area will be minimized. The existing bridge is being replaced with a RCBC as a cost saving measure. Page 7 of 12 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at littp://li2o.enr.state.nc.us/ncwetiands/strmuide.litml. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option.
