Payne, P.E., Division Engineer NCDOT Division 716 West Main Street Albemarle, NC 28001 Dear Mr Payne: You have our approval, in accordance with the attached conditions, to impact 30 linear feet of West Fork Twelve Mile Creek for the purpose of performing an emergency bridge repair to Bridge No. 221 on SR 1315 (Newtown Road) in Union County. We understand that the project was constructed in accordance with your communication via e-mail on May 10, 2001 and your application dated May 18, 2001 (received 31 May 2001). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to the U.S. Army Corps of Engineers General (Regional) Permit Number 198200031. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. _ This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. The bridge that I am referring to is located in Union County, Newtown Road (SR 1315) and Twelve Mile Creek. Apparently this bridge had a weight rating of 18 tons and was crossed with a trackhoe weighing close to 60 tons. The end result compromised the bridge's integrity and required an immediate road closure. On Monday, our bridge maintenance crew went in and constructed a cofferdam utilizing a plastic liner and sandbags. An interior bent for the bridge was then added, I have attached pictures of the final product (the stone that you see piled around the bent was native to the creek). I was working in Division 8 when this took place, hence the delayed notice. I will be applying for the Section 404 General Permit 31 authorization and 401 Water Quality Certification "after the fact". The purpose of this letter is to notify you of the work performed and to request authorization, after the fact, from the U. S. Army Corps of Engineers under a Section 404 General Permit No. 198200031. It was reported that a truck, with an estimated 35 - 50-ton payload, overloaded Bridge 221, which had a gross maximum-posted weight limit of A -o Visual eff jis. ects of stresses to existing timbers, as well as observed deflection of the steel I-beams under live load conditions. necessitated the installation of a crutch bent at mid-span of the 50-foot single span bridge. Traffic was maintained using an off site detour. Impacts to waters of the United States occurred from the emergency repair work. There are no wetlands present, although impacts to surface water occurred. A 30-foot by 1-foot area of stream channel was lost due to the installation of the crutch bent sill. The stream is located in a rural area just outside the town of Weddington and is located in the Catawba River Basin, Hydrologic Unit 03050103. A permit drawing, showing the location of the installed crutch bent, and pre- construction notification form are attached to this letter. The NCDOT anticipates that the permit application will be authorized under a Section 404 General Permit No. 198200031. We are also hereby requesting a 401 Water Quality Certification, after the fact, from the Division of Water Quality. In compliance with Section 143- 215.3D(e) of the NCAA, we have enclosed a check for $200.00 a t as payment for processing the'section 401 permit application. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances. accessibility, and financial viability of the project. The applica.?it may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The Bridge Maintenance Engineer for Division Ten made a determination to take immediate. non-scheduled safetv measures to ensure the structural integrity of this bridge after reviewing the effects of reported overloading A citizen contacted NCDOT to report the hauling of a trackhoe across Bridge 221, which has a gross maximum posted weight limit of 18 Tons. The information received from the citizen suggested the trackhoe to be in the range of 35-50 Tons. Visual effects of stresses in certain timber members and the amount of visuallv measured deflection in the steel I-beams under live load conditions where determines in the decision to install a crutch bent at mid-span of the 50-ft. singles an bridge. Page 7 of 12 BRIDGE n 221 UNION COUNTY Installin_T a crutch bent at this location required placement of a timber sill and post within the middle of the existing live channel Sand bags inlaved within plastic to separate the sand from the channel were installed as a coffer-dam. This allowed de-watering of an area measuring 35-ft. alon(7 the line of the channel by 15-ft. along the width of the channel to place a 30-ft. x 12-ft. timber sill along the bed of the creek that serves as the base of the crutch bent. The sandbags and plastic where removed from the creek once the sill and the posts where connected to the sill where secure. VIII. i Iffi;ation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and iVloditication of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include. but are not limited to: reducing the size of the project. establishing and maintaining Nyetland and/or upland vegetated buffers to protect open waters such as streams: and replacing losses of aquatic resource functions and values by creating, restoring. enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current ;guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us%ncwetlands/stnrn!,ide.hturnl. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including. but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option.
