Box 250 North Wilkesboro, NC 28659 Dear Mr. Slaughter: You have our approval, in accordance with the attached conditions and those listed below, to impact 40 linear feet of an unnamed tributary to Meat Camp Creek in order to improve SR 1384 (Proffitt Road) and place three wet pipes in Watauga County. The project should be constructed in accordance with your application dated 5 March 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the trout spawning season of October 15 through April 15, or as otherwise determined by the North Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from sedimentation during construction. 2. 'Storm water should be directed to buffer areas or retention basins and should not be routed directly into streams. 3. Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A NCAC 4B .0024) must be implemented prior to any ground-disturbing activities to minimize impacts to downstream aquatic resources. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5 days of ground-disturbing activities to provide long term erosion control. 4. The culvert required for this project shall be installed in such a manner that the original stream profile is not altered (i.e. the depth of the channel should not be reduced by a widening of the streambed). Existing stream dimensions are to be maintained above and below locations of culvert extensions. 5. All work shall be performed during low flow conditions. All mechanized equipment operated near surface waters should be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 7. The presence of equipment in the channels must be minimized. Under no circumstances should rock, sand or other materials be dredged from the wetted stream channel under authorization of this permit, except in the immediate vicinity of the culverts. 8. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm water sheet flow. 9. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted when practical. If necessary, rip-rap should be limited to the stream bank below the high water mark, and vegetation should be used for stabilization above high water. 10. Rock silt screens at culvert outlets should be removed at project completion. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following area: The proposed stream impacts should be reported in linear feet (rip-rap to rip-rap) for each pipe. Therefore, pursuant to 15A NCAC 2h .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold. Due to the proposed work, we are requesting a 404 Nationwide Permit #14. This project will require replacing three (3) wet cross lines as shown below: 1) Replace existing 30'x 24" CMP at station 2+80 with a 40'x 36" CMP. 2) Replace existing 30'x 59" CNIP at station 10+85 with a 50'x 59" CMP. 3) Replace existing 40'x 48" CMP at station 13+75 with a 50'x 48" CMP. Director TO: Steve Lund, USACOE Asheville Field Office FROM: Ron Linville, Regional Coordinator Habitat Conservation Program` 010 D DATE: March 7, 2001 SUBJECT: North Carolina Department of Transportation (NCDOT), SRI 384, Proffitt Road, Unnamed Tributaries to Meat Camp Creek, Watauga County These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 1.6 U.S.C. 661-667d) and the North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The NCDOT proposes to grade, drain, base, and pave the referenced road. Same size pipes will replace existing pipes at Stations 2+80, 10+85, and 13+75. Meat Camp Creek is Hatchery Supported Trout waters that supports a significant population of brown trout. We will not object to the project as proposed by Mr. Heath Slaughter provided that the following conditions are implemented: 1. Replacement pipes will be•sized and installed approximately one (1) foot below streambed grade so that no damning or freefalling occurs on either end of the pipe during low flow conditions. The dimgnsion, pattern, and profile of the stream above and below the pipes should not be modified by widening the stream channel or reducing the depth of the stream. 2. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 3. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5 days of ground disturbing; activities to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization when practicable. 6. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the trout spawning seasons of October 15 through April 15 to protect the egg and fry stages of trout from off-site sedimentation during construction. Thomas property, Unnamed Tributary to Riddle Fork Creek, a tributary to Meat Camp Creek, Watauga County "These comments are provided in accordance with the provisions of the Dish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The applicant proposes to install a road crossing at the referenced site for a farm road. A 35' buffer is proposed along the rest of the stream. Meat Camp Creek is 1-latchery Supported Trout waters that supports a significant population of brown trout. We will not object to the project as proposed provided that the following conditions are implemented: 1. The 40' culvert will be appropriately sized and installed approximately one (l) foot below streambed grade so that no damming or frecfalling occurs on either end of the pipe during low flow conditions. The length of culvert will be reduced to 30 linear feet, if possible. 'The dimension, pattern, and profile of the stream above and below the pipes should not be modified by widening the stream channel or reducing the depth of the stream. 2. If any concrete will be used, work must be accomplished so that wet concrete does not contact stream water. ]'his will lessen the chance of altering the stream's water chemistry and causing a fish kill. 3. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. "Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5 days of ground disturbing activities to provide long-term erosion control. We encourage the use of onsite vegetation and materials for streatnbank stabilization when practicable. 6. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the trout spawning seasons of October 15 through April 15 to protect the egg and fry stages of trout from off.-site sedimentation during construction.
