Subject: Replacement of existing pipe conveying an unnamed perennial tributary to
Possumquarter Creek on SR 1645 in Warren County. NCDOT State
Project No. 5.4152.
The North Carolina Department of Transportation (NCDOT) plans to replace the
existing 60 foot corrugated metal pipe that conveys an unnamed perennial tributary to
Possumquarter Creek on SR 1645 in Warren County (Figures 1 and 2). The pipe is
currently in poor condition and must be replaced. The proposed replacement structure is
60 foot long aluminum pipe.
Impacts to Waters of the United States
Construction of the project will necessitate impacts to waters of the United States
in the Tar-Pamlico River Basin. Here, the project crosses an unnamed perennial tributary
to Possumquarter Creek (DWQ Index No. 27-13-(0.1)).
Permit Issues
The construction of the project is authorized under a Section 404 Nationwide
Permit (NWP) 3 (Maintenance). Notification for the use of this NWP to the USACE is
not required for this project. Accordingly, notification to the North Carolina Division of
Water Quality (NCDWQ) for Section 401 Water Quality Certificate (WQC) No. 3290 is
not required for this project.
The purpose of this letter is to request authorization under a Section 404 NWT' 33
to dewater the stream during project construction. The 401 WQC No. 3114 {which
corresponds to N)NT 33) does not require written notification from the NCDWQ as

NCDOT intends to comply with general conditions for this certification. A courtesy copy
of the permit application is supplied to NCDWQ.
Dewatering
The NCDOT proposes to temporarily dewater the stream during the construction
of the project. This will involve the temporary placement of sandbags or Class B or
Class 2 rip rap covered with filter fabric in the stream channel approximately 10 feet
upstream of the proposed pipe inlet (Figure 2). To maintain water flow during
construction, water upstream of this impervious structure will be temporarily pumped out
and conveyed downstream of the construction activity where it will be allowed to filter
through vegetation before flowing into the stream. The stream will be dewatered less
than a day. This will result in temporary impacts to these surface waters. Temporary
impacts to the stream from this activity will result in the dewatering of <0.01 ac of stream
bed and 70 linear feet stream channel. The sandbags or rip rap covered with filter fabric
will be removed after construction.
Riparian Buffer Impacts
The project is located within the Tar-Pamlico River Basin. Due to the nature of
impacts associated with this project, the construction of the project will not result in
impacts to the riparian buffer. The existing structure and adjacent roadway were
constructed prior to July 22, 1997. Therefore, this project is exempt from the Rule.
Summary
NCDOT proposes to replace the existing pipe on SR 1645 that conveys an
unnamed tributary to Possumquarter Creek. This activity is authorized by NWP 3 and
WQC 3290. The purpose of this letter is to request authorization under NWP 33 to
dewater the stream during project construction. The WQC No. 3114 (which corresponds
to NWP 33) does not require written notification. The NCDOT intends to comply with all
