Duke Street Durham, NC 27704 Dear Mr. Nance: You have our approval in accordance with the attached conditions, to place fill material in 0.05 acres of wetland, to impact 42 linear feet of the unnamed tributary to Cub Creek at Site 1, and to impact 3,879 square feet of riparian buffer for the purpose of paving the existing roadway SR 1724, from US 158 to Dead End in Person County. The project should be constructed in accordance with your application dated 17 July 2001 (received 20 July 2001). After reviewing your application, we have decided that these activities are covered by General Water Quality Certification Numbers 3289. This certification correspond to the Nationwide Permit Number 14 and by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ in writing and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). ). This approval shall expire with the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the 'conditions-listed in the attached certification and any additional conditions listed below. 1. Construction impacts that occur outside of the proposed road crossing foot print must be restored. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. This WQC is rescinded when the Corps of Engineers re-authorizes Nationwide Permit 14 or Regional General Permit 198200031 when deemed appropriate by the Director of the DWQ. The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with the conditions hereinafter set forth. Conditions of Certification: 1. Proposed fill or substantial modification of wetlands or waters (including streams) under this General Certification requires application to and prior written concurrence from the Division of Water Quality; 2. In accordance with North Carolina General Statute Section 143-215.3D(e), any application fora 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees; 3. In accordance with 15A NCAC 211 .0506 (h) compensatory mitigation may be required for impacts to -streams and/or wetlands. In addition, buffer mitigation may be required for. any project with Buffer Rules in effect at the time of application: A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols; 4. For any project involving a stream re-alignment, a stream relocation plan must be included with the 401 application for written DWQ approval. Relocated stream designs should include the same dimensions, patterns and profiles as the existing channel, to the maximum extent practical. The new channel should be constructed in the dry and water shall not be turned into the new channel until the banks are stabilized. Vegetation used for bank stabilization shall be limited to native woody species, and should include establishment of a 30 foot wide wooded and an adjacent 20 foot wide vegetated buffer on both sides of the relocated channel to the maximum extent practical. Also, rip-rap may be allowed if it is necessary to maintain the physical integrity of the stream, but the applicant must provide written justification and any calculations used to determine the extent of rip-rap coverage requested. If suitable stream mitigation is not practical on-site, then stream impact will need to be mitigated elsewhere; Impacts to any stream length in the Neuse, Tar-Pamlico and Randleman River Basins requires written concurrence from DWQ in accordance with 15A NCAC 2B.0233, 15A NCAC 2B .0259 and.0250 and 15A NCAC 211.0500. New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the Neuse, Tar-Pamlico and Randleman River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0233, 15A NCAC 2B .0259 and .0250. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices. Activities listed as "exempt" from these rules do not need to apply for written concurrence under this Certification; 6. Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed to allow low flow passage of water and aquatic life unless it can be shown to DWQ that providing passage would be impractical. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested in writing by DWQ. Additionally, when roadways, causeways or other fill projects are constructed across FEMA-designated floodways or wetlands, openings such as culverts or bridges must be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in destabilization of streams or wetlands; 7. If this Certification is used to access building sites, all lots owned by the applicant must be buildable without additional fill beyond that allowed under other General Certifications. Deed restrictions must be placed on the remaining wetlands and streams on these lots to restrict future wetland and stream fill. DWQ shall be sent copies of all deed restrictions applied to these lots; 8. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" - - - - - --- - - or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the - -- -- - -- - - -- - -- - Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 9. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored within two months after the Division of Land Resources has released the project; 10. This Certification shall be utilized for roads from natural high ground to natural high ground. The Certification for Nationwide Permit 18 may not be used in conjunction with this Certification to create high ground for road access; 12. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse. All water quality-related conditions of the FONSI or ROD shall become conditions of this Certification; 13. That additional site-specific conditions may be added to projects proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 14. When written concurrence is required, the applicant is required to use the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed; 15. Concurrence from DWQ that this Certification applies to an individual project shall expire three years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding Nationwide Permit 14 and Regional General Permit 198200031 whichever is sooner. Non-compliance with or violation of the conditions herein set forth by a specific fill project may result in revocation of this Certification for the project and may also result in criminal and/or civil penalties. . The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland, stream or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality. NCDOT Work Order No. 6.382088T. The North Carolina Department of Transportation (NCDOT) proposes to upgrade and pave SR 1724 (Jack Sherman Road) from US 158 to Dead End in Person County (Figures 1 and 2). Total project length is 0.75 miles. Transportation and highway laws of North Carolina (G. S. 136-44.6, 136-44.7, 136-44.7A, 136-44.8, and 136-44.9) require the NCDOT to develop annual work programs for construction and maintenance of secondary roads. These general statutes specifically set forth requirements for annual construction and paving of existing unpaved roads. Paving of these roads is performed in priority order as established by the NCDOT for each unpaved road within a given county. This number is based on characteristics of each road, including number of homes, schools, churches, businesses, industries, recreational facilities, traffic counts, presence of school bus routes, and value as a thoroughfare. SR 1724 is scheduled to be paved in the 2001-2002 Secondary Roads Construction Program. Impacts to Waters of the United States Construction of the project will necessitate impacts to waters of the United States at two sites in the Tar-Pamlico River Basin. Wetland delineations were conducted using the field delineation method outlined in the 1987 Corps of Engineers Wetland Delineation Manual (Environmental Laboratory, 1987). U. S. Army Corps of Engineers (USACE) Wetland Data Forms and a North Carolina Division of Water Quality (DWQ) Wetland Rating Form are attached to this application. _ .U Division 5, 2612 N. Duke Street, Durham, NC 27704 Phone: (919) 560-6081 Fax: (919) 560-3371 Q 2 Site 1-Station 25+71-Rt- to Station 26+47-Rt- and Station 26+27-Lt- to Station 26+55-Lt The project crosses an unnamed intermittent tributary to Cub Creek (DWQ Index No. 28-3, Best Usage Classification WS-IV NSW) (Figure 3). The existing structure that conveys the creek is a 24-inch reinforced concrete pipe that is 26 feet long. The replacement structure is a 36 inch concrete pipe that is 48 feet long. Permanent impacts at the site associated with the replacement of the structure and minimal amounts of rip rap to protect the structure include <0.01 acre fill in surface water and 42 linear feet existing channel impacted. Impacts at this site also occur to an emergent wetland (PEM2B). Permanent impacts at this site include 0.04 acre fill in wetlands. The wetland has a DWQ wetland rating of 20. Site 2-Station 16+62-Lt- to Station 17+20-Lt- The project impacts a palustrine forested wetland (PFO1 B) (Figure 4). Permanent impacts at this site include <0.01 acre fill in wetlands. The wetland has a DWQ wetland rating of 16. Riparian Buffer Impacts The construction of the project involves a road crossing of a stream that is subject to the Tar-Pamlico River Riparian Buffer Rule. The unnamed intermittent tributary to Cub Creek at Site 1 is depicted on the most recent version of the Moriah, North Carolina topographic quadrangle (USGS, 1981, Photorevised 1987) (Figure 1) and the Soil Survey of Person County, North Carolina (USDA-NRCS, 1995) (Figure 2) The construction of the project at Site 1 results in impacts to the riparian buffer (Figure 3). Construction impacts at Site 1 total 2,361 square feet in Zone 1, 1,518 square feet in Zone 2 and 49 linear feet of riparian buffer. Based on the impacts to the riparian buffer at this site, this crossing is allowable. The NCDOT certifies that the criteria documented in Sub-Item (8)(a) of the buffer rules (which find that there are no practical alternatives to the project) are met. The NCDOT requests an Authorization Certificate for this activity at this project. The NCDOT proposes to install temporary erosion and sediment control devices at Site 1 in Zone 1 and Zone 2 of the riparian buffer. Specifically, the NCDOT will place a temporary rock silt check (Type A) in Zone 1 and a temporary rock sediment dam (Type B) in Zone 2. The temporary structures will be removed once vegetation has been established and then seeded with a seed mixture of fescue and bahia grass. The riparian buffer adjacent to Site 1 is comprised of grassed land. Based on impacts to the riparian buffer at this site from this use, this activity is allowable with a variance from DWQ. A copy of the sediment and erosion control plan at Site 1 is depicted in Figure 5. The NCDOT certifies that the criteria documented in Sub-Item (8)(a) of the buffer rules (which find that there are no practical alternatives to the project) are met. The NCDOT requests an Authorization Certificate for this activity at this project. 411.. Waters of the U.S. Mitigation Avoidance: All wetlands and surface waters not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization: The side slopes have been steepened to the extent possible at jurisdictional sites. Strict enforcement of sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be enforced during project construction. Continued coordination will occur with maintenance forces and the Environmental Officer during construction to minimize impacts to these sites. Compensatory Mitigation: tion: Construction of the project will result in only minimal impacts to waters of the United States. Impacts have been avoided and minimized to the maximum extent possible during the design process. Due to minimal impacts, compensatory mitigation for stream and wetland impacts will not be provided for this project. Protected Species Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the ESA. As of February 27, 2001, there are no federally-protected species listed for Person County. Summary NCDOT proposes to upgrade and pave SR 1724 in Person County. The NCDOT will comply with all applicable NWP and. WQC conditions. In compliance with Section 143-215.3D(e) of the NCAA we have enclosed a check for $200.00 to act as payment for processing the 4 Section 401 permit application. This form is also to be used for any project requiring approval under any Riparian Buffer Rules implemented by the N.C. Division of Water Quality. S. The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant which 401 Certification will apply until the 404 Permit type has been determined by the USACE. Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at http://h2o.enr.state.nc.us/ncwetlands to read about current requirements for the 401 Water Quality Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The applicant is also advised to read the full teat of the General Certification (GC) matching the specific 404 Permit requested. In some cases, written approval for some General Certifications is not required, provided that the applicant adheres to all conditions of the GC. Applicants lacking access to the internet should contact DWQ's Central Office in Raleigh at (919) 733-1786. Trout Waters Coordination - Special coordination with the North Carolina Wildlife Resources Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five counties that contain trout waters. In such cases,.the applicant should contact the appropriate NCWRC regional coordinator (listed by county on the last page of this application). Page 1 of 12 CAMA Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on the last page of this application) the applicant should also contact the North Carolina Division of Coastal Management (DCM) at (919) 733-2293. DCM will determine whether or not the project involves a designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency. In such cases, DCM will require a Coastal Area Management Act (CAMA) Permit and will coordinate the 404/401 Permits. USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms, photos, etc. to the applicable USACE Regulatory Field Office (addresses are listed at the end of this application). Upon receipt of an application, the USACE will determine if the application is complete as soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant to address information needs for all USACE Nationwide, Regional or General permits, as well as information required for State authorizations, certifications, and coordination. Fully providing the information requested on this form will result in a complete application for any of the USACE Nationwide, Regional or General permits. Submit seven collated copies of all USACE Permit materials to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center, Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401 Certification, then a non-refundable application fee is required. In brief, if project impacts include less than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is required. A check made out to the North Carolina Division of Water Quality, with the specific name of the project or applicant identified, should be stapled to the front of the application package. For more information, see the DWQ website at http://h2o.ehnr.state.nc.us/ncwetlands/fees.html. The fee must be attached with the application unless the applicant is a federal agency in which case the check may be issued from a separate office. In such cases, the project must be identifiable on the U.S. Treasury check so that it can be credited to the appropriate project. If written approval is sought solely for Buffer Rules, the application fee does not apply, and the applicant should clearly state (in a cover letter) that only Buffer Rule approval is sought in writing. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed.
