Stevens Division of Water Quality 2001 County DWQ oject # APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Dear Mr. You have our approval, in accordance with the attached conditions and those listed below, to place fill material in acres of wetlands and linear feet of streams for the purpose of at as described in your application dated . After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number . This certification allows you to use Nationwide Permit Number when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional _ wetlands and streams _to_ notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that a final, written stormwater management plan shall be approved by this Office before the impacts specified in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. Also, before any permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and operational, and the stormwater management plan, as approved by this Office, shall be implemented. PROJECT SUMMARY: The applicant proposes to construct a multi use path on the east side of US 17 Business from the S bridge to the Winfall Town limits. NCDOT Field Investigation Report Page Two Project Setting The project setting is located along the east side of US 17 Business starting at the historic "S" bridge in the town of Hertford to the Winfall town limits in Perquimans County and adjacent to the Perquimans River. The roadway for US 17 Business is a manmade causeway through a cypress swamp peninsula which connects the high ground portion of the roadway at the Winfall town limits to the "S" bridge, a turntable bridge that provides vehicular access to downtown Hertford. The causeway has an elevation of approximately 3 ft. above the normal water level and has approximately 1850 ft. of shoreline on the east side of the right of way. The shoulders for the roadway at the development site are very narrow and soft and the roadway has experienced washouts during hurricanes. In some areas of the causeway, the location of the normal water line is within 6 ft. of the existing pavement. Approximately 700 ft. of the shoreline has small amounts of riprap and what appears to be old asphalt tailings. Adjacent riparian property consists of a drive-in and fishing center with a manmade canal and an abandoned dump site for the Town of Hertford. The waters of the Perquimans River are classified as SC in the area of the development site and are closed to shellfish taking. Development Proposal In order to provide a multi-use (bike & pedestrian) path along US 17 Business from the Perquimans River "S" bridge to the Town of Winfall line, the applicant proposes to construct a 6 to 8 ft. wide and approximately 2110 ft. long asphalt path to be located 5 ft. east of US 17 Business. The 6 ft. wide section will run along the portion of the roadway that fronts the Perquimans River. The 8 ft. wide sections are proposed for areas that front the wetlands. A two ft. wide earthen shoulder will be constructed waterward of the path and will be covered with sod. The entire 1850 ft. long shoreline will be protected with riprap which will be placed an average distance of 5 '/2 ft. waterward of normal water level. The riprap will also be used for the portion of the project that penetrates the swamp. The riprap and fill material will be placed in 404 wetlands to create the foundation for the path. The backfill material will be sand from an approved borrow site. Anticipated Impacts The development proposal will result in approximately 9,500 sq. ft. of Public Trust Area and Estuarine Waters Areas of Environmental Concern (AECs) being filled; approximately NCDOT Field Investigation Report Page Three 7300 sq. ft. of Section 404 wetlands located in the Estuarine Shoreline AEC being filled; and approximately 1650 sq. ft. of Section 404 wetlands, located outside the Estuarine Shoreline AEC, being filled. The proposed amount of fill to be placed below the normal water level is approximately 400 cu yds. Approximately 11,300 sq. ft. of the asphalt path will be located in the Pubic Trust Shoreline AEC. Water turbidity will occur during construction. The project will provide shoreline protection for US 17 Business and act as a buffer between the existing roadway and the adjacent waters of the Perquimans River. Submitted by: Frank A. This project will be part of a planned system of paths from the Winfall School on NC 37 to the Newbold-White House on SR 1336. The walkway will enhance the area by providing pedestrians and bicycle enthusiasts a safe passageway along the Perquimans river shoreline. The path will be 2110 feet long and 6 feet to 8 feet wide constructed of 6" ABC base and 2" of asphalt surface. DOT will minimize impacts to wetlands by reducing the proposed 8-foot wide paved path area to 6 feet wide in areas with less existing shoulder. To accomplish the proposed improvements, there would need to be a 5-foot shoulder separating the path from the road and then an 6 to 8-foot path, 2 feet of sod shoulder and 3 to 10 foot of rip-rap shoreline stabilization. The shoreline will be stabilized with 2000 tons of "Class 1" rip-rap placed an average of 5.5 feet from NWL with a maximum of 10 feet waterward. Sand and rip rap fill material will total about 400 cubic yards below Normal Water Level. This footpath will impact approximately 0.27 acres of wetlands. Since wetland continuums occur along the boundaries of sections of the project, essentially up to the existing toe of fills, it is not possible to avoid impacting these wetlands. Proposed wetland compensation will be provided in a 2:1 ratio of riverine/palustrine wetland making for a total of 0.54 acres at the Balance Tract Mitigation Site (DOT). P.O.
