In accordance with Tracey Conrad Pittman, PE, the field inspection will begin at 10:30 a.m. on June 8, 2000 at the Division Office Conference Room. I request that each of you attend this meeting or have a representative attend for you. Attached is a list of the environmental commitments that were developed during the planning stage of the project. Review these commitments to ensure all construction-related commitments can be properly executed. This project is scheduled to be let June 19 2001; therefore, all final data should be submitted to this office prior to March 13, 2001. Under separate cover, we are forwarding two sets of Roadway plans to the Division Engineer. Also, the CADD files have been placed on CC4/TIPDATA/B- 3366 for your use. Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to replace Bridge No. 122 over Cotton Mill Branch on NC 41. The existing right-of-way (ROW) is 18.3 m (60.0 ft) and the proposed ROW is 24.4 m (80.0 ft). The existing cross section is a 17.1 m (56.0 ft) wide bridge with an existing structure type of a reinforced concrete floor on I-beams. Bridge No. 122 will be replaced with a two barrel, 8-foot by 8-foot reinforced concrete box culvert at the same location as the existing bridge (see Fig. 2). The roadway will be 64 feet wide from face to face of curbs with gutters. Approach work will consist of resurfacing to tie in to the existing roadway approaches to the bridge. Existing sidewalks on both sides of the bridge will be replaced. The project length will be approximately 500 feet. Traffic will be maintained by phase constructing an extra length culvert to accommodate two lanes of traffic during construction. No wetlands will be impacted by the proposed work. Bridge replacement over the Cotton Mill Branch is scheduled to be let to construction on June 19, 2001. Temporary and permanent fill in surface water impacts are anticipated. The project will impact 115 linear feet of stream. Total instream impacts equal 0.042 acres. No wetlands are located within the project area. Bridge No. 122 contains one span totaling 21 feet (6.4 meters). The bridge superstructure is composed of a reinforced concrete deck with steel beams. The bridge superstructure is composed of two end bents, consisting of timber piles and caps. The end bents will be removed without dropping any of its components into Waters of the United States. There is potential for components of the reinforced concrete deck to be dropped into Waters of the United States during construction. The resulting potential temporary fill associated with bridge deck is approximately 23 yd3. The Categorical Exclusion document prepared for the project includes environmental commitments. All standard procedures and measures will be implemented to avoid or minimize environmental impacts. All practical Best Management Practices will be included and properly maintained during project construction. The project is being processed by the FHWA as a "Categorical Exclusion" (CE) in accordance with 23 CFR 771.115(b). A copy of this document has been attached to this letter as well as a copy of the Natural Resources Technical Report prepared for this project. The NCDOT does not anticipate requesting a Section 404 Individual Permit but proposes to proceed under a Section 404 Nationwide Permit 23 and 33 in accordance with 33 CFR 330 issued by the COE. The provisions of Section 330.4 and Appendix A (C) of these regulations will be followed in the construction of the project. The NCDOT anticipates that 401 General Water Quality Certification for an approved CE will apply to this project. A copy of the CE document has also been provided to the North Carolina Department of Environment and Natural Resources, Division of Water Quality, for their review. Bridge No. 122 will be replaced with a two barrel, 8-foot by 8-foot reinforced concrete box culvert at the same location as the existing bridge (see Fig. 2.) The roadway will be 64 feet wide from face to face of curbs with gutters. Approach work will consist of resurfacing to tie in to the existing roadway approaches to the bridge. Existing sidewalks on both sides of the bridge will be replaced. The project length will be approximately 500 feet. Traffic will be maintained by phase constructing an extra length culvert to accommodate two lanes of traffic during construction. Purpose and Need: B. Bridge No. 122 has a sufficiency rating of 47.E out of 100. The deck and superstructure of the 60-year old bridge are in poor condition. For these reasons, Bridge No. 122 needs to be replaced. Special Project Information Environmental Commitments: All standard procedures and measures will be implemented to avoid or minimize environmental impacts. All practical Best Management Practices (BMP's) will be included and properly maintained during project construction. In accordance with the provisions of Section 404 of the Clean Water Act (33 U.S.C. 1344), a permit will be required from the Corps of Engineers for the discharge of dredged or fill material into "Waters of the United States." North Carolina Division of Environmental Management (DEM) Section 401 Water Quality General Certification will be obtained prior to issue of the Army Corps of Engineers Nationwide Permit #23. Design Speed: 60 mph Functional Classification: Urban Other Principal Arterial Division Office Comments: At the Division's recommendation, NCDOT will maintain two lanes of traffic on-site by phase construction of the project. Discussion: NC 41 consists of a 44-foot face-to-face of curbs facility that operates as four narrow lanes in a high-density development area. Three alternative cross sections were considered. Each consists of providing ultimate multi-lane curb and gutter sections, with only two lanes during construction. Provision of a separate on-site detour structure is not feasible due to the proximity of development. Alternate 1 - 44-foot (f.f.) curb and gutter Alternate 2 - 52-foot (f.f.) curb and gutter Alternate 3 (Recommended) - 64-foot (f.f.) curb and gutter Alternate 3 (Recommended) involves approximately 150 feet of curb and gutter that could be utilized in future widening of NC 41. The remainder of the project consists of tapering back to the existing 44-foot face to face curb and gutter width. The Lumberton Planning Director has concurred in the recommended 64- foot cross section. The Lumberton Thoroughfare Plan specifies a cross section of six-lane divided with a 16-foot raised median, however, provision of a width greater than 64 feet would require an intolerable number of relocatees. Alternates 1 and 2 do not provide acceptable widths or substantially reduced costs. Numerous utilities (water, sewer, gas, telephone, and power) will be disrupted as a part of the project. 4 E. Threshold Criteria The following evaluation of threshold criteria must be completed for Type II actions. Based on our present knowledge of the area, it is unlikely that any archaeological resources which may be eligible for inclusion in the National Register of Historic Places will be affected by the project construction. We, therefore, recommend that no archaeological investigation be conducted in connection with this project. T.I.P. No. B-3366; State Project No. 8.1463001; Federal Project No BRSTP- 41(4). This report is to assist in the preparation of a Programmatic Categorical Exclusion (PCE) for the subject project. Water resources, biotic resources and jurisdictional issues such as wetlands and federally protected species are included in this report. This project involves the replacement of Bridge No. 122 on NC 41 over Cotton Mill Branch in Robeson County. The existiing right-of-way (ROW) is 18.3 m (60.0 ft) and the proposed ROW is 24.4 m (80.0 ft). The existing cross section is a 17.1 m (56.0 ft) wide bridge with an existing structure type of a reinforced concrete floor on I-beams. The proposed cross section is a 4 lane roadway with 5 foot sidewalks on each side. The proposed structure type is 2 @ 3.0 m (10.0 ft) by 2.4 m (8.0 ft) reinforced concrete box culverts. The total length of the project is 91.4 m (300.0 ft). DEFINITIONS Definitions for areal descriptions used in this report are as follows: Project Study Area denotes the area bounded by proposed ROW limits; Project Vicinity describes an area extending 0.8 km (0.5 mi) on all sides of the project study area; and 2 Project Region is equivalent to an area represented by a 7.5 minute USGS quadrangle map. WATER RESOURCES One jurisdictional surface water is located within the project study area. Bridge No. 122 crosses over Cotton Mill Branch. The stream contained minimal water flow at this bridge crossing when the site visit was made. Streams have been assigned a best usage classification by the Division of Water Quality (DWQ). The best usage classification for Cotton Mill Branch (Index No. 14-14, Date 9/1/74) is C Sw. Class C refers to freshwaters protected for secondary recreation, fishing, aquatic life including propagation and survival, and wildlife. Swamp waters (Sw) is a supplemental classification designating waters which have low velocities and other natural characteristics which are different from adjacent streams. Point source dischargers located throughout North Carolina are permitted through the National Pollutant Discharge Elimination Service (NPDES) program. Any discharger is required to register for a permit. There are no point source dischargers affecting the project study area. Neither High Quality Waters (HQW), Water Supplies (WS-I or WS-II) nor Outstanding Resource Waters (ORW) occur within 1.6 km (1.0 mi) of the project study area. The DWQ has initiated a whole basin approach to water quality management for the 17 river basins within the state. To accomplish this goal the DWQ collects biological, chemical and physical data that can be used in basinwide assessment and planning. All basins are reassessed every five years. Prior to the implementation of the basinwide approach to water quality management, the Benthic Macro i nve rtebrate Ambient Network (managed by the DEM) assessed water quality by sampling for benthic macroi nverteb rate organisms at fixed monitoring sites throughout the state. No monitoring sites are located within the project area. The NCDOT, in cooperation with the DWQ, has developed a sedimentation control program for highway projects which adopts formal Best Management Practices (BMPs) for the protection of surface waters. Removal of vegetation and soil agitation during project construction will result in soil erosion. Without erosion control measures, sedimentation from the project site could still reach jurisdictional surface waters through flow over impervious surfaces or through storm water management systems. In order to minimize impacts to water resources in the entire impact area, NCDOT's (BMPs) for the Protection of Surface Waters must be strictly enforced during the entire construction process. BIOTIC RESOURCES NCDOT natural systems specialists Shannon Simpson and Lindsey Riddick identified one dominant terrestrial plant community during a field visit on December 3, 3 1998. A maintained/disturbed community dominates the landscape in the project study area. Maintained/Disturbed A maintained/disturbed community along a heavily traveled interstate dominates the project study area. Herbaceous and shrub species identified include; fescue (Festuca sp.), goldenrod (Solidago sp.), blackberry (Rubus argutus), plantain (Plantago sp.), dog fennel (Eupatorium capillifolium), and knotweed (Polygonum sp.). Vines found in the project area include trumpet creeper (Campsis radicans). The shrub and vine species were found on the stream banks. Plantain and fescue dominate the field which extends up to the edge of the stream banks. Wildlife Raccoon (Procyon lotor) forage nocturnally in roadside habitats and are often observed as roadkill on adjacent roadways. The least shrew (Cryptotis parva), eastern harvest mouse (Reithrodontomys humulis) and hispid cotton rat (Sigmodon hispidus) frequent disturbed or open areas dominated by herbaceous vegetation which provide foraging and nesting habitat. Eastern cottontails (Sylvilagus floridanus) prefer brushy edges where they primarily feed on weedy perennials. Snakes such as the black racer (Coluber constrictor) and eastern garter (Thamnophis sertalis) may venture into this community to feed on small mammals and insects. Chipping sparrows (Spizella passerina) also frequent roadsides and brushy areas. Mockingbirds (Mimus polyglottos) can be found along roadsides and in woodland edges and thickets, hedgerows, and dooryards where it makes its nest in bushes, vines, and trees. Mourning doves (Zenaida macroura) use twigs and pine needles to build their nest on the ground, in vines and bushes, or on a horizontal limb. Impacts To Communities The biotic communities found within the project area will be altered as a result of project construction. Terrestrial communities serve as nesting, foraging, and shelter habitat for fauna. However, the majority of the project study area is in a highly altered state and plants and animals here are well adapted to disturbed conditions. Flora and fauna occurring in the disturbed community are common thoughout North Carolina because of their ability to persist in disturbed habitats. Moreover, similar additional disturbed habitats will be re-established after project construction. Animals temporarily displaced by construction activities should repopulate areas suitable for the species following project completion. . The calculation of community impacts is based on the total project area minus the existing road and bridge facilities. The ROW width (24.4 m [80.0 ft]) and project length (91.4 m [300.0 ft]) were used to determine the total area of the project impacts. It is estimated that approximately 0.02 ha (0.04 ac) of maintained roadside shoulder will be eliminated by this project. 4 JURISDICTIONAL ISSUES Surface Waters and Wetlands Surface waters and jurisdictional wetlands fall under the broad category of "Waters of the United States," as defined Section 33 of the Code of Federal Register (CFR) Part 328.3. Wetlands, defined in 33 CFR 328.3, are those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and under normal circumstances do support, a prevalence of vegetation typically adapted to life in saturated conditions. Any action that proposes to place fill material into these areas falls under the jurisdiction of the U.S. Army Corps of Engineers (COE) under Section 404 of the Clean Water Act (CWA) (33 U.S.C. 1344). Criteria to determine the presence of jurisdictional wetlands includes evidence of hydric soils, hydrophytic vegetation and hydrology. No jurisdictional wetlands are located within the project study area. One jurisdictional surface water, Cotton Mill Branch, is located in the project study area. The replacement of Bridge No. 122 will impact Cotton Mill Branch. If the current design is changed in any way then these surface waters will have to be reevaluated. Permits Encroachment into jurisdictional surface waters as a result of project construction is inevitable. Since the project is classified as a Programmatic Categorical Exclusion (PCE) a Nationwide Permit 33 CFR 330.5 (a)(23) is likely to be applicable for the proposed construction. This permit authorizes any activities undertaken, assisted, authorized, regulated, funded or financed, in whole or in part, by another federal agency or department has determined pursuant to the Council on Environmental Quality regulation for implementing the procedural provisions of the National Environmental Policy Act, that the activity, work, or discharge is Categorically Excluded from environmental documentation because it is included within a category of actions which neither individually nor cumulatively have a significant effect on the human environment and the office of the Chief of Engineers has been furnished notice of the agency's or department's application for the CE and concurs with that determination. A Section 401 General Water Quality Certification is required for any activity which may result in a discharge and for which a federal permit is required. State permits are administered through the Department of Environment, Health and Natural Resources (DEHNR). Federally-Protected Species Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered, and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act. As of May 14, 1998, three 5 species are listed for Robeson County (U.S. Fish and Wildlife Service 1997). A summary of each species' natural history follows. Table 1. Picoides borealis (red-cockaded woodpecker) Endangered Animal Family: Picidae Date Listed: October 13, 1970 The adult red-cockaded woodpecker (RCW) has a plumage that is entirely black and white except for small red streaks on the sides of the nape in the male. The back of the RCW is black and white with horizontal. stripes. The breast and underside of this woodpecker are white with streaked flanks. The RCW has a large white cheek patch surrounded by the black cap, nape, and throat. The RCW uses open old growth stands of southern pines, particularly longleaf pine (Pinus palustris), for foraging and nesting habitat. A forested stand must contain at least 50% pine, lack a thick understory, and be contiguous with other stands to be appropriate habitat for the RCW. These birds nest exclusively in trees that are >60 years old and are contiguous with pine stands at least 30 years of age. The foraging range of the RCW is up to 200.0 ha (500.0 ac). This acreage must be contiguous with suitable nesting sites. These woodpeckers nest exclusively in living pine trees and usually in trees that are infected with the fungus that causes red-heart disease. Cavities are located in colonies from 3.6-30.3 m (12.0-100.0 ft) above the ground and average 9.1- 15.7 m (30.0-50.0 ft) high. They can be identified by a large incrustation of running sap that surrounds the tree. The RCW lays its eggs in April, May, and June; the eggs hatch approximately 38 days later. Biological Conclusion No Effect Nesting habitat for the RCW which requires open old growth stands of southen pines and a foraging range of up to 200.0 ha (500.0 ac) does not exist within the project study area. The NCNHP database of rare species does not list any populations of the RCW within the project vicinity. This project will not effect the red-cockaded woodpecker. 6 Rhus michauxii (Michaux's sumac) Endangered Plant Family: Anacardiaceae Federally Listed: September 28, 1989 Flowers Present: June Michaux's sumac is a densely pubescent rhizomatous shrub. The bases of the leaves are rounded and their edges are simply or doubly serrate. The flowers of Michaux's sumac are greenish to white in color. Fruits, which develop from August to September on female plants, are a red densely short-pubescent drupe. This plant occurs in rocky or sandy open woods. Michaux's sumac is dependent on some sort of disturbance to maintain the openness of its habitat. It usually grows in association with basic soils and occurs on sand or sandy loams. Michaux's sumac grows only in open habitat where it can get full sunlight. Michaux's sumac does not compete well with other species, such as Japanese honeysuckle, with which it is often associated. Biological Conclusion No Effect Disturbed, open areas do exist within the project study area, although due to frequent mowing of this community it does not provide suitable habitat for Michaux's Sumac. The NCNHP database of rare species does not list any populations of Michaux's sumac within the project vicinity. This project will not affect Michaux's sumac. Federal Species of Concern (FSC) are those plant and animal species which may or may not be listed in the future. These species were formerly candidate species, or species under consideration for listing for which there was insufficient information to support a listing of Endangered, Threatened, Proposed Endangered, or Proposed Threatened. Federal Species of Concern are not afforded federal protection under the ESA and are not subject to any of its provisions, including Section 7, until they are formally proposed or listed as Threatened or Endangered. Organisms which are listed as Endangered (E), Threatened (T), Significantly Rare (SR), or Special Concern (SC) by the North Carolina Natural Heritage Program (NCNHP) list of rare plant and animal species are afforded state protection under the State Endangered Species Act and the North Carolina Plant Protection and Conservation Act of 1979; however the level of protection given to state listed species does not apply to NCDOT activities. Fourteen FSC are listed for Robeson County. Table 2 lists FSC and State listed species, the species state status (if afforded state protection) and the existence of suitable habitat for each species in the study area. Threatened (T) species are native or once-native species of a wild plant or animal which is likely to become an endangered species within the foreseeable future throughout all or a significant portion of its range. Special Concern (SC) species require monitoring, but may be collected and sold under regulations adopted under the provisions of the Plant Protection and Conservation Act. Significantly rare (SR) species are very rare in North Carolina, generally with 1-20 populations in the state. These species are generally more common somewhere else in their ranges, occurring in North Carolina peripherally to their main ranges, mostly in habitats which are unusual in North Carolina. Candidate (C) species are very rare in North Carolina, with 1-20 populations in the state, generally substantially reduced in numbers by habitat destruction. Proposed (P) species have been formally proposed for listing as Endangered, Threatened, or Special Concern, but have not yet completed the legally mandated listing process. Surveys for the above- mentioned species were not conducted during the site visit, nor were these species observed during the site visit. A review of the Natural Heritage Program database on October 2, 1998 revealed a population of Florida yellow-eyed-grass (Xyris difformis var. floridana) and a citing of the American alligator (Alligator mississipiensis) within 1.6 km (1.0 mi) of the project study area.
