Dear Mr. Thompson:
You have our approval, in accordance with the attached conditions and those listed below, to impact
0.085 acres of wetlands and 508 linear feet of intermittent stream impacts to unnamed tributaries of
Mallard Creek in order to realign an existing two-lane section of West Sugar Creek Road (SR 2480)
in Mecklenburg County. The project should be constructed as described in your application dated
April 26, 2001 (received May 4, 2001). After reviewing your application, it is our determination that
your proposed activities are covered by General Water Quality Certification Number 3289 which
corresponds to Nationwide Permit Number 14 issued by the US Army Corps of Engineers. Prior to
initiating any work in jurisdictional areas you should obtain the necessary permit(s) from the Corps of
Engineers as well as any other federal, state or local permits, including (but not necessarily limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This
approval will expire when the accompanying §404 permit expires, unless otherwise specified in the
General Certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. For this approval to
be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below:
Mitigation
Since the proposed fill is in excess of 150 linear feet of stream length, compensatory mitigation is
required as described in 15A NCAC 2H.0506 (h) (6) and (7). We understand that NCDOT proposes
compensatory mitigation in the form of performing 364 linear feet of onsite stream relocation using
natural stream channel design. No additional stream or wetland mitigation will be required.

On March 16, 2001 a Nationwide 14 permit application was submitted for the subject project.

Dear Mr. Lund:
The North Carolina Department of Transportation (NCDOT) proposes to realign an existing two-
lane section of West Sugar Creek Road (SR 2480) in Mecklenburg County. The improvements
include road realignment of SR 2480, placement of guardrail, and an increase in pavement width
to a thirty-six (36) foot pavement section (increased width includes middle turn lane) with ten
(10) foot usable shoulders.
On March 16, 2001 a Nationwide 14 permit application was submitted for the subject project.
Since that time we have reexamined the project and determined that the wetland impacts for this
project lie within the Yadkin River Basin, Hydrologic Unit 03040101, instead of the Catawba
River Basin, by approximately 8, 000 feet as stated in the original application. In addition, we
have further minimized the impacts on wetlands by eliminating one access road and steepening the
fill slopes to 2:1 instead of the 4:1 depicted in the original application. Therefore, the impacts for
this project are now estimated to be 0.085 acres of riverine wetlands within the Yadkin River
Basin, Hydrologic Unit 03040101. There will be 0.085 acre of fill deposited in wetlands and 508
feet of intermittent stream impacts incurred. NCDOT proposes to minimize stream impacts for
this project by relocating 364 feet of the intermittent stream channel utilizing natural stream
channel design, as specified in the original permit application. The total stream channel loss will
be 144 feet. No compensatory mitigation will be required for this project.
The NCDOT anticipates that the original permit application, as modified, will be authorized under
a Section 404 Nationwide Permit 14. We are also hereby requesting a 401 Water Quality
Certification from the Division of Water Quality. In compliance with Section 143-215.3D(e) of
the NCAA, we have enclosed a check for $475.00 to act as payment for processing the

The North Carolina Wetlands Restoration Program (NCWRP) received an April 6, 2001
letter requesting concurrence that the NCWRP accept payment for the compensatory mitigation
requirements for U-3342 in Mecklenburg County. This letter was correcting an earlier letter,
which identified these impacts in cataloging unit 03050103 in the Catawba River Basin.
NCWRP had accepted that mitigation on January 29, 2001. Based on the corrected.information
provided by you, approximately 0.14 acres of riverine wetlands will be impacted in cataloging
unit 03040105 of the Yadkin River basin and will need mitigation.
The long-term goal of the NCWRP is to be able to accept payments to satisfy .
compensatory mitigation requirements throughout North Carolina. However, at this time the
NCWRP is unable to provide this service throughout the state. The Memorandum of
Agreement with the U.S. Army Corps of Engineers, which allows payments to the Wetlands
Restoration Fund, requires that the compensatory mitigation performed by the NCWRP be
within the same cataloging unit as the impact. At this time, the NCWRP has not accepted any
payments nor do we have any perspective wetland restoration projects in this cataloging unit.
Therefore the NCWRP is unable to accept payment for this project.
