Stevens Division of Water Quality May 4, 2001 DW Q# 01-0463 Madison County Roger D. Bryan NC Department of Transportation P.O. Box 3279 Asheville, NC, 28801-5006 APPROVAL of 401 Water Quality Certification Dear Mr. Bryan: You have our approval, in accordance with the attached conditions, to place fill in 30 linear feet of unnamed tributaries to Long Branch and East Fork Bull Creek in order to pave SR 1345 in Madison County, as described in your application received by the Division of Water Quality on April 2, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3289. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. EASLEY LYNDO TIPPETT GOVERNOR SECRETARY PO BOX 3279, ASHEVILLE, NC 28802 March 27, 2001 Mr. Steve Lund US Army Corps of Engineers ()10463 151 Patton Avenue, Room 208 Asheville, NC 28801-5006 Subject: Nationwide Permit #14 SR 1345, Long Branch Road Madison County, NC Dear Mr. Lund: I have enclosed a straight-line diagram with erosion control plan, a PCN application for NWP #14, and a location map relative to the proposed project on SR 1345, Long Branch Road, Madison County, NC. Long Branch Road is currently a 12-14 feet wide gravel road. Division of Highways plans to pave the road 18 feet wide and increase the typical section. Grading will be light to moderate. Whenever possible, widening will occur on the side opposite the streams. We propose to extend three culverts on unnamed tributaries to Long Branch and E. Fork Bull Creek. Total culvert extensions will be 30 linear feet. Existing channel morphology will be maintained upstream and downstream of the culvert. The culvert will be placed below existing streambed elevation. Riparian vegetation will be reestablished along ? -p disturbed areas associated with the culvert extensions. Stormwater will be diverted ? through grass-lined ditches or vegetated buffers prior to entering streams. E -zz No significant effect on federally listed species (threatened or endangered) or their ~ habitats is anticipated. By copy of this letter, we request Owen Anderson, North Carolina Wildlife Resources Commission Mountain Region Coordinator, to comment directly to the Corps concerning the permit request. -r Y Mr. Steve Lund Page -2 SR 1345, Madison County March 26, 2001 By copy of this letter, we are asking W. Neil Trivette, Area Roadside Environmental Engineer, to comment on the above project. Temporary encroachment into the buffer zone will be required for the project for the following areas: Stations 10+00 -17+50, 33+00 - 39+00, and 46+00 - 49+00. The Unnamed trib. to Long Branch is classified as trout. By copy of this letter, I am forwarding seven (7) copies of the application package to Cynthia Van der Wiele, NC DENR, Division of Water Quality, 401/Wetland Unit for review and comment. A $200.00 check is enclosed for application processing. Please forward comments directly to the Corps with copy to Division 13 Environmental Officer.
