Dear Mr. Burch:
You have our approval, in accordance with the attached conditions and those listed below, to improve Big Horse Branch
Road (SR 1233) in Graham County and extend the culverts. The project should be constructed in accordance with your
application dated 14 February 2001 (received 23 February 2001). After reviewing your application, we have decided that
this project is covered by General Water Quality Certification Number 3289. This certification corresponds to Regional
General Permit Number 1198200031 issued by the Corps of Engineers. In addition, you should acquire any other federal,
state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control,
Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying §404 permit,
unless otherwise specified in the Water Quality Certification. The following additional conditions will be required:
1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the trout spawning
season of October 15 through April 15 to protect the egg and fry stages of trout from sedimentation during
construction.
2. " Stormwater should be directed to buffer areas or retention basins and should not be routed directly into streams.
3. High Quality Waters Erosion Control Guidelines must be implemented prior to any ground-disturbing activities to
minimize impacts to downstream aquatic resources. Temporary or permanent herbaceous vegetation should be
planted on all bare soil within 15 days of ground-disturbing activities to provide long term erosion control.
4. The culvert required for this project shall be installed in such a manner that the original stream profile is not altered
(i.e. the depth of the channel should not be reduced by a widening of the streambed).
5. All work shall be performed during low flow conditions.
6. All mechanized equipment operated near surface waters should be regularly inspected and maintained to prevent
contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
7. The presence of equipment in the channels must be minimized. Under no circumstances should rock, sand or other
materials be dredged from the wetted stream channel under authorization of this permit, except in the immediate
vicinity of the culverts.
8. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm water sheet flow.
9. Use of rip-rap for bank stabilization- is to be minimized; rather, native vegetation is to be planted when practical. If
necessary, rip-rap should be limited to the stream bank below the high water mark, and vegetation should be used for
stabilization above high water.
10. Rock silt screens at culvert outlets should be removed at project completion.

This approval is valid solely for the purpose and design described in your application (unless modified below). Should
your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions.
If the proposed fill is in excess of 150 linear feet of stream length or 1 acre of wetlands, compensatory mitigation will
required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed above.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter: To ask for a hearing, send a written petition that conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.

The North Carolina Department of Transportation (NCDOT) is proposing to grade, drain,
base and pave SR 1233, Big Horse Branch Road, primarily along the existing roadway. In order
to construct this project in accordance with our current secondary road standards and due to the
proximity of a trout stream (Horse Branch and tributaries, DEM Class C - Trout Water) and
extension of pipe culverts, we are requesting (a renewal) of NWP 14 (Action Id. 199930795)
received by this office on May 24, 1999. Attached is a copy of the original approval of NWP 26
for the subject roadway.
I am sending a straight-line diagram with the proposed erosion control, stream, stream
bank, and construction limits and various sites along the project where we will be in conflict with
the stream. In addition, I am sending a typical section of the road, cross sections, drawings for
pipe culvert replacements, general notes and standards on some erosion control measures, and a
marked map. We propose to install all the new culverts slightly below the existing streambed
elevations where bedrock is not encountered to minimize impacts to wildlife habitats and allow
the existing stream gradients to remain as unchanged as is physically possible. No threatened or -

endangered species are known to be present in or near the project area; therefore, no significant
impacts are anticipated from project construction.

The best management practices will be used to minimize and control sedimentation and ~
erosion on this project. The construction foreman will review all erosion control measures daily
to ensure sedimentation and erosion are being effectively controlled. If the planned devices are
not functioning as intended, they will immediately be replaced with better devices. The rocksilt
screens and other erosion control devices will be in place prior to pipe culvert construction and
will remain in place until the project is stabilized.

By copy of this letter, I am asking Owen Anderson, North Carolina Wildlife Resources
Commission (NCWRC) Western Mountain Region Coordinator, to comment directly to you
concerning the 404 Nationwide Permit request.
A request was made and authorized on this project for a temporary encroachment in the
Trout Water Buffer Zone of Horse Branch. Our construction will encroach in the buffer zone
from approximate survey station 26+00 to survey station 43+50. Plans are attached to this
request showing our erosion control devices being implemented along the stream. I am asking
Mr. Anderson and Mr. Ed Ingle, Area Roadside Environmental Engineer (NCDOT) to consider
re-authorization of this encroachment, and that they comment directly to me concerning the
Trout Water Buffer Zone Encroachment.
Also, by copy of this letter, I am requesting reauthorization to proceed under Section 401
of the Clean Water Act from the Division of Environmental Management. (A check payable to
NC Division of Water Quality in the amount of $200.00 is attached to this application with the
new fee schedule).
We would like to begin construction as soon as possible. If further information is

Dear Mr. Johnson:
Mr. Brian C. Burch, P.E., of the North Carolina Department of Transportation is requesting a letter of
concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the
U. S. Army Corps of Engineers. I have reviewed information provided by the applicant, and an onsite
investigation was conducted on May 12, 1999, to assess potential construction impacts on wildlife and fisheries
resources. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C.
466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The applicant proposes to replace/extend 2 culvert structures and work in the trout water buffer zone in
association with roadway improvements. Big Horse Branch is a tributary to Panther Creek. which is managed by
the NCWRC as Hatchery Supported trout water. Both of these streams provide excellent habitat and support wild
trout populations in the project area. The NCWRC is concerned about potential project impacts to trout and other

1. High Quality Waters Erosion Control Guidelines must be implemented prior to any ground disturbing
activities to minimize impacts to downstream aquatic resources. Temporary or permanent herbaceous
vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide
long-tern erosion control.
2. The culverts should be placed with the floor of the barrels approximately one foot below the level of
the stream bottom to allow natural stream bottom materials to become established in the culvert and
to allow fish passage during periods of low flow. This may require increasing the size of the culvert
to meet flow conveyance requirements. The NCWRC recommends that a pipe arch (CSPA) be used
to replace the 60-inch CMP at Site 1.
Under no circumstances should rock, sand, or other materials be dredged from the wetted stream
channel under authorization of this permit, except in the immediate vicinity of the culverts. Instream
dredging has catastrophic effects on aquatic life, and disturbance of the natural form of the stream
channel will likely cause downstream erosion problems, possibly affecting other landowners.
4. If concrete is used during culvert installation (headwalls), a dry work area should be maintained to
prevent direct contact between curing concrete and stream water. Uncured concrete affects water
quality and is highly toxic to fish and other aquatic organisms.
5. Natural materials should be used as much as possible to restore stream banks at crossings. Riprap
should be limited to the stream bank below the high water mark, and vegetation should be used for
stabilization above high water.
6. Construction within the 25-foot buffer zone is prohibited during the trout spawning period of
November 1 to April 15 in order to protect the egg and fry stages from sedimentation.
7. Rock silt screens at culvert outlets should be removed at project completion.
8. Stormwater should be directed to buffer areas or retention basins and should not be routed directly
into streams.
9. All mechanized equipment operated near surface waters should be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants. hydraulic fluids, or other toxic
