At 9:00 am on June 10, 1993, a scoping meeting was held for
project R-2568 in the P&E conference room. In attendance were:

Mgt. could not attend the meeting, but called-in comments earlier.
David Yow of Wildlife Resources gave comments after the meeting.
These minutes are augmented by the informational "handout
provided during the scoping meeting.
The project was introduced as the widening of NC 109 from I-
85 business in Thomasville to I-40/US 311 in Winston-Salem. The
1990 feasibility study was discussed. TIP Estimates are
reflective of the feasibility study's recommendation to widen to
5-lanes throughout the project length, varying between shoulder
section and curb and gutter.
Ted Devens presented a possible change to the project scope.
There is a possibility that the division engineer or the board
member may want to widen from Thomasville to Wallburg, then veer
north to join US 311 in the Union Crossroads vicinity. A
discussion ensued about future projects in the area, namely the
Winston-Salem eastern loop and the potential US 52 Bypass.
Program Development will provide feedback as soon as possible on
which "project" to pursue. The purpose and need for the project
requires better definition. For now, Program Development wants to
proceed with the project as described in the TIP. Statewide
Planning supports the widening of NC 109 all the way to Winston-
Salem, and opposes the link to US 311 north of Wallburg.
Statewide planning conducted a study that shows the new link will
not significantly draw traffic from NC 109 between Wallburg and
Winston-Salem. Eventhough the new link could be used as part of a
larger future system, Statewide Planning feels that NC 109 will
have to be widened anyway. The traffic projections unit (Joe
Springer) is currently working on a model to predict how much
traffic the new alternative will draw from NC 109 north of
Wallburg. For now, the project will proceed per TIP description.
No bicycle facilities are required.
Program Development is considering the acceleration of funds
from post-year.
All agreed that a Federal Environmental Assessment is the
best document to use.
Comments from Robin Stancil of SHPO: An archaeological
survey of the project area is necessary, as well as an
architectural-historic survey. It is likely that Wallburg may
have a historic district, due to the many potentially. significant
properties. Several properties are also scattered along the
project length.
Comments from Eric Galamb of DEM (DEHNR):
He is concerned with the Tom-A-Lex water supply reservoir, and its
tributaries in the area. Several streams/creeks are classified as
WS III. These creeks are: Reedy's Run, Brushy Fork, Abbotts
Creek, Mary Reich Creek, and Spurgeon Creek. Mr. Galamb
recommends use of hydrospill catch basins to protect these
sensitive areas from spills of hazardous substances.
Comments from David Yow of Wildlife Resources:
He is concerned about the water sensitive areas with regard to
fish habitat, and also recommends use of the hydrospill catch
basins. He will arrange for a survey in the project area. Mr..
Yow recommends that any substandard bridges be replaced with
bridges that have adequate spans to allow wildlife movement.
Jerry Snead of Hydraulics mentioned that several bridges may
require replacing. Existing culverts can be extended, although
some grade elevations may need to be raised slightly.
No parks are evident.
Several gasoline stations are located adjacent to NC 109. A
geotechnical survey will be required.
Petroleum pipelines cross NC 109 at two locations. A
regional fiber optics cable has a crossing. A 10" water line and
a 36" gas 'line are located along the project.
Minimal noise impacts are expected. The low density of
development will probably not justify a noise wall.
Right-of-Way is not presently known, and may be the claimed
width.
Existing horizontal alignment is predominantly adequate. An
8 and a 9 degree curve are in the Wallburg vicinity. Vertical
curvature has some problems, with grades of up to 7%. The terrain
is rolling.
Speed limits vary from 45 - 55 mph, except for a 35 mph
section through Wallburg.
A discussion began about a bypass of Wallburg. Because it is
expected that historically significant properties will be
encountered in Wallburg, Section 4F and Section 106 will be a
factor. The only obvious "feasible and prudent alternative" seems
to be a full bypass of Wallburg. Although NCDOT may look at
utilizing the alignment through Wallburg, that alternative does
not look promising. The existence of potentially significant
properties, combined with the low speed limit and bad curves in
Wallburg, make a bypass look like the preferred option.
It was agreed that two cross-sections should be studied. A
5-lane cross-section will provide a 4-lane highway, minimize
right-of-way, yet also provide a protected center left-turn lane.
The cross-section could vary between either a shoulder section or
a curb and gutter section. Additionally, it was agreed that a 4-
lane, median-divided cross-section is a feasible option. This
divided highway will be safer, yet provide a sheltered left-turn
lane in locations that warrant a median break. This type of
section would also limit unchecked development. It was also
agreed that a 4-lane undivided highway is an unacceptable
alternative.
Project R-2568 Scoping Meeting
June 10, 1993
Project Description
Widen NC 109 to multi-lanes from I-85 Business in
Thomasville to US 311 in Winston-Salem. Project length is
13.5 miles.
Existing NC 109 consists primarily of 20-foot pavement
with unpaved shoulders varying front ,3 to 6 feet in width.
Past the southern end of the project, NC 109 continues
southward as a two-lane road with a 20-foot pavement, but at
the northern terminus, NC 109 has been widened to a five-
lane, 64-foot curb and gutter cross section.
A feasibility study was conducted in 1990. The study
recommends widening to five lanes throughout the project.
From I-85 Business to 500 feet north of SR 1772, the
recommended cross section is a five-lane, 64-foot curb and
gutter section. From 500 feet north of SR 1772 to SR 1755, a
five-lane shoulder section is recommended. This cross
section will have a 64-foot paved width, providing five 12-
foot lanes with a 10-foot usable shoulder width (including
2-foot paved shoulders). From SR 1755 to 200 feet north of
SR 1970, a five-lane curb and gutter cross section is
recommended. From 200 feet north of SR 1970 to 2200 feet
south of SR 1724 a five-lane shoulder section on new location
is recommended to provide a bypass of Wallburg. The shoulder
section will continue along the existing alignment from the
Wallburg bypass to SR 1724. From SR 1724, the cross section
reverts back to five-lane curb and gutter for the remainder
of the project to US 311. The TIP estimate was based upon
the feasibility study recommendation.
The NCDOT Bicycle Program has determined that there is
no need for any special accommodations for bicycles on this
project.

Description of the Project Area
Roadside development is primarily rural in character
with isolated residential development and farms. Much of the
land immediately adjacent to the highway is characterized by
low to moderate density residential development. Commercial,
industrial, and institutional development is interspersed
along the project.

Thoroughfare Plan
NC 109 is a major north-south route that serves as a
primary link between cities of Thomasville and Winston-Salem.
The project is classified as a Major Thoroughfare in both the
Thomasville Thoroughfare Plan and the Winston-Salem/Forsyth
County Thoroughfare Plan. From I-85 to the Winston-Salem
Urban Extension Boundary, NC 109 is classified a Rural Major
Collector in the North Carolina Functional Classification
System. The section of NC 109 within Winston-Salem limits is
classified as an other Urban Principal Arterial.
Potential Architectural/Historic or Archaeological Sites
Robin Stancil of SHPO cannot attend the meeting, but
called-in comments. A listing of potentially historic
properties is attached. It is likely that a historic
district may be delineated in the Wallburg vicinity.

Comments by Environmental Agencies
Eric Galamb of the Department of Environmental Mgt
(DEHNR) cannot attend the meeting, but called-in comments.
Hydrospill catch basins are requested at locations where
potential hazardous material spillages can enter the water
supply. The more sensitive areas are at Abbotts Creek,
Reedys Run, and Brushy Fork. On the northeast side of
Wallburg, Spurgeon Creek and Mary Reich Creek are WS III, but
are not crossed by the present alignment.
Right-of-Way
Initial investigation of existing right-of-way yields no
records. Therefore, it is likely that NCDOT may only be able
to claim the maintained width, which is as little as 30 feet.
Alignment
Substandard horizontal alignment in Wallburg vicinity
(8 and 9 degree curves). Terrain is rolling throughout the
project, with vertical grades up to 7%.
Speed Limits
Posted speed limits vary from 45-55 mph for most of the
highway. The speed limit is 35 mph in Wallburg.
Traffic Counts
Not "officially" received, however preliminary numbers
are available. Near the northern end of the project,
preliminary numbers indicate a 1999 ADT of 17,500 vpd, with a
2019 ADT of 31,400. Near the southern end of the project,
1999 ADT is 11,400 and 2019 ADT is 26,000.
Truck percentages vary from 3% to 8%, with a
directional distribution of 60-40.
Traffic Signals
Two signals on NC 109 at the on both sides of the
interchange with I-40/US 311.
Accidents
Not yet received.
Railroad Crossings
None.

It is apparent that not all structures are on the bridge
location maps. A listing must be obtained from the hydrology
unit. Structures currently identified are:

Proposed Improvements to NC 109 from I-85 Business in
Thomasville to I-40/US 311 in Winston-Salem, Davidson and
Forsyth Counties, R-2568
The Water Quality Section of the Division of Environmental
Management requests that the following topics be discussed in the
environmental documents prepared on the subject project:
A. Identify the streams potentially impacted by the project. The
stream classifications should be current.
B. Identify the linear feet of stream channelizations/
relocations. If the original stream banks were vegetated, it
is requested that the channelized/relocated stream banks be
revegetated.
C. Number of stream crossings.
D. Will permanent spill catch basins be utilized? DEM requests
that these catch basins be placed at all water supply stream
crossings. Identify the responsible party for maintenance.
E. Identify the stormwater controls (permanent and temporary) to
be employed.
F. Please ensure that sediment and erosion and control measures
are not placed in wetlands.

G. Wetland Impacts
1) Identify the federal manual used for identifying and
delineating jurisdictional wetlands.
2) Have wetlands been avoided as much as possible?
3) Have wetland impacts been minimized?
4) Discuss wetland impacts by plant communities affected.
5) Discuss the quality of wetlands impacted.
6) Summarize the total wetland impacts.
7) List the 401 General Certification numbers requested from
DEM.
H. Will borrow locations be in wetlands? Borrow/waste areas
should avoid wetlands to the maximum extent practicable.
Prior to approval of any borrow/waste site in a wetland, the
contractor shall obtain a 401 Certification from DEM.
I. Did NCDOT utilize the existing road alignments as much as
possible? Why not (if applicable)?
J. Please provide a detailed discussion for mass-transit as an
option.
K. To what extent can traffic congestion management techniques
alleviate the traffic problems in the study area?
L. Please provide a conceptual mitigation plan to help the
environmental review. The mitigation plan may state the
following:
1. Compensatory mitigation will be considered only after
wetland impacts have been avoided and minimized to the
maximum extent possible.
2. On-site, in-kind mitigation is the preferred method of
mitigation. In-kind mitigation within the same watershed
is preferred over out-of-kind mitigation.
3. Mitigation should be in the following order:
restoration, creation, enhancement, and lastly banking.
Written concurrence of 401 Water Quality Certification may be
required for this project. Applications requesting coverage under
our General Certification 14 or General Permit 31 will require
written concurrence. Please be aware that 401 Certification may be
denied if wetland impacts have not been avoided and minimized to
the maximum extent practicable.

The Planning and Environmental Branch of the Division of Highways has
begun studying the proposed improvements to NC 109. The project is included
in the 1993-1999 North Carolina Transportation Improvement Program and is
scheduled for right of way in fiscal year 1997 and construction in fiscal
year 1999.
Two cross-sections will be studied, with the possibility of alternating
between the cross-sections. The first alternative is a five-lane curb and
gutter section which is 64 feet from curb-face to curb-face, requiring 100
feet of right-of-way. The second alternative is a 4-lane highway (with
shoulders) which is separated by a grassed median, utilizing up to 150 feet
of right-of-way.
We would appreciate any information you might have that would be helpful
in evaluating potential environmental impacts of the project. If applicable,
please identify any permits or approvals which may be required by your
agency. Your comments will be used in the preparation of a federally funded
Environmental Assessment. This document will be prepared in accordance with
the National Environmental Policy Act. It is desirable that your agency
respond by August 4, 1993 so that your comments can be used in the
preparation of this document.

A citizens informational workshop will be held on Tuesday,
September 28, 1993 at the Ledford Senior High School Cafeteria
located on John Green Road (SR ]756) in Davidson County
approximately 0.25 mile from NC 109 north of Thomasville,
North Carolina. This will be an informal open house workshop
held between the hours of 4:00 p.m. and 7:00 p.m. Those
wishing to attend may do so at their convenience during these
hours.
The purpose of this informational workshop'is to present
information, answer questions and receive comments during the
early design stages of the proposed widening of NC 109. The
proposed project consists of converting NC 109 to a multi-lane
roadway.
Representatives of the Department of Transportation will
be available to discuss the proposed project with those
attending. Anyone desiring additional information about the
workshop may contact Mr. Ted Devens, P. E., N. C. Department of

of the Finding of No Significant Impact (FONSI) that was signed in August 1997 and

improve and relocate NC 109 in Davidson County from south of I-85 Business to south of
SR 1800 (Midway School Road). Construction of a four-lane divided facility will be on
new location and include a new interchange with I-85 Business. An Individual Permit
application was submitted by the NCDOT in a letter dated September 14, 1999.
In a phone conversation with Mr. Phillip Todd of my staff, you requested a copy
of the Finding of No Significant Impact (FONSI) that was signed in August 1997 and
information regarding Site 7. A copy of the FONSI has been attached to this letter.
Also attached to this letter is a plan view of Site 7. Upon further review of this
site, the Station Number for the site on the permit drawing summary sheet is incorrect.
The Station Number for Site 7 should read from Station No. 26+20-L- to 26+40-L-. A
revised summary sheet has also been attached to this letter.

As you are aware, the North Carolina Department of Transportation proposes to
improve and relocate NC 109 in Davidson County from south of I-85 Business to south of
SR 1800 (Midway School Road). Construction of a four-lane divided facility will be on
new location and include a new interchange with I-85 Business. An Individual Permit
application was submitted by the NCDOT in a letter dated September 14, 1999.
In a phone conversation with Mr. Phillip Todd of my staff, you requested a copy
of the Finding of No Significant Impact (FONSI) that was signed in August 1997 and
information regarding Site 7. A copy of the FONSI has been attached to this letter.
Also attached to this.letter is a plan view of Site 7. Upon further review of this
site, the Station Number for the site on the permit drawing summary sheet is incorrect.
The Station Number for Site 7 should read from Station No. 26+20-L- to 26+40-L-. A
revised summary sheet has also been attached to this letter.

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 50
linear feet of streams for the purpose of installing a temporary stream crossing on Hunts Fk Creek near 1-85 as described in your
application dated January 30, 2001. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3114. This certification allows you to use Nationwide Permit Number 33 when the Corps of
Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed
regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified
in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. The restoration plan outlined in the January 30, 2001 cover letter must be completed as described.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
1508 of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Dear Mr. Dorney,
In an effort to provide construction access, we are requesting a modification to the permit for the
subject project. The Contractor has requested permission to install a temporary stream crossing on Hunts
Fork Creek just north of I-85 Business, as shown in the attached figures and application. This crossing is
necessary for the hauling to and from the borrow area for the construction of the project. There is no other
access to this site, due to the phasing of the project. We have enclosed seven copies of the application and
a check for $200.00.
The footprint of the crossing will be 700 square feet. Two 48-inch, 50-foot long pipes will be
placed in the creek with approximately 130 cubic yards of rip rap placed over them. Only 50 feet of the
creek will be temporarily impacted. The pipes will be partially buried to allow passage of fish and aquatic
organisms. The time period of the placement will be for the duration of the project, which is expected to be
completed by December 30, 2003. Upon completion, the Contractor will remove all pipes, and rip rap, and
restore the creek and its banks to the original condition by grassing and placing native vegetation on the
banks.

NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-
500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ)
Regulations in 15 NCAC 2H, Section .0500. This certification authorizes the NCDOT to place fill material
in 1.28 acres of jurisdictional wetlands, 0.07 acre of impacts to wetlands from mechanized clearing, 0.31
acre of fill in surface water, 2,682 linear feet of impact to streams (perennial and intermittent streams,
including 197 feet of stream relocation) and 2,485 linear feet of stream loss in Davidson County. The
project shall be constructed pursuant to the application filed on the 14th day of September 1999 to improve
and relocate NC 109 in Davidson County from south of I-85 Business to south of SR 1800 (Midway School
Road). Construction of a four-lane divided facility will be on new location and include a new interchange
with I-85 Business.
The application provides adequate assurance that the discharge of fill material into the waters of Hunt's
Fork and its unnamed tributaries in conjunction with the proposed development will not result in a violation
of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina
certifies that this activity will not violate the applicable portions of Sections 301,302, 303, 306, 307 of PL
92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your application, as described in
the Public Notice. Should your project change, you are required to notify the DWQ and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and approval
letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project
(now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the
conditions listed below. In addition, you should obtain all other federal, state or local permits before
proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal
Stormwater, Non-discharge and Water Supply watershed regulations. ,
Condition(s) of Certification:
1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most
recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or
the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the
DEHNR Regional or Central Offices) shall be utilized to prevent exceedence of the appropriate
turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout
waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters);
2. All sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources
has released the project;
3. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued
by the State Clearinghouse;
4. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the
state until the concrete has hardened;
5. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated
with this certification without appropriate modification of this certification. Should waste or borrow
sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct
impact from road construction activities.
6. Compensatory mitigation shall be performed for 1.35 acres of wetlands at a ratio of 2:1 and for 2279
_ linear feet of jurisdictional stream impacts . We understand that you have chosen to complete off-site
via the Shepherd's Tree Mitigation Site in eastern Iredell County.

Violations of any condition herein set forth shall result in revocation of this Certification and may result in
criminal and/or civil penalties. This Certification shall become null and void unless the above conditions
are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification
shall expire upon the expiration of the 404 or CAMA permit.
If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request
within sixty (60) days following receipt of this Certification. This request must be in the form of a written
petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. If modifications are made
to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written
request within sixty (60) days following receipt of the Certification. Unless such demands are made, this
Certification shall be final and binding.
