Box 47 Shelby, NC 28151-0047 Dear Ms. Simon: You have our approval, in accordance with the attached conditions, to permanently impact 90 linear feet and temporarily impact 80 linear feet of an unnamed tributary to Lick Branch for the purpose of improving SR 2227 (Rippy Road) in Cleveland County. The project should be constructed in accordance with your application dated June 15, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to the U.S. Army Corps of Engineers General (Regional) Permit Number 198200031. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations., This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. If concrete is used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's chemistry and causing a fish kill. 2. Temporary or permanent herbaceous vegetation should be planted on all bare soil within IS days of ground-disturbing activities to provide long term erosion control. 3. The culverts required for this project shall be installed in such a manner that the original stream profile is not altered (i.e. the depth of the channel should not be reduced by a widening of the streambed). Existing stream dimensions are to be maintained above and below locations of culvert extensions. 4. All work shall be performed during low flow conditions. 5. All mechanized equipment operated near surface waters should be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. The presence of equipment in the channels must be minimized. Under no circumstances should rock, sand or other materials be dredged from the wetted stream channel under authorization of this permit, except in the immediate vicinity of the culverts. 7. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm water sheet flow. 8. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted when practical. If necessary, rip-rap should be limited to the stream bank below the high water mark, and vegetation should be used for stabilization above high water. 9. Rock silt screens at culvert outlets should be removed at project completion. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The NCDOT proposes to grade and pave the referenced road. The project will include pipe extensions at Station 13+50 and 24+50 for a total of 90 linear feet of additional fill. A temporary diversion will be required. Pipes will be placed 1 foot below streambed grade and existing channel morphology will be maintained. We will not object to the project provided the following conditions are implemented. The pipes should be designed and constructed large enough so that they can be installed one foot below streambed grade so that all waters can flow through uninterrupted and without damming or freefalling on either end during low flow conditions to maintain passage. The dimension, pattern, and profile of the stream above and below the pipes should not be modified by widening the stream channel or reducing the depth of the stream. Natural channel dimension restoration should be provided if the stream has been previously widened. 2. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 4. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 5. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. Riprap stabilization should be pressed into the substrate so as not to interfere with aquatic life passage. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization when practicable. 6. The water diversion activities should be in compliance with turbidity standards. We believe this project can be accomplished under N",VP # 14, Linear Transportation Crossing: I have enclosed a straight line diagram with erosion control plan, a PCN application for NWP 914, a sketch of planned activities, and a location map relative to the secondary road paving project and pipe replacement projects on SR 2227, Rippy Road, Cleveland County, NC. The stream impacted by the proposed project is an unnamed tributary to Lick Branch, which is classified Class C Waters and is located in the Broad River Basin. The tributary does not appear on the USGS topographical map (Blackburgs North Quadrangle, 1971). There are no wetlands involved in the project. Rippy Road is currently an unpaved gravel road. Division of Highways plans to pave the road from NC/SC State Line to SR 2226. It will be graded and paved.to current standards and typical section using bulldozers, pans, backhoes, rollers, and pavers. The project will include upgrading existing alignment as well as construct an area of new alignment to provide a safer alignment and reduce impacts to a parallel tributary. The alignment change is shown on an enclosed map. The approximate acreage of the secondary road paving project is 7.71 acres of NC DOT right of way. Mr. Steve Lund Page 2- SR2227, Cleveland County June 15, 2001 The project proposal also includes the pipe replacement/extension projects at Stations 13+50 and 24+50. A 20-foot long, 72" CMP will be attached to both the inlet and outlet of the existing 4' x 4' concrete culvert pipe at Station 13+50. A 30' long, 4'x 4' concrete box culvert will be replaced with a 50' long, 54" CMP at Station 24+50. Riprap will be placed at the inlet and outlet of new pipes for bank stabilization. The approximate acreage of these two pipe replacement projects is <'/z acre of the NC DOT right of way. The total linear footage of the unnamed tributary to Lick Branch to be permanently impacted by the placement of fill in the tributary and the placement of riprap at the inlet and outlet for stabilization is 90 feet. The pipes will be placed one foot below existing streambed elevation and disturbed areas associated with the pipe replacements will be stabilized. Existing channel morphology will be maintained. It is proposed that the watercourse be blocked using concrete barriers and sandbags and pumped around the two construction areas through vinyl pipes during pipe installations. The diversions will extend approximately 20 feet beyond the length of the new pipes. A review of the Natural Heritage information for the threatened species listed for Cleveland County, the dwarf-flowered heartleaf (Hexastylis naniflora), did not reveal any known sites in the vicinity of the proposed project. I have conducted a survey for the dwarf-flowered heartleaf in the project area on May 1, 2001. None were observed. It was determined that no heartleaf species or suitable habitat was located in the proposed project area. No significant effect on this species. is anticipated.. _ A review of the National Register of Historic Places was also conducted. There are no sites listed on the National Register nor are there any eligible historic sites that will be affected by the proposed project. Enclosed is concurrence from the State Historic Preservation Office for this project. By copy of this letter, we are asking Neil Trivette, Area Roadside Environmental Engineer to comment on the above project. By copy of this letter, we are also requesting concurrence from the Wildlife Resources Commission and the U.S. Fish & Wildlife Service. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Describe the purpose of the proposed work:The project consists of upgrading the existing unpaved road to current paved road standards for the safety of the travelling public. Will upgrade existing alignment with a 200 feet area of new alignment. The existing roadway is 18 feet and will be paved to 20 feet. At Station 13+50, 20 feet of 72" CMP will be attached to an existin- 4'x4' concrete culvert with concrete headwalls utilizing concrete collars at the inlet and outlet. At Station 24+50, an existing 30-foot long, 4' x 4' concrete culvert will be replaced and with a 50-foot, 54" CNIP. 11. There were several properties for sale adjacent to SR 2227: therefore, it is anticipated that residential development may occur once the road is paved. IV. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. NCDOT will be grading; and paving SR 2227 in order to improve safety and to reduce maintenance of the road. Grading will occur predominantly on existing alignment to minimize impact to the surrounding environment, with only one alignment shift to provide safer alignment for the traveling public and to reduce potential stream impacts to the parallel tributary. The unnamed tributaries to Lick Branch parallels SR 2227 in several areas. Silt fences will be installed in those areas where the construction occurs in close proximity to the stream to prevent excessive silt from entering the tributaries. Also, at these locations where the stream parallels the road, clearing and rue, bbing of vegetation will be minimized in an effort to prevent erosion The streams are 1.0 -2.0 feet in width- a piped stream diversion will be utilized to manage the stream during the pipe placement. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.ne.us/newetlands/strmuide.html. 1. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map; if offsite); affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. As an area is brought to finish grade and the black base is placed for the road; and the shoulder finished, then seed, mulch and tack should be provided for denuded areas. 4. Leave all erosion control devices iri place until vegetation has been established sufficiently to withstand erosion. DO NOT remove any erosion control devices until directed by the County Engneer. MAINTENANCE PLAN 1. All erosion and sediment control practices will be checked for stabiHhr and operation following every runoff producing rainfall but in no case less than once every week. Any repairs will be made immediately to maintain all practices as designed. 3. Sediment will be removed from behind the sediment fence when it becomes about 0.5 feet deep at the fence. The sediment fence will be repaired as necessary to maintain a barrier. 3. All seeded areas will be fertilized, reseeded as necessary and mulched according to the instruction in the seeded specifications to maintain a vigorous, dense vegetative cover. 4. Outlet protection will be installed when outlets are installed. Filter fabric will be placed under the entire stone section and will be repaired and replaced if damaged during any phase of construction. 5. Sediment will be removed from the basin when it reaches 1.0 foot below the emergency spillway. The filter stone is to be cleaned or replaced when basin no longer drains properly. If the owner wants new fence, it will be his responsibility to furnish the post and wire. This road will be in the 2001-2002 program and work will begin after July 1, 2001.
