Smith, II, PWS, Division Environmental Officer NCDOT Division 7 1584 Yanceyville Street Greensboro, NC 27415 Dear Mr. Smith: You have our approval, in accordance with the attached conditions and those listed below, to impact 60 linear feet of an unnamed tributary to Hughs Mill Creek for the purpose of replacing Bridge No. 28 on NC 62 in Caswell County. The project should be constructed in accordance with your application dated 23 March 2001 and additional information proved in correspondence dated 24 April 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. With regard to these questions the following responses are offered at this time: 1, Fish passage will be provided by burial of the pipe at least 1-foot below streambed elevation. This is standard procedure for Bridge Maintenance projects in Division 7. 2. This projects does not require floodplain culverts as it lies outside any special flood hazard areas, the drainage area is too small to justify floodplain culvert construction (see attached items), and the pipe has been sized to handle flooding events that may occur in association with a narrow channel in a drainage of this size. Based on a channel width of 8 feet at high water (see the attached sounding report), the proposed 10.6 foot wide arch is of suflycicnt width to handle flooding. The 18 foot channel width stated in the PCN assumes that the bents are in the channel- The photos that were attached in the original application and a close re iew of the stream bed sounding report will indicate this a is an erroneous assumption. 3. In stream-stabilization was discussed with Randy Boyd, P.E. of the NCDOT Hydraulics Unit. At this time there is uncertainty regarding implementation of this item. Please clarify. The bridge must be replaced due to structural deficiencies. No federally protected species or their habitats were observed during a site visit conducted by Lenwood Smith, II on March 22, 2001. Black willow (Salix nigra) wetlands are present within the confines of the stream channel. Wetland impacts will be less than 0.01 acres. The site is located in a high quality water zone. Impacts will result from the placement of fill in 60 linear feet of channel The NCDOT anticipates that this activity will be authorized under General Permit 198200031. Enclosed please find the project site map and the pre-construction notification form for the above referenced projects.
