Stevens Division of Water Quality May 22, 2001 Caswell County DWQ Project No. 010452 Replacement of Bridge 14 on NC 62 APPROVAL of 401 Water Quality Certification with Additional Conditions Mr. Lenwood Smith, II, Division Environmental Officer NCDOT Division 7 1584 Yanceyville Street Greensboro, NC 27415 Dear Mr. Smith: You have our approval, in accordance with the attached conditions and those listed below, to impact 145 linear feet of Hughes Mill Creek for the purpose of replacing Bridge No. 14 on NC 62 in Caswell County. The project should be constructed in accordance with your application dated 21 March 2001 (and as revised 11 May 2001). After reviewing your application, we have decided that this project is covered by General Water Quality Certification Number 3289. This certification corresponds to Nationwide Permit 14 issued by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying §404 permit, unless otherwise specified in the Water Quality Certification. The following additional conditions will be required: 1. Storm water should be directed to buffer areas or retention basins and should not be routed directly into streams. 2. Sediment and erosion control measures shall adhere to design standards for sensitive watersheds (15A NCAC 4B .0024) prior to any ground-disturbing activities to minimize impacts to downstream aquatic resources. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground-disturbing activities to provide long term erosion control. 3. The culvert required for this project shall be installed in such a manner that the original stream profile is not altered (i.e. the depth of the channel should not be reduced by a widening of the streambed). 4. All work shall be performed during low flow conditions. 5. All mechanized equipment operated near surface waters should be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 6. The presence of equipment in the channels must be minimized. Under no circumstances should rock, sand or other materials be dredged from the wetted stream channel under authorization of this permit, except in the immediate vicinity of the culverts. 7. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm water sheet flow. 8. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted when practical. If necessary, rip-rap should be limited to the stream bank below the high water mark, and vegetation should be used for stabilization above high water. 9. Rock silt screens at culvert outlets should be removed at project completion. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Dear Mrs. Frye: la+ d` SUBJECT: Caswell County, Replacement of Bridge 14 on NC 62 across Hughes Mill Creek DWQ Project # 01 0452 - Additional Information The following is being provided per your letter of April 27, 2001 requesting additional information. (1) Reasonable efforts have been made to practice avoidance and minimization of impacts to surface waters. Hughes Mill Creek is narrow enough at this location to facilitate use of a spanning structure such as a Con-span or Aluminum Box Culvert (ABC) with footings assuming that bedrock is present near the surface for footing placement. The Con-span was immediately rejected due to the inability to add extensions to this structure. Use of extendable structures is standard procedure for bridge replacements on rural arterials that may be widened within the life of the new structure. To facilitate both the minimization of surface water impacts and possible future extensions a new method was devised allowing for the addition of extensions to an ABC installed with proper modifications. Unfortunately, a sounding measurement made on May 11, 2001 indicated that bedrock at the project site is at least 10 feet below the surface. This project is being conducted to increase travel safety (see the attached accident reports for the three bridges in the project vicinity), not because of imminent bridge or roadway failure, and is therefore not eligible for Transportation Improvement Program Funds. Because driving piles is cost prohibitive for this project, a Con-span or ABC would require flooring for support; therefore, the a Reinforced Concrete Box Culvert (RCBC) will be used due to its increased life as compared to an ABC, the ability to extend this structure, and the availability of contractors familiar with the installation RCBCs. Impacts to aquatic resources will be minimized by burial of the RCBC to one-foot below streambed elevation, placement of a sill on one of the barrels to increase water depths during low flow, and implementation of NCDOT Best Management Practice guidelines for Bridge Demolition Removal and Protection of Surface Waters. The rip-rap energy dissipater is to be place above the ordinary high water mark. We recommend that an NCDOT architectural historian identify and evaluate all properties over fifty years of age and report the findings to us. There are no known archaeological sites within the proposed project area. Based on our present knowledge of the area, it is unlikely that any archaeological resources which may be eligible for inclusion in the National Register of Historic Places will be affected by the project construction. We, therefore, recommend that no archaeological investigation be conducted in connection with this project. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Permit Number 14 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.
