Box 47 Shelby, NC 28151-0047 Dear Ms. Simon: You have our approval, in accordance with the attached conditions and those listed below, to impact 17 linear feet of an unnamed tributary to Boween River for the purpose of upgrading SR 1134 (Randall Road) in Alexander County. The project should be constructed in accordance with your application dated 2 March 2001 (received 12 March 2001). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Randall Road is currently an 18-foot wide gravel road. Division of Highways plans to pave the road from NC Highway 18 to Station 19+80. It will be graded and paved to current standards and typical section to a width of 20 feet wide (32 feet shoulder point to shoulder point). The equipment to be used in these improvements will consist of bulldozers, backhoes, graders, paving machines, and rollers. The project will include areas of new alignment to avoid impacts to a jurisdictional channel that follows the right side of the road from Station 8+00 to the stream crossing at Station 14 + 50. Approximate acreage of project area is 2.73 acres. The project proposal is to replace a 40-foot 60 " CMP pipe at Station 14+50 with a 50- foot 60" CMP. A second pipe (43-foot long 60" CMP) located 2500 feet from the beginning of the road will also be replaced with a 50-foot long, 95" x 67" CMPA. The total linear footage of the two unnamed tributaries to Boween River (Class C waters) to be impacted is 17 feet. The streams are approximately 1-2 feet wide and are approximately 0.50- 1 inch deep. The pipes will be placed below existing streambed elevation and disturbed areas associated with the culvert replacement will be stabilized. By copy of this letter, we are also requesting a concurrence letter from the Wildlife Resources Commission, US Fish & Wildlife Service and the State Historic Preservation Office. By copy of this letter, I am forwarding seven (7) copies of the application package to John Dorney, NCDENR, Division of Water Quality, 401/Wetland Unit for review. A $200.00 check is enclosed for application processing. I have conducted a survey in the project area for the federally listed threatened species, the dwarf-flowered heartleaf (Hexastylis naniflora) on February 15, 2001. Logging of the area along the road had recently occurred prior to the site visit; however, this area did not appear to have been suitable habitat for the dwarf-flowered heartleaf. (A Division of Forest Resources forester was notified concerning the logging activity in the area). A review of the Natural Heritage sites for dwarf-flowered heartleaf occurrences in Cleveland County revealed two known sites approximately 1.5 to 2.0 miles northwest of the proposed project area. It was determined that neither the species nor suitable habitat was located in the proposed project area. No significant impact on this species is anticipated. SR 1134 ( Randall Road ) from its intersection with NC 18 to Sta. 19+80. It will be constructed to the attached typical section. No problem areas are anticipated. The work will be completed during the 00/01 construction season. PURPOSE The purpose of this Erosion and Sedimentation Control Program of the Division o Highways is to control accelerated- erosion and sedimentation resulting from the construction and maintenance of roads and highways in North Carolina. This program is developed pursuant to the requirements contained in the Rules and Regulations for Erosion and Sedimentation Controls which were adopted by the North Carolinas Sedimentation Control Commission on April 10.' 1574. CONSTRUCTION SEQUENCE 1. Grading to be started by state forces. Install all necessary silt fences, sediment basins, and check dams and begin clearing construction area. 2. Rough grade the construction area and begin installing any storm drainage and/or cross lines. Install inlet and outlet protection as storm drainage is being installed. 3. As an area is brought to finish grade and the black base is placed for the road, and the shoulder finished, then seed, mulch and tack should be provided for denuded areas. 4. Leave all erosion control devices in place until vegetation has been established sufficiently to withstand erosion. DO NOT remove any erosion control devices until directed by the County Engineer. MAINTENANCE PLAN 1. All erosion and sediment control practices will be checked for stability and operation following every runoff producing rainfall but in no case less than once every week. Any repairs will be made immediately to maintain all practices as designed. 2. Sediment will be removed from behind the sediment fence when it becomes about 0.5 feet deep at the fence. The sediment fence will be repaired as necessary to maintain a barrier. 3. All seeded areas will be fertilized, reseeded as necessary and mulched according to the instruction in the seeded specifications to maintain a vigorous, dense vegetative cover. 4. Outlet protection will be installed when outlets are installed. Filter fabric will be placed under the entire stone section and will be repaired and replaced if damaged during any phase of construction. 5. Sediment will be removed from the basin when it reaches 1.0 foot below the emergency spillway. The filter stone is to be cleaned or replaced when basin no longer drains properly. GROUND COVER FOR SLOPES. FILLS AND OTHER GRADED AREAS The angles for graded slopes and fills shall be no greater than the anal-. which can be retained by vegetative cover or other adequate erosion control devices or structures. Seeding should be done in accordance with the specifications for that season of the year. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall I121t be installed across streams, ditches, or waterways. AREAS OF USE: • At toe of fill sections where sediment runoff can be stored and contained inside the project limits. The silt basin is built at the base of the ditch with its length being at least 2 times the width of the basin. The type-B silt basin is generally built in conjunction with temporary rock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned-out on a regular basis until grass is established along the ditch line and sedimentation is no longer a problem. AREAS OF USE: • In conjunction with temporary rock silt checks and other devices used in drainage ditches. These type-B rock silt checks help reduce the flow velocity and are generally made of class-B stone. They are used in ditches during construction where the grade meets and/or exceeds 3%. Ares OF USE: • In channels, roadside ditch outlets, temporary silt ditches, and temporary diversions. • In conjunction with type-B silt basins. Type-B temporary rock sediment dams shall be used in drainage ditches to detain sediment-laden runoff and to trap sediment to protect receiving streams and adjacent property. The type-B temporary rock sediment dams utilize class-B stone lined with #5 or #57 stone in conjunction with a built in basin to trap sediment. They shall not be used in live streams. AREAS OF USE: • At outlets of temporary diversions, temporary silt ditches, channels, and temporary slope drains. • In locations where the dam can be cleaned and maintained on a regular basis. • In locations where runoff is exiting the construction site. • In small natural drainage turnouts.
