After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This Certification allows you to use Regional Nationwide Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification, If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Ed Downs Road is currently an 18-foot wide gravel road. Division of Highways plans to pave the road 20 feet. The improvements will consist of grading and paving on the existing alignment with areas of new alignment and will include the use of equipment such as bulldozers, backhoes, pans, graders, paving machines, and rollers to grade and pave the road to the current standard and typical section. The project begins at SR 1630 and proceeds 1.35 miles to SR 1632. The project consists of approximately 9.52 acres of right of way. The project proposal is to replace a 30-foot 30 "pipe at Station 31+90 with a 60-foot 60 " pipe which will be placed on a skew; thus eliminating 35 feet of an unnamed tributary to Bald Knob Creek. Additionally, at Station 45 +00, an existing 35' long x 12' wide tim er bridge on Bald Knob Creek is to be replaced with two lines of 128 " x 83 " CMPA, 60 feet long. A total of 125 linear feet of stream channel (Class "C" watlrs)_.will_ be im,_ed by the project. The pipes will be placed below existing streambed elevation and disturbed areas associated with the bridge and culvert replacement will be stabilized. Existing channel morphology will be maintained upstream and downstream of the pipes. Stream Crossing Narrative Ed Downs Road SR 1631 Cleveland County The improvements on unpaved road SR 1631, Ed Downs Road, will consist of grading and paving on the existing alignment with areas of new alignment. The existing roadway is 18 ft. and the proposed roadway is 20 ft. The work will consist of reshaping the existing typical section on the majority of the road. The work is to be completed on 9.52 acres of right of way. The following is a description of the work to be done at the stream crossings: Station 31 + 90 Remove existing 30 ft 30" CMP and replace with 60 ft of 60" CMP on a skew which will eliminate 35 ft of stream channel. This program is developed pursuant to the requirements contained in the Rules and Regulations for Erosion and Sedimentation Control which were adopted by the North Carolina Sedimentation Control Commission on April 10, 1974. P ?,? cc YffC? Ovy ,Lj A L SR 1631 (Ed Downs ROAD ) from its intersection with SR 1630 to SR 1632 . It will be constructed to the attached typical section. No problem areas are anticipated. The work will be completed during the 00/01 construction season. CONSTRUCTION SEQUENCE 1. Grading to be started by state forces: Install all necessarysilt fences, sediment basins, and check dams and begin clearing construction area 2. Rough grade the construction area and begin installing any storm drainage and/or cross lines. Install inlet and outlet protection as storm drainage is being installed.-, 3. As an area is brought to finish grade and the black base is placed for the road, and the shoulder finished, then seed, mulch and tack should be provided for denuded areas. 4. Leave all erosion control devices in place until vegetation has been established sufficiently to withstand erosion. DO NOT remove any erosion control devices until directed by the County Engineer. MAINTENANCE PLAN 1. All erosion and sediment control practices will be checked for stability and operation following every runoff producing rainfall but in no case less than once every week. Any repairs will be made immediately to maintain all practices as designed. 2. Sediment will be removed from behind the sediment fence when it becomes about 0.5 feet deep at the fence. The sediment fence will be repaired as necessary to maintain a barrier. 3. All seeded areas will be fertilized, reseeded as necessary and mulched according to the instruction in the seeded specifications to maintain a vigorous, dense vegetative cover. 4. Outlet protection will be installed when outlets are installed. Filter fabric will be placed under the entire stone section and will be repaired and replaced if damaged during any phase of construction. 5. Sediment will be removed from the basin when it reaches 1.0 foot below the emergency spillway. The filter stone is to be cleaned or replaced when basin no longer drains properly. GROUND COVER FOR SLOPES, FILLS AND OTHER GRADED AREAS The angles for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control devices or structures. Seeding should be done in accordance with the specifications for that season of the year. Additional erosion control measures may be required depending on the actual field conditions. The silt basin is built at the base of the ditch with its length being at least 2 times the width of the basin. The type-B silt basin is generally built in conjunction with temporary rock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned-out on a regular basis until grass is established along the ditch line and sedimentation is no longer a problem. AREAS OF USE: • In conjunction with temporary rock silt checks and other devices used in drainage ditches.. These type-B rock silt checks help reduce the flow velocity and are generally made of class-B stone. They are used in ditches during construction where the grade meets and/or exceeds 3%. AREAS OF USE: • In channels, roadside ditch outlets, temporary silt ditches, and temporary diversions. • In conjunction with type-B silt basins. DESIGN CRITCRIA: • Center of rock silt check shall be at least 1 foot lower than the outer edges (top of channel sides) • The spacing (ft.) _ (3 / % of ditch grade) X 100 ft.
