VARIANCE [15A NCAC 2B.0259(9)(b)]
Dear Mr. Gross,
On May 17, 2001, the Division of Water Quality (DWQ) received your proposed mitigation plan dated 5/17/01 as required
within your approved Minor Variance. After reviewing your proposed mitigation plan, it is the determination of this office that your
proposed plan including the attached vegetation plan initialed by me on 5/18/01 with the additional conditions stated within this letter
will satisfy conditions number 5 and 6 of your approved Minor Variance. You may begin construction of your approved project. In
addition to this certification, you should get any other required federal, state or local permits before you proceed with your project
including (but not limited to) Sediment and Erosion Control and CAMA permits.
This approval is only valid for the purpose and design that you described in your Minor Variance Request dated March 2, 2001.
If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the
new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be
valid, you must follow the conditions listed below as well as those indicated within the approved Minor Variance.
1. All approved planting must occur no later than December 1, 2001.
2. You are required to ensure the survival of all plantings as approved within your mitigation plan for a period of at least five
years from the date of planting. Any plantings that do not survive must be replaced during this period.
3. Only a one-time fertilizer application to establish planted vegetation is allowed. On-going fertilizer application within the
protected buffers is prohibited.
4. If any of these conditions or any others stated within the approved Minor Variance are not met, then current property owner
will be in violation of the State's or the delegated authority's riparian buffer protection program.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, PO Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection Rules
[15A NCAC 2B .0259(9)(b)]. Please call me at 919-733-9726 if you have any questions or require copies of our rules or procedural

APPROVAL of Tar-Pamlico River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC 2B.0259(9)(b)] with
ADDITIONAL CONDITIONS
Dear Mr. Gross,
You have our approval, in accordance with the conditions listed below, to impact ± 1,300 ft2 of Zone 2 of the protected riparian
buffers for the purpose of constructing the proposed visitor center on the subject property. This letter shall act as your Minor Variance
approval as described within 15A NCAC 2B .0259(9)(b) and your Authorization Certificate for the proposed walkway. In addition, you
should get any other required federal, state or local permits before you proceed with your project including but not limited to CAMA
Permits and Sediment and Erosion Control Permit.
This approval is only valid for the purpose and design that you described in your Minor Variance Request dated 3-2-01. If you
change your project, you must notify us and you may be required to send us a new request for approval. For this approval to be valid,
you must follow the conditions listed below.
1. No impacts shall occur to Zone 1 of the protected riparian buffers except those associated with the proposed walkway.
2. Additional woody vegetation (native shrubs and trees) shall be planted in retained areas of Zone 1 and Zone 2 of the
protected riparian buffer to the greatest extent practicable.
3. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identifies
within 15A NCAC 2B .0259(5). Drainage from the house shall be directed to vegetated areas prior to entering the
protected riparian buffers.
4. Any additional stormwater located on the remainder of the property shall be directed as diffuse flow at non-erosive
velocities prior to entering the protected riparian buffers. No new ditching or piping of stormwater through the
protected buffers is allowed.
5. A mitigation plan to compensate for impacts to the protected riparian buffer must be approved by this office prior to
- construction. The required amount of mitigation for the. Zone 2 impacts is 1,950 ft2 [1,300 ft2 x 1.5 (required ...
mitigation ratio)].
6. The mitigation plan can consist of restoring (replanting native woody vegetation at a density of at least 320 trees/shrub
per acre) on at least 1,950 ft2 of protected riparian areas located on the property.
7. If restoration or enhancement or donation of property per 15A NCAC 2B .0260 is not an option, another suitable
method to meet this mitigation requirement is to make'a payment into the Riparian Buffer Restoration Fund
administered by the NC Wetlands Restoration Program (WRP). In accordance with 15A NCAC 2B .0242(7), this
contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0260(10) and (7)(c). Until
the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program), buffer impacts
shall not occur. Mr. Ron Ferrell should be contacted at (919) 733-5208 concerning payment into the WRP. For
accounting purposes, this Certification authorizes payment into the Riparian Buffer Restoration Fund to
compensate for 1,950 ft2 of required riparian buffer mitigation for impacts to 1,300 ft2 (and 75 linear feet) of

Please find enclosed a Minor Variance Request form for a new Ferry Terminal/Visitor
Center at Pamlico River. I described this project to Deborah Sawyer on February 12,
2001 and she informed me that a Minor Variance Request would be required because of
the sidewalk and picnic areas around the project. This project has a let date of March 21,
2001 and a contract start date at or around the end of April. A Minor CAMA Permit has
previously been applied for on this project.
