Box 1587 Greenville, NC, 27835 APPROVAL of 401 Water Quality Certification Dear Mr. Johnson: You have our approval, in accordance with the attached conditions, to dredge and fill 0.10 acre of vegetated and non-vegetated wetlands in order to widen and pave SR 1727 and replace and enlarge two existing culverts in Beaufort County, as described in your application received by the Division of Water Quality on January 4, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be.valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: Applicant proposes to widen and pave existing gravel road and replace and enlarge two existing culverts. NCDOT SR 1727 Beaufort County Project Setting The applicant maintains a two lane gravel road (SR1727) adjacent to Wright Creek near Belhaven in Beaufort County, North Carolina. The existing road is approximately 18 feet wide and 0.6 miles long with shallow ditches on either side. The road forms a loop that runs parallel to the north fork of Wright Creek. Both ends of the existing road intersect SR 1726. The western side of the existing road is primarily a residential area with approximately 16 houses. The lots extend to the edge of Wright Creek and most are bulkheaded. There are three areas of coastal wetland located within the project area. Wetland Area #1 is east of the road, approximately 200 ft from the western intersection of SR 1727 and SR 1726. This area is vegetated with a mix of wetland species including Spartina patens, Spartina cynosuroides, Distichlis spicata, Baccharis halimifolia, scattered wax myrtles and broom sedge on the upland edge, and dense Phragmites australis. Wetland area #1 is connected to Wetland area #2 and Wright Creek by an existing 15" culvert pipe. During periods of high tide, water flows across the existing road. Wetland Area #2 runs parallel to the road, on the west side of the project area, and is across the road from Wetland Area # 1. Wetland #2 is bordered to its west by an old spoil berm. The berm is 4' to 18' wide and has breaks along its alignment. There is an extensive Juncus roemerianus marsh on the west side of the berm that extends from Wright Creek to SR 1726. Wetland #2 is vegetated with Spartina patens, Juncus roemerianus, Cladium jamaicense and Distichlis spicata, with a few Baccharis halimifolia on the edge of the berm. Wetland area #2 has a direct hydrologic connection to Wright Creek. Wetland Area #3 is the landward edge of a marsh finger that extends from Wright Creek and passes tinder the existing gravel road. The species here are mixed, with the shrubbier species closer to the road. This area is vegetated with Spartina patens, Juncus roemerianus, Distichlis spicata, Baccharis halimifolia, Iva frutescens and sporadic goldenrod. There is an existing 15" culvert pipe that allows water to pass from Wetland area #3 under the road and into a connected wetland. Wright Creek classified SA HQW NSW by the Environmental Management Commission and are not open to shell fishing at this location. Project Description The applicant proposes to widen and pave the existing road and replace and enlarge two existing concrete culvert pipes. The existing 18' by 26,123' (0.6 mi) gravel road will be widened to 20' and paved. The 18' by 15" culvert connecting Wetland Area #1 to Wetland area #2 will be replaced with a 24' by 18" culvert. The 18' by 15" culvert passing from Wetland area 43, under the road will be replaced with a 24' by 18" culvert. Anticipated Impacts The project as proposed would directly impact 56,746 W. Of the total area impacted, 4,242 ft2 is coastal wetland, 138 ft2 is unvegetated creek bottom, and 52,366 ft2 is upland. Indirect impacts include the reduction of waterflow to the wetlands located north of the existing gravel road. Under current conditions, water flows across the road during high tides. This hydrologic exchange will be limited to the proposed culverts after the road is improved. Localized short term turbidity increases will result from construction activities during culvert replacement. Tracey L. Avoidance and minimization and road re-alignment was initiated so that only 4122 Sq. Ft. of Coastal and 404 wetlands will be impacted by the widening of SR 1727. An existing ditch will have the culverts replaced. Existing side ditches that flow through the wetlands will be back filled to make storm water sheet flow into the wetlands instead of being discharged directly into the wetlands. Upland side ditches will be designed to catch stormwater and sheet flow it over vegetated uplands before entering wetlands. Please let me know if there is additional information required.
