Box 250 North Wilkesboro, NC 28659 Dear Mr. Slaughter: You have our approval, in accordance with the attached conditions and those listed below, to impact 145 linear feet of Stag Creek in order to replace Bridge No. 320 on SR 1342 in Ashe County. The project must be constructed in accordance with your application dated 3 December 2001 (received 5 December 2001). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you must acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ in writing and submit a new application. If the property is sold. the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the brook and brown trout spawning season of October 15 through April 15, or as otherwise determined by the North Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from sedimentation during construction. 2. Stormwater must be directed to buffer areas or retention basins and must not be routed directly into streams. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm water sheet flow. 3. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [ 15A NCAC 4B .0024]. 4. Temporary or permanent herbaceous vegetation must be planted on all bare soil within 10 days of ground-disturbing activities to provide long term erosion control. NCDOT is encouraged to use existing bn-site vegetation and materials for streambank stabilization. 5. The RCBC shall be designed and constructed so that it can be installed one foot below streambed grade to enable waters to flow without freefalling or damming on either end during low flow conditions and ensure passage of all aquatic life. Three barrels will be installed; only one barrel should be placed so as to receive base flow. NCDOT is encouraged to implement natural stream structures such as cross veins and W weirs to direct flow to the barrel. The other two barrels should be elevated or silled to receive only storm flows. The dimension, pattern, and profile of the stream and floodplain above and below the base flow barrel shall not be modified by widening the stream channel or reducing the depth of the stream. Disturbed streams and floodplains should be restored to natural geomorphic conditions. 7. The base flow barrel (westernmost barrel) should be baffled with 4-5 (approx. 8" high) alternating baffles (approx. 11" long), in a manner that mimics existing stream conditions. The baffles shall be placed in a manner that maintains stream pattern and that smoothly reconnects to the existing stream. 8. The height of the upstream and downstream storm water barrel sills (4) should be determined by the Division Environmental Officer after flow is turned into the base flow barrel. The height of the storm water sills should only be as high as necessary to maintain existing stream and floodplain conditions. 9. All work shall be performed during low flow conditions. 10. Disturbance of the stream channel must be limited to only what is necessary to perform the culvert installation. Heavy equipment must be operated from the banks rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the §401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The proposed new structure is a triple barreled @ 16' x 8' reinforced concrete box culvert (RCBC) 105' long. The entire culvert will be buried 1' below the existing streambed grade. The two stormwater barrels with have 2' high sills (1' buried) thus directing all base flow into the third barrel. Please note that sill height may be modified as per WRC recommendations. Baffles will be installed as per WRC recommendations. All excavated natural streambed material will be placed into the stormwater barrels as directed by WRC. Miscellaneous rip-rap impacts will total 401inear feet or less. New stream impacts = 145 In. feet. This culvert will be constructed approximately 200 feet downstream of the existing bridge in order to eliminate a sharp curve in the roadway. This will also eliminate the need to construct a temporary detour. The 105' length of the culvert is needed to accommodate the amount of fill that is required to complete the roadway. Construction of this project will necessitate impacts to waters of the United States in the New River Basin. Bridge #320 crosses Stagg Creek (Class: C, Trout +). The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on November 29, 2001. The subject project has been determined to have no effect on any listed threatened or endangered plant or animal species. Historic compliance work will be scheduled and concurrence with the State Historic Preservation Office will be obtained if required. P. O. Box 250, N. Impervious dike "A" will be installed followed by the construction of culvert barrel #1. Once barrel #1 is complete, impervious dike "A" will be removed. The stream will then be routed into barrel #1 by constructing impervious dike "B". Barrels #2 and #3 (stormwater barrels) will then be constructed. Once barrels #2 and #3 are complete, impervious dike "B" will be removed and the roadway will be completed (see attached erosion control plan for a diagram). Any dirty water located inside the construction area will be pumped into a silt bag. The dewatered area will total approximately 750 square feet or 0.017 acres. Acceptable impervious dike materials shall include sheet piles, sandbags and/or the placement of an appropriate sized stone lined with polypropylene or other impervious fabric. The modifications proposed in this application should not remove or degrade existing water quality uses. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control measures, a marked county map, a marked topography map and photographs. By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with the North Carolina Wildlife Resources Commission comment directly to you concerning the 404 Nationwide Permit application with a copy sent to me. A trout buffer zone encroachment variance will be requested for this project. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The existing bridge must be replaced for safety reasons The proposed RCBC will be buried F below existing streambed grade and base flow will be directed into one barrel to mimic existing stream dimensions pattern and-profile. Forty linear feet or less of rip-rap will be needed to stabilize the slopes in the immediate vicinity of the new crossing. The existing bridge is being replaced with a RCBC as a cost saving measure Page 7 of 12 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Page 8 of 12 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Applicants will be notified early in the review process by the 401 /Wetlands Unit if payment into the NCWRP is available as an option. The NCDOT proposes to replace an existing bridge with a triple-barreled culvert with barrel dimensions of 16' wide x 8' high reinforced concrete box culvert (RCBC). The culvert will be on a new road alignment. Removal of the existing bridge should not be allowed to impact waters. While our preference would be to replace the bridge with another spanning structure, we will not object to the use of a reinforced box culvert provided the following conditions are fully implemented: 1. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the brown and brook trout spawning season of October 15 through April 15 to protect the egg and fry stages of trout from off-site sedimentation during construction. 2. The RCBC should be designed and constructed large enough so that it can be installed one foot below streambed grade so that all waters can flow through without freefalling or damming on either end during low flow conditions to maintain aquatic life and fish passage. As three barrels will be installed, only one barrel should be placed so as to receive base flow. The other barrels should be elevated or silled to receive only storm flows. The dimension, pattern, and profile of the stream and floodplain above and below the base flow barrel should not be modified by widening the stream channel or Bridge 320, SR 1342, Stagg Creek Page 2 December 7, 2001 reducing the depth of the stream. Disturbed streams and floodplains should be restored to natural geomorphic conditions. 3. The base flow barrel (westernmost barrel) should be baffled with 4 to 5 (approximately 8" high) alternating baffles (approximately 11' long) in a manner that mimics existing stream conditions. The baffles should be placed in a manner that maintains stream pattern and triat)mogthl?te'jonnects to the existing stream. 4. The height of the upstream and downstream stormwater barrel sills (4) should be determined by the Division Environmental Officer after flow is turned into the base flow barrel. The height of the stormwater sills should only be as high as necessary to maintain existing stream and floodplain conditions. 5. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 6. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 7. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds (15A NCAC 4B .0024). 8. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 5 days of ground disturbing activities to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization. 9. The length of the barrels should be minimized to the extent possible and practicable. 10. The old bridge site should be restored using bioengineering design techniques and native plant species. Again, we encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization. The proposed new structure is a triple barreled @ 16' x 8' reinforced concrete box culvert (RCBC) 105' long. The entire culvert will be buried 1' below the existing streambed grade. The two stormwater barrels with have 2' high sills (1' buried) thus directing all base flow into the third barrel. Please note that sill height may be modified as per WRC recommendations. Baffles will be installed as per WRC recommendations. All excavated natural streambed material will be placed into the stormwater barrels as directed by WRC. Miscellaneous rip-rap impacts will total 40 linear feet or less. New stream impacts = 145 In. feet. This culvert will be constructed approximately 200 feet downstream of the existing bridge in order to eliminate a sharp curve in the roadway. This will also eliminate the need to construct a temporary detour. The 105' length of the culvert is needed to accommodate the amount of fill that is required to complete the roadway. Construction of this project will necessitate impacts to waters of the United States in the New River Basin. Bridge #320 crosses Stagg Creek (Class: C, Trout +), The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on November 29, 2001. The subject project has been determined to have no effect on any listed threatened or endangered plant or animal species. Impervious dike "A" will be installed followed by the construction of culvert barrel #1. Once barrel #I is complete, impervious dike "A" will be removed. The stream will then be routed into barrel #1 by constructing impervious dike "B". Barrels #2 and #3 (stormwater barrels) will then be constructed. Once barrels #2 and #3 are complete, impervious dike "B" will be removed and the roadway will be completed (see attached erosion control plan for a diagram). Any dirty water located inside the construction area will be pumped into a silt bag. The dewatered area will total approximately 750 square feet or 0.017 acres. Acceptable impervious dike materials shall include sheet piles, sandbags and/or the placement of an appropriate sized stone lined with polypropylene or other impervious fabric. The modifications proposed in this application should not remove or degrade existing water quality uses. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
