The activity must be conducted as indicated in your application dated October 9, 2001. This approval is only for the impacts listed above and for the activities that you described in your application received by the Division of Water Quality on October 16, 2001. We have determined that General Water Quality Certifications Number 3289 covers this fill activity. These Certifications allow you to use Nationwide Permit Number 14 when issued by the US Army Corps of Engineers. Please keep in mind that there may be additional Federal, State and Local regulations applicable to your project, such as the Sedimentation and Pollution Control Act, Non-Discharge and Water Supply Watershed Regulations, whereby you may be required to obtain permits and/or approvals prior to beginning your project. In addition, this approval will expire when the accompanying 404 Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purposes and designs that you described in your application. If you change your project, you must notify the Division in writing and you may be required to submit a new application for a new Certification. If the property is sold, the new owner must be given a copy of the Certifications and approval letter and is thereby responsible for complying with all conditions. 01 1504 Page 2 If total wetland or individual stream fill for this project (now or in the future) exceeds one acre or 150 linear feet respectively, compensatory mitigation may be required as described in 15A NCAC 2H.0506(h). For this approval to be valid, you must follow the conditions listed in the attached Certification and the additional condition listed below: Instream work and land disturbance within the 25-foot riparian buffer zone are prohibited during the smallmouth bass spawning season of May I through June 30, or as determined by the North Carolina Wildlife Resources Commission. 2. As-built plans and the attached Certificate of Completion (COC) must be submitted to the Division's 401/Wetlands Unit upon final construction of the road crossings. If you do not accept any of the conditions of these Certifications, you may ask for an adjudicatory hearing. You must act within 60 days from the date of receipt of this letter. To request a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. These Certifications and their conditions are final and binding unless you request a hearing. This letter completes the review of DWQ Project #01 1504 by the Division of Water Quality under Section 401 of the Clean Water Act. WATEUb1LIP(SFfTIgr. The NC Department of Transportation is scheduled to grade, drain, base, and pave primarily along the existing roadway of SR 1513 (North Fork New River Road) in Ashe County. Total project length is approximately 1.8 miles. This project will require the replacement of six (6) wet cross lines as shown below: 1) Replace existing 26' x 24" CMP at station 13+02 with a 45' x 24" CMP. 2) Replace existing 40' x 72" CMP at station 30+86 with a 70' x 72" CMP. 3) Replace existing 40' x 60"x 48" CMP at station 41+12 with a 110' x 66"x 51" CMP. 4) Replace existing 33' x 48"x 36" CMP at station 44+41 with a 50' x 48"x 36" CMP. 5) Replace existing 31' x 36" CMP at station 52+47 with a 75' x 48" CMP. 6) Replace existing 23' x 30" CMP at station 65+71 with a 50' x 36" CMP. Miscellaneous rip-rap impacts will total 100 linear feet or less. New stream impacts = 307 In. feet. "Several of the above noted wet cross lines are longer than the typical replacement pipes. This is due to the fact that several of the stream crossings intersect the roadway at severe angles (see attached pipe data sheets in the rear section of this application). I have reviewed the proposed replacement pipe lengths with the County Maintenance Engineer. The proposed replacement pipe at 52+47 was reduced in length from 100' to 75'. The crossings at station numbers 30+86 and 41+12 carry the same perennial unnamed tributary to the North Fork of the New River. All of the remaining wet cross lines carry different intermittent unnamed tributaries to the North Fork of the New River (Class: C +). The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on October 4, 2001. The subject project has been determined to have no effect on any listed threatened or endangered plant or animal species. Historic Compliance work will be scheduled and concurrence with the State Historic Preservation Office will be obtained if required. Since this is an existing roadway, the modifications proposed in this application should not remove or degrade existing water quality uses. Any widening of the existing roadway will be directed away from any adjacent creek whenever possible with minimum fill placed in any buffer area. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control measures, a marked county map, a marked topography map and photographs. By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with the North Carolina Wildlife Resources Commission comment directly to you concerning the 404 Nationwide Permit application with a copy sent to me. When drafting comments to the COE, it is requested that WRC note that the replacement pipe at station 30+86 will Rely not be buried due to bedrock restrictions. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The existing roadway must be widened to achieve an acceptable section width, thus increasing public safety. The existing pipes must be replaced for the same reason. By utilizing the erosion control measures as shown in the attached drawings adverse impacts to streams in the area will be minimized Since this is an existing roadway, the stream impacts cannot be avoided However, the replacement pipe lengths will be the minimum needed to construct the widened roadway. Page 7 of 12 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stnngide.htmi. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction.
