Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact
135 linear feet of an unnamed tributary to Cow Camp Creek in order to improve SR 1158 (Cole
Hollow Road) in Avery County. The project must be constructed in accordance with your application
dated 4 September 2001 (received 24 September 2001). After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification No. 3289, corresponding to the
U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you must acquire any
other federal, state or local permits before you proceed with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This
approval will expire with the accompanying 404 permit unless otherwise specified in .the Water
Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification.
Upon completion of the project, the NCDOT shall complete and return the enclosed
"Certificate of Completion" form to notify NCDWQ when all work included in the §401
Certification has been completed. The responsible party shall complete the attached form
and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon
completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.

SUBJECT: North Carolina Department of Transportation (NCDOT), SR 1158, Old Cow
Camp Road, Unnamed Tributary to Cow Camp Creek, Avery County
The North Carolina Department of Transportation (NCDOT) is requesting a concurrence
letter from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit
from the U.S. Army Corps of Engineers. Biologists on staff with the NCWRC have reviewed
the proposed improvements and are familiar with habitat values of the project area. These
comments are provided in accordance with the provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the Clean Water Act of 1977 (33 U.S.C.
466 et seq.).
NCDOT is currently making improvements on SR 1158 under a Nationwide Permit #3.
A site inspection revealed a waste area adjacent to station number 43 + 20, Mrs. Betty Cole's
yard, that will require the additional placement of 135 linear feet of pipe on an unnamed tributary
to Cow Camp Creek. We have no objection to the work proposed, however, we are concerned
that this waste site was not previously identified in the review process. Waste areas should be
identified and located in the original permit and included in the calculation of cumulative
impacts for a project.

The NC Department of Transportation submitted a Nationwide Permit #3 application to the office
of Mr. Steve Lund on November 28, 2000, for authorization to grade, drain, base and pave SR
1158, Cole Hollow Road in Avery County. Mr. Lund issued the Nationwide Permit #3 on
January 25, 2001 (Action ID # 200130248, copy attached). No water quality certification was
required at the time of the initial application.
The previously authorized grade, drain, base, and pave activity on SR 1158 is underway. As you
are aware, most of the grade and drainage work is now complete. A recent site inspection
revealed an active waste pit on the property of Mrs. Betty Cole. Mrs. Cole's property is located
at 828 Cole Hollow Road and is immediately adjacent to station number 43+20 on Cole Hollow
Road.
An unnamed tributary to Cow Camp Creek (class: C) runs through Mrs. Cole's yard. Although a
large volume of waste has already been placed into the yard, no fill has been placed into the above
noted creek. Since this material has already been deposited, we are proposing to place 135 linear
feet of pipe into the above noted UT and backfill over the new pipe.
Please note that Mrs. Cole and the grading contractor, Riverview Construction Co., came to a
mutual agreement to place waste material from the adjacent DOT project into Mrs. Cole's yard.
This agreement was made after the initial permit application was submitted. Mrs. Cole and
Riverview Construction were not aware that a permit would be needed for this activity. In

addition, the DOT District Office in Boone was not aware of this agreement until recently. As a
result, authorization to place waste at this location was not requested in the initial application
dated November 28, 2000.
The Division 11 Environmental Officer reviewed this project for the presence of threatened and
endangered species on August 27, 2001. The subject project has been determined to have no
effect on any listed threatened or endangered plant or animal species.
The NCDOT Historical Architecture Section has reviewed this project and determined that there
are no NR/SL/DOE projects along this roadway that will be impacted by the proposed project. A
concurrence form from the State Historic Preservation Office has been signed as well.
Attached is a Preconstruction Notification Form, a copy of the initial permit application dated
11/28/00, a sketch of the waste site area, a marked county map, a marked topography map and
photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me.
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia
Van Der Wiele, NCDENR, Division of Water Quality, 401/Wetland Unit, for her review. A
$200.00 check is enclosed for the 401 certification processing fee. It is requested that any
comments related to the 401 certification be forwarded directly to the Corps with a copy sent to
me.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this

The application date was 11/28/00. No DWO_permit was needed at the time of the original
application.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Mrs. Cole contacted the Grading Contractor workine on the navinn nroiect that is currentl
underway in front of her house. She and the contractor agreed on establishing a waste site in her
yard to flatten out her land. At the time that I viewed this site, waste had already been deposited
in Mrs. Cole's yard. However, the creek running through hrough the yard has not been filled. Impacts
will be minimized by installing no more than 135 linear feet of pipe through the yard even
though approximately 180 linear feet is needed to completely fill all low areas.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.ne.us/ncwetlands/stnngide.htmi.

Dear Mr. Lund:
The NC Department of Transportation is scheduled to grade, drain, base, and pave
SR 1158, Old Cow Camp Rd., in Avery County when the necessary permits are obtained. This
project will require replacing four (4) cross-line pipes and construct one brick Drop Inlet, which
carry unnamed tributaries to Cow Camp Creek. Also, this project will require an encroachment
in the creek buffer zone. Cow Camp Creek DEM classification, C,Tr.. Due to the proposed
work, we are requesting a 404 Nationwide Permit 3.
1 am sending a Pre-Construction Notification Application, typical roadway section, straight-
line sketch with the proposed erosion control, notes on pipe installation, general notes on
erosion control, cross sections of proposed encroachments in the creek buffer zone, and a
marked county map.
By copy of this letter, I am requesting Mr. Ron Linville, Western Piedmont Region
Coordinator to comment directly to you concerning the 404 Nationwide Permit request. Since
a request will be made for a temporary encroachment in the creek buffer zone, I am also
requesting Mr. Linville to comment directly to me concerning the encroachment.
