APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact 47
linear feet of unnamed tributaries to Mill Creek and Roaring Branch in order to improve SR 1340 (West
Mill Creek Road) in Ashe County. The project should be constructed in accordance with your application
dated 14 March 2001 (and additional information received 30 May 2001). After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification No. 3289,
corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you
should acquire any other federal, state or local permits before you proceed with your project including
(but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in
the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
trout spawning season of October 15 through April 15, or as otherwise determined by the North
Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from
sedimentation during construction.
2. Storm water should be directed to buffer areas or retention basins and should not be routed directly
into streams.
3. The culverts required for this project shall be installed in such a manner that the original stream
profile is not altered (i.e. the depth of the channel should not be reduced by a widening of the
streambed). Existing stream dimensions are to be maintained above and below locations of culvert
extensions.
4. All work shall be performed during low flow conditions.
5. All mechanized equipment operated near surface waters should be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.

6. The presence of equipment in the channels must be minimized. Under no circumstances should rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culverts.
7. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm
water sheet flow.
8. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted
when practical. If necessary, rip-rap should be limited to the stream bank below the high water mark,
and vegetation should be used for stabilization above high water.
9. Rock silt screens at culvert outlets should be removed at project completion.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mrs. Van Der Wiele:
The NC Department of Transportation is scheduled to grade, drain, base, and pave primarily
along the existing roadway of SR 1340 (West Mill Creek Road) in Ashe County. This project
will require replacing three (3) wet cross lines as shown below:
1) Replace existing 501x 18" CMP at station 0+67 with a 501x 24" CMP.
This pipe carries an unnamed tributary to Mill Creek (Class: C, Trout +). Since the
new pipe length does not exceed the existing pipe length, there are no new stream
impacts to report.
2) Replace existing 40'x 24" CMP at station 32+15 with a 60'x 36" CMP.
This pipe carries an unnamed tributary to Roaring Branch (Class: C+). The new pipe
impacts at this location will be 20 linear feet.
3) Replace existing 33'x 18" CMP at station 34+11 with a 45'x 36" CMP.
This pipe carries the same unnamed tributary to Roaring Branch (Class: C+) as noted
above. The new pipe impacts at this location will be 12 linear feet.
We will probably not have any rip-rap impacts, be we request authorization to place 15 linear
feet or less (approximately 5 feet per pipe for stabilization if necessary).
Total stream impacts for the project = 47 linear feet.

The NC Department of Transportation is scheduled to grade, drain, base, and pave primarily
along the existing roadway of SR 1340 (West Mill Creek Road) in Ashe County. We are
proposing to replace three (3) wet pipes that cross the existing roadway. The stream crossing at
station 0+67 carries an unnamed tributary to Mill Creek (Class: C, Trout +). The stream
crossings at stations 32+15 and 34+11 carry unnamed tributaries to Roaring Branch (CC + .
Any widening of the existing roadway will be directed away from any adjacent creek whenever
possible with minimum fill placed in the buffer area. The total project length is approximately
0.65 miles. Due to the proposed work, we are requesting a 404 Nationwide Permit #14.
Attached is a Preconstruction Notification Form, plan sheet with proposed erosion control
measures, pipe crossing information, a marked county map and a marked topography map and
photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me.
A request will be made on this project for a tem ncroachment into the trout water buffer
zone of NO Creek (Class: C, Trout +) from station 1+00 to 2+ Is requested that Mr. Ron
Linville comment directly to me concerning the trout water buffer zone encroachment.

RIP RAP MATERIALS
1042-1 PLAIN IZII' RAP.
Slone for plain rite rap shall consist of fieldstone or rough untie ;:,n quarry
s!one. The stone shall be sound, tou?,h, dense, resistant to the action of air
and water, and suitable in all other respects for the purpose intended.
Miere broken concrete from demolished structures or pavement is avail-
-Ible, it may be used in place of stone provided that such use meets with the
approval of the Engineer..Ilowever, the use of bi-oken concrete which
contains reinforcing steel will not be permitted.
The stone or broken concrete shall be graded to meet the following
requirements:
1. Foi- Class I Rip Rap. Stone small vary in weight from 5 to 200 pounds.,
At least 30 percent of the total weight of tlhe r1. rap shall be in
individual pieces weicr hin( a i-ninlnium of 60 pounds each. Not more
than 10 percent of the total weight of the rip rats nhay be in individual
uleces v.'eic hing less than Io pounds each.
2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250
oounds. At least GO peI-cent of the Total weight o the r1D rap shall be in
individual pieces weigh ing a riniiiimum of 100 pounQ's each. Not more
than 5 percent of the total weight.: of the rip raid nhav be in individual
pieces weing le s than 50 pounds each.

1. Uncovered areas are limited at any`c ea., dine to a maximum total area
of 20 acres. .
2. Erosion and sedimentation control measures shall be designed to provide
protection fronn the 25 year storm.
3. Lame Type-A basins shall be designed and constructed with a sett ing
eficiency of at least 7051o for the ='.0 nicron soil pardcle size transuorted
by runoff ilon tlhe 2 year storm.
4. Newly constructed channels shall be cons ructed with side slopes no
steezer than 2:1, unless slopes are to be stabilized by methods other than
vegetation.
5. A -round cover sumcient to res"T.ain erosion must be provided for any

Dear Mr. Alsmeyer:
The NC Department of Transportation is scheduled to grade, drain, base, and pave primarily
along the existing roadway of SR 1340 (West Mill Creek Road) in Ashe County. We are
proposing to replace three (3) wet pipes that cross the existing roadway. The stream crossing at
station 0+67 carries an unnamed tributary to NO Creek (Class: C, Trout +). The stream
crossings at stations 32+15 and 34+11 carry unnamed tributaries to Roaring Branch (Class C +).
Any widening of the existing roadway will be directed away from any adjacent creek whenever
possible with minimum fill placed in the buffer area. The total project length is approximately
0.65 miles. Due to the proposed work, we are requesting a 404 Nationwide Permit 414.
Attached is a Preconstruction Notification Form, plan sheet with proposed erosion control
measures, pipe crossing information, a marked county map and a marked topography map and
photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me. _

RIP RAP MATERIALS
1042-1 PLAIN RIP IZAP.
Slone foi• plain rip 1•11u shall consist of field stone oI• rough unhev„,n quarry
stone. The stone shall be sound, tougll, clense, resistant to the action of air
and water, and suitable in all other respects for the purpose intended.
Where broken concrete from denlolishecl structures or pavement is avail-
able, it may be used in place of stone provided that such use meets with the
approval of the Engineer, However, the use of broken concrete which
contains reinforcing steel will not be permitted.
The stone or broken concrete shall be graded to meet the following
requirements:
L For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds:
At least 30 percent of the total weight or file rip rap shall be in
individual pieces weighing a ITiini ium of 60 t)UllndS each. IN Ot I7]O1'e
than 10 percent, of the total weight of the rip rap may be in IndIVlclual
