It is issued to NC Department of Transportation resulting in 1.4 acres lake dredging stream impact in Wake County pursuant to an application filed on the 8' day of November, 2000 to dredge a portion of Crossgate Lake and dispose of on an uplands site. The application provides adequate assurance that the discharge of fill material into the waters of Honeycutt Creek in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. If you change your project, you must notify us and send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre or total perennial stream impact exceeds 150 feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: 1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of two manuals, either the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices). The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. Should waste or borrow sites be located in wetlands or other waters, compensatory mitigation will be required since it is a direct impact from road construction activities; 5. All temporarily disturbed areas within 50 feet of the shore of Crossgate Lake and its tributaries shall replanted with woody vegetation. DWQ shall be copied with a planting plan one month of the date of the 404 Permit. Written DWQ approval of this plan is required before dredging occurs. 4 3 Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. We read it with great personal interest. From our home in Sutton Estates we have had a view of this lake for 13 years - long before there was a Crossgate sub-division. Significantly, noting that the NC Division of Water Quality must act BEFORE the U.S Army Corps of Engineers can give an approval, I called a Mr. Jon Dorney, identified in the Public Notice as with the NC Division of Water Quality, requesting completion information of his/their role in the project. Mr. Alsmeyer, I was concerned and dismayed when Mr. Dorney stated that he was unaware of the Public Notice. Further, his efforts to find the Action ID on his computer terminal were unsuccessful. After reading to Mr. Dorney portions of the Public Notice and noting that his name was listed, he asked me to forward a copy. Since we were ready to leave for the Thanksgiving holiday, I took the liberty of promptly calling your office and requesting that Dorothy Harrington forward a copy. Our interest is in completing this project concurrent with the new Outer Loop, presently anticipated in our area by the end of December,2000. As we understand it, the DOT highway contractor would still have the necessary equipment in place for the lake project. Meanwhile, we note that the sketch indicating the "approximate" limit of excavation at Crossgate Lake is somewhat less than where the silt has piled thus adding substantially to the lake bottom at the southern end. Prior to the building of the Crossgate sub-division, my wife and I spent many hours rowing about and picnicking on the lake. We also observed the lake when it was emptied to build the new dam, thus we have had many visual and on-site depth observations. Since our property does not border the lake, we have no decisional portion. This tributary outfalls into Crossgate Lake immediately north of the project at this station. Heavy rains associated with Hurricane Floyd inundated the site on September 14-16, 1999. As a result, excessive sediment runoff left the construction site and was deposited in Crossgate Lake. NCDOT Geotechnical Unit has determined the extent and amount of sediment in Crossgate Lake that was attributed to runoff from construction activity. Crossgate Lake has recently been drawn down to facilitate the excavation of this sediment. The NCDOT will excavate a total of 123,601 cubic feet of sediment from an area covering 1.4 acres. An Individual Permit Modification for this activity was applied for on November 1, 2000 and was subsequently placed on a 15-day public notice by the USACE. As you are aware, there are several timely issues of importance associated with this project and permit application. These include the lake which has been drawn down and the potential delay due to wet weather. Additionally, there is an undeveloped lot that is available for the NCDOT to utilize to gain access to Crossgate Lake. This lot may quickly become unavailable for the NCDOT to use if this excavation activity is not conducted in a timely manner. Please find attached the USACE Public Notice. No. R-2000CB,D). This project is located within the Crossgate Subdivision, north of Raleigh, in Wake County, North Carolina. The permit was subsequently modified on September 15, 1997 and September 29, 1999, to authorize minor additional temporary impacts, and to authorize the proposed compensatory mitigation at the Dutchmans Creek mitigation site. The authorized impacts for Sections CB and D total 13.67 acres of waters of the United States, including 9.87 acres of wetlands and 3,800 linear feet of stream. During construction of the Northern Wake Expressway upstream of Crossgate Lake, heavy rains associated with Hurricane Floyd inundated the site on September 14-16, 1999. As a result, r 1 2 excessive sediment was washed off the construction site, and was deposited in Crossgate Lake. Based on studies of the sedimentation in Crossgate Lake from late 1996, and June and July, 2000, it has been determined that approximately 124,000 cubic feet of sediment has been deposited in the lake as a result of the Northern Wake Expressway construction. NCDOT has entered into an agreement with Community Properties, Inc., the developers of Crossgate Subdivision, to excavate 123,601 cubic feet of sediment, covering 1.4 acres of unvegetated bottom of Crossgate Lake, as described below. The following description of the work is taken from data provided by the applicant and from observations made during onsite visits by a representative of the U.S. Army Corps of Engineers. Crossgate Lake has been partially drawn down to facilitate the proposed excavation. NCDOT proposes to construct a temporary access road, sixteen feet wide, on the upland, on-the east side of the lake adjacent to the excavation area. A swamp dozer will enter the drained portion of the lake, and push the 123,601 cubic feet of sediment to the edge of the lake near the access road. A track hoe will then excavate the sediment and place it directly into dump trucks. The dump trucks will take the material to a nearby upland site within a powerline right-of-way. The disposed material will be contained or stabilized on the upland site to ensure that no sedimentation enters waters of the United States from the disposal site. The temporary access road will be removed and revegetated within six months. A plan showing the proposed work site is included with this public notice. NCDOT is not proposing any compensatory mitigation for this work. The purpose of the work is to restore the lake bottom contours to conditions existing prior to sedimentation impacts from construction of Section D of the Northern Wake Expressway. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit modification will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit modification be issued until the North Carolina Division of Water Quality has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state,'with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being V eligible for inclusion therein, and the project does not impact any registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer. The District Engineer is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistoric, or historical data may be lost or destroyed by work under the requested permit modification. The District Engineer is not aware, based on available information, that the activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit modification will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the'discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit modification will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State, and local agencies and officials; Indian Tribes, and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition, or deny a permit modification for this proposal. Comments are used in preparation of an Environmental Assessment and/or Environmental Impact Statement pursuant to the National Environmental Policy Act. Generally, the decision whether to issue this DA permit modification will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit modification serves as application to the NCDWQ for certification. The Section 401 Water Quality Certification was issued by the N.C. Division of Water Quality (NCDWQ Project 960319) on September 27, 1996. This section of the Northern Wake Expressway project was let on July 15, 1997. In compliance with Special Condition "d", we hereby request that the USACE Section 404 Permit and DWQ Section 401 Water Quality Certification be modified to reflect the excavation of 123,601 cubic feet of sediment from an area covering 1.4 acres of Crossgate Lake. This packet contains this cover letter, vicinity map, and site map. An unnamed tributary to Honeycutt Creek (DWQ Index No. 27-20-(1)) is crossed by the project at Station 258+40-L-. This tributary outfalls into Crossgate Lake immediately north of the project at this station (Sheet 1). Heavy rains associated with Hurricane Floyd inundated the site on September 14-16, 1999. As a result, excessive sediment runoff left the construction site and was deposited in Crossgate Lake. A background siltation study was performed by NCDOT Geotechnical Unit in Crossgate Lake in late 1996. The purpose of this study was to determine a baseline of current sediment in Crossgate Lake. A final siltation study was conducted by NCDOT Geotechnical Unit in June and July 2000. The purpose of this study was to quantify the amount of sedimentation in Crossgate Lake that could be attributed to the construction of the Northern Wake Expressway. The results of this study indicate that the silt attributed from construction of the highway was thickest near the mouth of the Crossgate Lake and along the edges of the old channel of the unnamed tributary to Honeycutt Creek that flows within Crossgate Lake. All of the recent sediments were red in color while the pre- construction sediments were gray. The NCDOT has entered into an agreement with Community Properties, Inc. (the developers of Crossgate Subdivision) to obtain access to Crossgate Lake and excavate sediment that has been attributed to construction of the Northern Wake Expressway. Crossgate Lake has been recently drawn down to facilitate this activity. As stated above, a total of approximately 123,601 cubic feet of sediment will be excavated from an area covering 1.4 acres (Sheet 2). The construction sequence for this activity is addressed below: • A temporary road approximately 16 feet wide will be constructed in the subdivision to the landward limit of the normal water level of Crossgate Lake. • A swamp dozer will enter Crossgate Lake and push the sediment near the edge of the lake. • A track hoe stationed on the upland near the edge of Crossgate Lake will scoop the sediment into a truck. The truck will remove the sediment from the site. • The temporary road will be removed and revegetated within six months. Due to time constraints associated with the project, the NCDOT is requesting a shortened public notice period. In compliance with Section 143-215.3D(e) of the NCAA we have enclosed a check for $475.00 to act as payment for processing the Section 401 permit application. We are providing seven copies of this application to the North Carolina Department of Environment and Natural Resources, Division of Water Quality, for their review. As a result, excessive sediment runoff left the construction site and was deposited in Crossgate Lake. A background siltation study was performed by NCDOT Geotechnical Unit in Crossgate Lake in late 1996. The purpose of this study was to determine a baseline of current sediment in Crossgate Lake. A final siltation study was conducted by NCDOT Geotechnical Unit in June and July 2000. The purpose of this study was to quantify the t amount of sedimentation in Crossgate Lake that could be attributed to the construction of the Northern Wake Expressway. The results of this study indicate that the silt attributed from construction of the highway was thickest near the mouth of the Crossgate Lake and along the edges of the old channel of the unnamed tributary to Honeycutt Creek that flows within Crossgate Lake. All of the recent sediments were red in color while the pre- construction sediments were gray. The NCDOT has entered into an agreement with Community Properties, Inc. (the developers of Crossgate Subdivision) to obtain access to Crossgate Lake and excavate sediment that has been attributed to construction of the Northern Wake Expressway. Crossgate Lake has been recently drawn down to facilitate this activity. As stated above, a total of approximately 123,601 cubic feet of sediment will be excavated from an area covering 1.4 acres (Sheet 2). The construction sequence for this activity is addressed below: • A temporary road approximately 16 feet Wide will be constructed in the subdivision to the landward limit of the normal water level of Crossgate Lake. • A swamp dozer will enter Crossgate Lake and push the sediment near the edge of the lake. • A track hoe stationed on the upland near the edge of Crossgate Lake will scoop the sediment into a truck. The truck will remove the sediment from the site. • The temporary road will be removed and revegetated within six months. Due to time constraints associated with the project, the NCDOT is requesting a shortened public notice period. In compliance with Section 143-215.3D(e) of the NCAA we have enclosed a check for $475.00 to act as payment for processing the Section 401 permit application. The North Carolina Department of Transportation (NCDOT) submitted an Individual Section 404 (of the Clean Water Act) Permit Application to the U. S. Army Corps of Engineers (USACE) for the subject project on March 29, 1996. On October 10, 1996, the Section 404 Permit was issued by the USACE (Action ID No. 199601917). The Section 401 Water Quality Certification was issued by the N.C. Division of Water Quality (NCDWQ Project 960319) on September 27, 1996. This section of the Northern Wake Expressway project was let on July 15, 1997. In compliance with Special Condition "o", we hereby request that the USACE Section 404 Permit and DWQ Section 401 Water Quality Certification be modified to reflect the excavation of 123,601 cubic feet of sediment from an area covering 1.4 acres of Crossgate Lake. This packet contains this cover letter, vicinity map, and site map. An unnamed tributary to Honeycutt Creek (DWQ Index No. 27-20-(1)) is crossed by the project at Station 258+40-L-. This tributary outfalls into Crossgate Lake immediately north of the project at this station (Sheet 1). Heavy rains associated with Hurricane Floyd inundated the site on September 14-16, 1999. As a result, excessive sediment runoff left the construction site and was deposited in Crossgate Lake. A background siltation study was performed by NCDOT Geotechnical Unit in Crossgate Lake in late 1996. The purpose of this study was to determine a baseline of current sediment in Crossgate Lake. A final siltation study was conducted by NCDOT Geotechnical Unit in June and July 2000. The purpose of this study was to quantify the amount of sedimentation in Crossgate Lake that could be attributed to the construction of the Northern Wake Expressway. The results of this study indicate that the silt attributed from construction of the highway was thickest near the mouth of the Crossgate Lake and along the edges of the old channel of the unnamed tributary to Honeycutt Creek that flows within Crossgate Lake. All of the recent sediments were red in color while the pre- construction sediments were gray. The NCDOT has entered into an agreement with Community Properties, Inc. (the developers of Crossgate Subdivision) to obtain access to Crossgate Lake and excavate sediment that has been attributed to construction of the Northern Wake Expressway. Crossgate Lake has been recently drawn down to facilitate this activity. As stated above, a total of approximately 123,601 cubic feet of sediment will be excavated from an area covering 1.4 acres (Sheet 2). The construction sequence for this activity is addressed below: • A temporary road approximately 16 feet wide will be constructed in the subdivision to the landward limit of the normal water level of Crossgate Lake. • A swamp dozer will enter Crossgate Lake and push the sediment near the edge of the lake. • A track hoe stationed on the upland near the edge of Crossgate Lake will scoop the sediment into a truck. The truck will remove the sediment from the site. • The temporary road will be removed and revegetated within six months. Due to time constraints associated with the project, the NCDOT is requesting a shortened public notice period. In compliance with Section 143-215.3D(e) of the NCAA we have enclosed a check for $475.00 to act as payment for processing the Section 401 permit application. We are providing seven copies of this application to the North Carolina Department of Environment and Natural Resources, Division of Water Quality, for their review.
