This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to elevate a portion of the existing roadway and to upgrade existing drainage pipes under roadway. 9. PROJECT DESCRIPTION The project is located along NCSR 1542 (Hall Point Road), approximately 1,500 feet from the intersection of Hall Point Road and Fulcher's Landing Road, in the community of Sneads Ferry, in Onslow County. The project is located adjacent to an unnamed tidal tributary to the New River. The project site is an approximately 400 linear foot section of roadway at the crossing of the tidal tributary. At this location the road surface if very low (approximately 1.8' above MHW) and is subject to flooding during spring tides, wind driven high tides and storm events. The waters of the New River are classified "SA" by the Division of Water Quality. The area is not designated as a Primary Nursery Area and is open to the taking of shellfish. Five areas of coastal wetlands lie within the right-of -way of NCSR 1542 in the project area. These areas are indicated as areas A,B,C,D and E on the submitted plans. Area A is a small drainage feature on the norther side of the roadway, approximately 3' wide by 60' long and is vegetated with Salt Meadow Grass (Spartina patens) and Salt Grass (Distichlis spicata). Area B is an open water area on the norther side of the roadway, adjacent to the existing culvert crossings vegetated with Smooth Cordgrass Marsh (Spartina alterniflora) and Distichlis spicata along the edges. Area C is located along the northeastern end of the project, is approximately 90' long by 13' wide and is vegetated with Salt Reed Grass (Spartina cynosuroides), Spartina alterniflora, Disticidis spicata, and Spartina patens. Areas D and E are located on the southern side of the roadway, adjacent the culvert crossings and are vegetated with Spartina alterniflora, Distichlis spicata, and Spartina patens. The North Carolina Department of Transportation proposes to replace the two existing 24" reinforced concrete pipe (RCP) culverts at the tributary crossing with three 36" X 22" corrugated aluminum arch pipes. The bottom of the arch will be buried below the existing creek bottom and the top of the arch would be approximately one inch above MHW. Another existing 24" RCP located approximately 30' to the west of the crossing will be removed and not replaced. The existing roadway would be elevated approximately 1.5' above the existing road surface along a distance of approximately 400 feet. The increased elevation will require the footprint of the fill section to be increased to a width of approximately 40', which would average approximately 10' on each side of the pavement. The proposed project would not require the construction of temporary detour roads. All work will take place within the existing 60' right-of-way. The purpose of the project is to accommodate higher flows under the roadway and to help minimize flooding of the roadway during high tide events. 10. ANTICIPATED IMPACTS The expansion of the footprint of the roadway would result in impacts to approximately 2,383 sq. ft. of coastal wetlands within the existing 60' right-of-way during construction. It is estimated that approximately 345 sq. ft. of coastal wetlands and approximately 268 sq. ft. public trust area would be permanently impacted as the result of the increase of the fill section of the roadway and by the placement of the arch pipes and headwalls. In addition to replacing this culvert, one additional 24" RCP will be eliminated and the roadway will be elevated +/- 1.5 feet above its existing profile along a distance of +/- 400 feet. This work is being proposed to eliminate a chronic flooding problem at this low-lying area. The engineers have minimized the footprint of the fill section to the fullest extent practicable to ensure that impacts to waters and/or wetlands are minimized. The resulting impacts to Areas of Environmental Corcern involve coastal wetlands (CW), estuarine waters (EW), public trust waters (PT) and estuarine shoreline (ES). The estimated impacts to CW and EW/PT will be 0.05 acre and 0.006 acre, respectively.
