This letter is to inform you that the biological monitoring requirements for the projects listed
below are considered complete based on the criteria listed in the Interim, Internal Technical
Guide Summary for Benthic Macroinvertebrate Monitoring Protocols for Compensatory Stream
Restoration and Enhancement Level 1 Projects.

No further biological monitoring is required for these projects for one of the two following
reasons:
1) The project is included in the 80 level 1 projects referenced in Part I. Regulatory
Requirements of the technical guide.
2) In DWQ's opinion, the project has met the requirements of the permit based on biological
monitoring that has been completed to date.
Satisfaction of the biological monitoring requirements based on these two reasons is applicable
only to the projects listed above and should not be applied to current or future projects without
approval from the DWQ. If you have any questions on this matter, please contact John Hennessy

Dear Mr. Turner:
On March 6, 2000 the Division of Water Quality wrote to you concerning your plans to fill .01 acres of wetlands
and/ or linear feet of streams for the purpose of replacing Bridge 155 on SR 1338 in Sampson County. This letter
informed you that the project was incomplete and was being placed on hold until the additional information outlined in the
letter was supplied. To date, we have not received this additional information. Unless we hear from you in writing within 3
weeks of the receipt of this letter, we will consider that you no longer want to pursue this project and we will retire the file
and consider the application as withdrawn. Please be aware that reapplication for this project will require a Certification
fee and new applications.

On 22 of February, 2000 the Division of Water Quality (DWQ) was notified by receipt
of a copy of the regional permit 31 from the US Army Corps. Of Engineers regarding your plan
to fill 0.01 acres of wetland for the purpose of replacing bridge 155 on SRI 338 in Samson
County. Approval from DWQ is required to disturb these wetlands. The enclosed application
needs to be completed and returned to us with 7 copies of the application, supporting maps and
documentation. In particular as described in 15A NCAC 2B .0502, we will require you to locate
all streams and ponds on the property. Please show these on maps of suitable scale (for instance
1" = 100 feet) so we can begin to determine your projects' compliance with 15A NCAC 2H
.0500.
In addition, the N.C. General Assembly enacted a new law effective January 1, 1999
which requires fees for 401 Water Quality Certifications. If the impact is equal to or less than
one acre of wetland (or waters) or 150 feet of streams, payment of $200.00 is required. If the
proposed fill exceeds these thresholds; the fee is $475.00. Checks should be made payable to the
N.C. Division of Water Quality and sent in with the application.
Please call Cynthia Van Der Wiele at 919-733-1786 if you have any questions or would
require copies of our rules or procedural materials. This project will remain on hold as
incomplete in accordance with 15A NCAC 2B .0502 (c). The process time for this project will
begin when this information is received.

Location of project (waterway, road name/number, town, etc.): Bridge No. 155 over Hornet Swamp on SR 1338 in
Sampson County, North Carolina.
Description of Activity: Discharge of fill material impacting a total of 0.01 of waters of the United States,
including wetlands, for construction of State Project Number 5.2852. Bridge No. 155 will be replaced with 2 @
142" x 91 corrugated steel pipe arches. Traffic will be detoured along surrounding roads during construction.
