TIP No. B-3195, State Project no. 8.2822001, Federal Aid No. MABRZ-1852(2). The North Carolina Department of Transportation (NCDOT) has requested a Section 404 Nationwide Permit No. 23 for the subject project. Our comments are provided in accordance with the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Federally Listed Species In the Natural Resources Technical Report, NCDOT biologists considered the one federally listed species in Iredell County, the threatened (due to similarity of appearance) bog turtle (Clemmys muhlenbergii). No suitable habitat for bog turtle exists within the project area and there are no documented occurrences in the vicinity of the project. We concur with NCDOT's conclusion of "no effect" for federally listed species in the project area. In view of this, we believe the requirements under Section 7(c) of the Act are fulfilled. However, obligations under Section 7 of the Act must be reconsidered if. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. Effects to Waters and Wetlands We are pleased with NCDOT's decision to replace a bridge with a bridge. The new bridge design should include provisions for roadbed and deck drainage to flow through a vegetated buffer prior to reaching the affected stream. This buffer should be large enough to alleviate any potential effects from the run-off of storm water and pollutants. The bridge design should not alter the natural stream and stream-bank morphology or impede fish passage. Any piers or bents should be placed outside the bank-full width of the stream. The bridge and approach should be designed to avoid any fill that will result in damming or constriction of the channel or flood plain. If spanning the flood plain is not feasible, culverts should be installed in the flood plain portion of the approach to restore some of the hydrological functions of the flood plain and reduce high velocities of flood waters within the affected area. We recommend erosion- and sedimentation-control measures be in place prior to any ground-disturbing activities. Wet concrete should never be allowed to come into contact with the stream. As you are aware, the North Carolina Department of Transportation proposes to replace Bridge No. 227 over Rocky River on SR 1852. A Nationwide Permit No. 23 was applied for on August 21, 2000. The purpose of this letter is to also request a Nationwide Permit No. 33 for construction of a temporary causeway. Attached for your information are permit drawings for the temporary causeway. To construct the proposed center pier, a temporary causeway must be employed. The amount of temporary fill in surface waters will be approximately 0.05 ac. The fill will be composed of Class II Rip Rap (1.5:1). The NCDOT requests that you review this work for authorization under Nationwide Permit No. 33. It is anticipated that 401 General Certification No. 3114 (Temporary Construction, Access, and Dewatering) will apply to this project, and the attached information is being provided to the North Carolina Department of Environment and Natural Resources, Division of Water Quality, for their review.
