APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Smith:
You have our approval, in accordance with the attached conditions and those listed below, to impact
60 linear feet of an unnamed tributary to Buffalo Creek in order to perform road repair and
installation of two 72-inch corrugated metal pipes. The project should be constructed in accordance
with your application dated 13 October 2000 (received 23 October 2000). After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number
3289. This certification corresponds to the Nationwide Permit 14 issued by the Corps of Engineers.
In addition, you should acquire any other federal, state or local permits before you proceed with your
project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water
Supply Watershed regulations. This approval will expire with the accompanying 404 permit, unless
otherwise specified in the Water Quality Certification. The following additional conditions will be
required:
1. The culvert shall be installed in such a manner that the original stream profile is not altered (i.e.
the depth of the channel should not be reduced by a widening of the stream bed).
2. All work shall be performed during low flow conditions.
3. Care must be utilized such that live (wet) concrete does not enter the stream channel.
4. The presence of equipment in the channels must be minimized.
5. Rip-rap shall not be placed above the bank-full elevation.
6. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for
storm water sheet flow.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
2H.0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed
in the attached certification.

If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
To ask for a hearing, send a written petition that conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The North Carolina Department of Transportation (NCDOT) proposes to replace two (2) lines of
40-feet long 72-inch CMP with two (2) lines of 112 by 75-inch CMP Arch 60-feet long as part of
routing maintenance of the existing road crossing. Replacement is necessary due to damage of the
existing pipes, the absence of a stable shoulder, and the need to restore aquatic life movement (See
attached photos). No Wetlands, High Quality Waters, or Outstanding Resource Waters occur in the
project area.
The NCDOT anticipates that this activity will be authorized under General Permit 19820031.
Enclosed please find the project site map and the pre-construction notification form for the above
referenced projects. By copy of this letter we are also requesting a General Water Quality
Certification #3289 from the NC Division of Water Quality. Construction is anticipated to begin in
December and take five weeks to complete.

Replacement of two lines of damaged 40' long 72" CMP (see attached photos) located within a perennial
stream with two lines of 60' long 112 X 75" CMPA with a slope collar.
Road construction equipment.
13. PURPOSE OF PROPOSED WORK: Replace a damaged pipes to facilitate increased flow, aquatic life
movement, and prevent further siltation of the stream by extending the roadside shoulder to enhance
stability. Shoulder extension is also required to meet current safety standards.
14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN
WETLANDS (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS)
Pipes have to be replaced due to damage to the existing structure. Pipe replacement will result in benefits
to the environment by restoring aquatic life movement, increasing flow, and facilitating increased
shoulder stability by extending the slope. In addition, the activity is part of a linear proiect where waters
of the Unites States cannot be avoided.

Replacement of two lines of damaged 40' long 72" CMP (see attached photos) located within a perennial
stream with two lines of 60' long 112 X 75" CMPA with a slope collar.
Road construction equipment.
13. PURPOSE OF PROPOSED WORK: Replace a damaged pipes to facilitate increased flow, aquatic life
movement, and prevent further siltation of the stream by extending the roadside shoulder to enhance
stability. Shoulder extension is also required to meet current safety standards. -
14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN
WETLANDS (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS)
Pipes have to be replaced due to damage to the existing structure. Pipe replacement will result in benefits
to the environment by restoring aquatic life movement, increasing flow, and facilitating increased
shoulder stability by extending the slope. In addition, the activity is part of a linear project where waters
of the Unites States cannot be avoided.
