APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Mr. Holderman:
You have our approval, in accordance with the attached conditions and those listed below, to
replace Bridge #386 (SR 1535) over Pheasant Creek in Cleveland County. The project should
be constructed in accordance with your application dated 8 September 2000 (received 19
September 2000). After reviewing your application, we have decided that this project is covered
by General Water Quality Certification Number 3289. This certification corresponds to the
Nationwide Permit Number 14 issued by the Corps of Engineers. In addition, you should acquire
any other federal, state or local permits before you proceed with your project including (but not
limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. This approval will expire with the accompanying §404 permit, unless otherwise
specified in the Water Quality Certification. The following additional conditions will be
required:
• In-stream work and land disturbance within the 25-foot wide buffer zone are prohibited
during the rainbow trout spawning season of January 1 through April 15 to protect the egg
and fry stages of trout from off-site sedimentation during construction.
• Any culverts required for this project shall be installed in such a manner that the original
stream profile is not altered (i.e. the depth of the channel should not be reduced by a
widening of the streambed).
• All work shall be performed during low flow conditions.
• The presence of equipment in the channels must be minimized.
• Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for
storm water sheet flow.
• Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be
planted when practical.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ and submit a new

application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If the proposed
fill is in excess of 150 linear feet of stream length or 1 acre of wetlands, compensatory mitigation
will required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid,
you must follow the conditions listed in the attached certification and any additional conditions
listed above.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition that conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C.
27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Please forward this response to Cynthia Vanderwiel.
Our fish biologists are most concerned about rainbow trout in the area of
this road. For that purpose, they have recommended the following
moratorium period:
Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the rainbow trout spawning season of January 1 through
April 15 to protect the egg and fry stages of trout.

Ron - as discussed with you by phone, there are conflicting
moratorium dates between your comments and DEHR comments. Your
comments dated Sept. 21, 2000 gave Jan. 1 thru April 15.
DEHR-DWQ Certification gave dates of Nov. 1 thru March 31. Due
to the poor condition of the bridge we would like to do this
replacement during December. Speaking with Cynthia Vanderwiel at
DEHR, she said whatever dates you wanted, DENR would go along
with. They would only need an e-mail from you.
Please let me and DEHR know what you decide.

STREAM: Pheasant Creek
DESCRIPTION: Replace existing 65' long x 20' wide timber bridge with 2 lines of 142"x91"
CMPA, 80' long. Class "IV Watershed - Trout" waters involved. No wetlands involved.
Less than %2 acre of stream effected.
With a copy of this letter, we are also requesting a concurrence letter from the Wildlife Resources
Commission, US Fish & Wildlife Service, State Historic Preservation Office, and NCDENR.
We have attached a site location map, and a sketch of planned activities. A stringent erosion and
sedimentation control program will be implemented during the project construction, and every
effort will be made to complete the work in a timely manner.

The North Carolina Department of Transportation Bridge Maintenance Unit, proposes the
following project for your issuance of a Section 404 Permit. We believe this project can be
accomplished under NWP #14, Linear Transportation Crossings.

LOCATION: SR 1535
STREAM: Pheasant Creek
DESCRIPTION: Replace existing 65' long x 20' wide timber bridge with 2 lines of 142"x91"
CMPA, 80' long. Class "IV Watershed - Trout" waters involved. No wetlands involved.
Less than % acre of stream effected.
With a copy of this letter, we are also requesting a concurrence letter from the Wildlife Resources
Commission, US Fish & Wildlife Service, State Historic Preservation Office, and NCDENR.
We have attached a site location map, and a sketch of planned activities. A stringent erosion and
sedimentation control program will be implemented during the project construction, and every
effort will be made to complete the work in a timely manner.

According to your letter of September 11, 2000, the North Carolina Department of
Transportation is proposing to replace Bridge No. 386 on SR 1535 in Cleveland County. The
existing timber bridge will be replaced with two 80-foot metal arched pipes.
As requested, we have reviewed the proposed project and are providing the following comments
in accordance with the provisions of Section 7 of the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531-1543) (Act), and the Fish and Wildlife Coordination Act, as amended
(16 U.S.C. 661-667e).
Enclosed is a list of species from Cleveland County that are on the Federal List of Endangered
and Threatened Wildlife and Plants, as well as species of federal concern. Our records for
Cleveland County indicate there are several known locations of the federally threatened
dwarf-flowered heartleaf (Hexastylis naniflora) nearby Bridge No. 386. You should determine
whether there is suitable habitat for dwarf-flowered heartleaf in the area affected by the project. If
suitable habitat occurs in the project area, surveys will be required to determine if the species is
present. if this species occurs in the project area, additional consultation will be required.
Species of federal concern are not legally protected under the Act and are not subject to any of its
provisions, including Section 7, unless they are formally proposed or listed as endangered or
threatened. We are including these species in our response to give you advance notification and
to request your assistance in protecting them if any are found in the vicinity of your project.
We are concerned about the decision to replace a bridge with a set of culverts. We also have
questions about the culverts and their capacity to accommodate high flows, especially during
storm events, and the potential negative effects of scouring on the natural stream channel
downstream of the structures. A bridge would ensure the natural functions of the flood plain and
maintain fish passage, especially during low flows. We strongly recommend replacing the existing
bridge with a bridge.

'In the November 4, 1997, Federal Register (55822-55825), the northern population of the bog turtle (from New
York south to Maryland) was listed as T,(threatened), and the southern population (from Virginia south to
Georgia)was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the
collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A)
designation has no effect on land-management activities by private landowners in North Carolina, part of the
southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service
considers the southern population of the bog turtle as a federal species of concern due to habitat loss.
