NORTH CAROLINA 401 WATER QUALITY CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92- 500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500. This certification authorizes the NCDOT to place fill material in 0.047 acres of jurisdictional wetlands, the discharge of fill material into 89 linear feet of intermittent stream channels, fill 2,147 linear feet of perennial stream channel and the proposed relocation of an additional 377 linear feet of perennial stream channel in Catawba County. The project shall be constructed pursuant to the application filed on the 22nd day of May 2000 to construct a 2.0 mile section of the proposed Newton-Conover Eastern Loop on the east side of Conover, NC. Specifically, this project involves the reconstruction of Thornburg Drive to a four-lane section with a median along its current alignment across SR 1739 (Emanuel Church Road) and US 64-70 to SR 1709 (Rock Barn Road). From SR 1709, the new four-lane median roadway continues on new location to I-40. From I-40, the project terminus at NC 16, north of Conover, the roadway will remain on new location, but as a five-lane facility. As part of this section, the NC 16 interchange with I-40 will be relocated to the new route and the ramps for the existing interchange in Conover will be removed. The application provides adequate assurance that the discharge of fill material into the waters of Mull Creek, Conover Creek and its unnamed tributaries in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. Should your project change, you are required to notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: 1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices) shall be utilized to prevent exceedence of the appropriate - turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 4. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 5. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this certification without appropriate modification of this certification. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities. 6. Compensatory mitigation shall be performed for 1,881 linear feet of jurisdictional stream impacts at a 2:1 ratio and for 266 linear feet of stream impacts at a 1:1 ratio. We understand that you have chosen to complete onsite mitigation at a 1:1 ratio to restore 692 feet of stream to offset for these impacts. The balance of 3,336 linear feet of compensatory mitigation will occur off-site via a payment of $417,000 to the North Carolina Wetland Restoration Program (WRP). The WRP has agreed to implement mitigation for the project. In accordance with L5A NCAC 2R.0500, the contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). Until the Wetland Restoration Program receives and clears your check (made payable to DENR - Wetland Restoration Program), wetland oL stream fill shall not occur. The payment to NCWRP shall be sent within two months of issuance of the 404 permit. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon the expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. If modifications are made to an original Certification; you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. Unless such demands are made, this Certification shall be final and binding. Dear Ms. Manuele: The North Carolina Department of Transportation (NCDOT) proposes to construct a four- or five-lane median-divided curb and gutter highway and reconstructing existing two-lane SR 2642 (Thornburg Drive) to four lanes around the east sides of the cities of Newton and Conover in Catawba County. The proposed route for this highway begins at NC 16 southeast of Newton and proceeds east of Conover, crossing Interstate 40 (I-40), before ending north of existing NC 16 north of Conover. The NC 16 interchange with I-40 will be relocated to the new route and the ramps for the existing interchange in Conover will be removed. The total length of the project is 5.8 miles. The purpose of this application is to address impacts to Section B, which specifically involves the reconstruction of Thornburg Drive to a four-lane section with a median along its current alignment across SR 1739 (Emanuel Church Road) and US 64- 70 to SR 1709 (Rock Barn Road). From SR 1709, the new four-lane median roadway continues on new location to I-40. From I-40 to the project terminus at NC 16 north of Conover, the roadway will remain on new location but be a five-lane facility. The total length of Section B is 2.0 miles. R The purpose of the project is to improve accessibility and traffic service for V residents, business and industry in Newton, Conover, Hickory, and surrounding areas. Additionally, the project will provide the opportunity to relocate NC 16 out of the downtown area to the eastern perimeters of Newton and Conover. The eastern loop of this project will provide a section of the proposed thoroughfare loop that will eventually encircle Newton and Conover and provide access to the developing areas east of these cities. NEPA Documentation An Environmental Assessment (EA) was approved by the Federal Highway Administration (FHWA) on December 10, 1996. The EA explains the purpose and need for the project, provides a,4eAcpi of the project and characterizes the social, economic, and environmental cffesn of the project. An extensive public and agency coordination was initiat-o ;hsproject. To obtain input from citizens, a public involvement program was organized and implemented throughout the planning processes. This program included newsletters, a toll-free hotline, a Public Officals meeting (January 17, 1995), a Citizens Informational Workshop (January 17, 1995), and two small group meetings from residents near Caleb-Setzer Road (February 13, 1995) and L'echo Park (February 20, 1995). After the EA was approved and circulated, a Combined Public Hearing on the location and design was held on February 20, 1997. On August 29, 1997, the Finding of No Significant Impact (FONSI) was approved by the FHWA. Copies of the EA and FONSI have been provided to the regulatory review agencies involved in the approval process. Additional copies will be provided upon request. Jurisdictional Status Construction of the proposed project will necessitate impacts to waters of the United States. Surface waters will be affected by the placement and extension of culverts and pipes at stream crossings, stream relocation, and the removal of existing pipe to create new open channels. Wetlands will be affected by the placement of fill and mechanized clearing (10 feet beyond construction limits). The North Carolina Division of Water Quality (NCDWQ) has provided guidance to differentiate between perennial streams, intermittent streams, and stormwater channels. These guidelines are presented in Field Location of Streams, Ditches, and Ponding (NCDENR, 1997). Wetland delineations were conducted using the field delineation method outlined in the 1987 Corps of Engineers Wetland Delineation Manual (Environmental Laboratory, 1987). Jurisdictional stream determinations and wetland delineations for Section B were conducted at the site by NCDOT Natural Systems Specialist Chris Murray on February 19, 1998 and verified by USACE field representative Steve Lund on December 15, 1998. USACE field representative Jean Manuele visited portions of the site on October 7, 1999. Mr. John Hennessy (NCDWQ) and Mr. David Cox (North Carolina Wildlife Resources Commission) were provided the opportunity to visit the site on the same day; however, due to existing workload, they were unable to attend the site visit. Mr. Hennessy indicated that he would defer his comments and rely on the USACE determination. Project Let Schedule . For construction purposes, the construction of the project has been broken down into two sections. Table 1 reflects the project breakdown, section termini, and project let dates. Table 1. Impacts on jurisdictional areas of this section consist of 0.025 acre fill in wetlands, 0.022 acre permanent wetland impact due to mechanized clearing (Method III), 0.331 acre fill in surface water (stream), 2,236 feet existing channel filled, and 377 feet relocated channel. Additionally, portions of an existing pipe under the westbound off-ramp and eastbound on-ramp will be, removed, allowing 315 feet of stream to be "relocated" in its natural channel at its existing location. NCDOT plans to extend the existing pipe crossing and fill 75 feet of stream channel. The stream exhibits stable banks and a developed canopy. A 2:1 stream mitigation ratio is proposed at this site. Site 2 This site will impact Conover Creek. NCDOT plans to place a double barreled box culvert at the site and fill 436 feet of stream channel. A sill will be added to the inlet to direct low flow through one barrel. This stream is located in a stable floodplain with a well developed canopy layer. Fish were observed in this creek. A 2:1 stream mitigation ratio is proposed at this site. Site 3 This site will impact Conover Creek. NCDOT plans to place a double barreled box culvert at the site and fill 531 feet of stream channel. A sill will be added to the inlet to direct low flow through one barrel. This stream is located in a stable floodplain with a well developed canopy layer. Fish were observed in this creek. A 2:1 stream mitigation ratio is proposed at this site. Site 4 This site will impact an unnamed perennial tributary to Conover Creek. NCDOT plans to relocate the channel for 377 feet and then continue the stream flow through a concrete pipe. Here, a total of 682 feet of Conover Creek will be filled by project construction. The base width of the relocated channel will be constructed to match the existing channel to maintain the existing depth of water. A small high energy channel levee will be created along the proposed channel and natural substrate will be incorporated along the base of the channel. Riprap is only located along the banks of the relocated channel at the toe of the slope to prevent erosion. This area will quickly be colonized by successional plants, which will stabilize the area. In addition, NCDOT will revegetate along the relocated channel, where feasible, with similar forest species that naturally occur adjacent to the project site. The design of the relocated channel incorporates a 50 foot wooded border along the relocated channel, all located within the NCDOT right-of- way. Based on this design, the segment of relocated channel will continue to support that use exhibited by the existing channel and approximate existing stream conditions. The presence of a stable bank may improve water quality in the area. A total of 377 feet of on-site stream mitigation will be available at this site for this project. USACE representative Jean Manuele visited this site on October 7, 1999. Due to the fluctuating nature of the stability of the stream bank, it was determined that the stream mitigation ratio would vary along the system. It was determined that a 1:1 ratio would be applicable from the origin of the relocation to Station 1+20 Ramp B where the stream is very incised and has an unstable, highly erodable bank. A 2:1 ratio would be applicable from Station 1+20 Ramp B to the termination of the relocation where the stream exhibits a stable bank and well developed canopy layer. A total of 266 feet of stream channel loss would require mitigation at a 1:1 ratio and a total of 416 feet of stream channel loss would require mitigation at a 2:1 ratio. Site 5 This site will impact Conover Creek. NCDOT plans to extend a single barrel box culvert with a tapered inlet at the site and fill 72 feet of stream channel. This site exhibits a stable bank and well developed canopy layer. Juvenile amphibians were observed at this site. A 2:1 stream mitigation ratio is proposed at this site. Site 6 This site will impact Conover Creek. NCDOT plans to place a double barreled box culvert at the site and fill 269 feet of stream channel. A sill will be added to the inlet to direct low flow through one barrel. This site exhibits a stable bank and well developed canopy layer. Juvenile amphibians were observed at this site. A 2:1 stream mitigation ratio is proposed at this site. Site 7 This site will impact Mull Creek. NCDOT plans to extend the existing pipes crossing Thornburg Drive and fill 82 feet of stream channel. This site exhibits a stable bank and well developed canopy layer. A 2:1 stream mitigation ratio is proposed at this site. Site 8 This site will impact an unnamed intermittent tributary to Mull Creek. NCDOT plans to extend the existing pipes crossing Thornburg Drive and fill 89 feet of stream channel. According to a conversation with Jean Manuele on October 7, 1999, stream mitigation will not be required at this site. Site 9 A total of 197 ft of perennial stream will be removed from a pipe and relocated into a natural channel using natural stream guideline techniques, as applicable to the existing setting. NCDOT will revegetate along the channel, where feasible, with similar forest species that naturally occur adjacent to the project site. NCDOT will claim on-site stream mitigation for this segment of relocated stream at a 1:1 ratio. Accordingly, 197 feet- of on-site mitigation will be available at this site for the project. Site 10 A total of 118 ft of perennial stream will be removed from a pipe and relocated into a natural channel using natural stream guideline techniques, as applicable to the existing setting. NCDOT will revegetate along the channel, where feasible, with similar forest species that naturally occur adjacent to the project site. NCDOT will claim on-site stream mitigation for this segment of relocated stream at a 1:1 ratio. Accordingly, 118 ft of on-site mitigation will be available at this site for the project. Site A This site impacts a very small portion of a non-riverine emergent/scrub-shrub wetland. Impacts on jurisdictional areas of this site consist of 0.025 acre fill in wetlands and 0.022 acre permanent wetland impact due to mechanized clearing (Method III). Due to the minimal impacts at the site, NCDOT will not provide mitigation for wetland impacts Endangered Species Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act. As of December 10, 1999, dwarf- flowered heartleaf (Hexastylis naniflora) is the only protected species listed for Catawba County. Two sites containing heartleaf (Hexastylis spp.) were located within the project limits of this portion of the Newton-Conover Eastern Loop on August 27, 1999. This genera contains a federally Threatened species, dwarf-flowered heartleaf (Hexastylis naniflora) that cannot be accurately identified until its flowering period of late March- June. Representative flowers were collected from these sites on April 4, 2000. NCDOT Area Coordinator Tim Savidge identified the flowers as Hexastylis heterophylla, a non- protected species. Therefore, impacts to protected species will not occur from project construction. Cultural Resources A historical architectural survey was performed to identify properties within the project study area listed in or eligible for the National Register of Historic Places. An Area of Potential Effect (APE) was determined and an assessment of effects of the proposed Eastern Loop on properties within the APE was performed. The North Carolina State Historic Preservation Office concurrence form indicates that there are no resources listed in the National Register of Historic Places (NRHP), on the State Study List, or eligible for listing in the national Register, located within the APE for the project. An archaeological background study was prepared for the project study area. The background research and field reconnaissance demonstrated that all alternatives had some potential to contain archaeological sites. The North Carolina Deputy State Historic Preservation Officer reviewed the study and agreed with the NCDOT recommendation to conduct an intensive archaeological survey of non-eroded soils within the APE. The intensive archaeological survey was conducted within the Preferred Alternative in March 1997. The survey resulted in the discovery of four previously unrecorded sites, none of which are eligible for the National Register. However, there is potential for unmarked infant burials dating to the 1890's at Site 31CT199**. Prior to construction, NCDOT will assess the site for the presence of unmarked burials. If such remains are found, they will be relocated according to State guidelines. A final report will be submitted to the North Carolina Department of Cultural Resources (NCDCR) prior to construction. The NCDCR concurred with the determination make by the FHWA that no archaeological properties within the APE are in or eligible for listing in the NRHP. Environmental Commitments Pertinent to Section B • Best Management Practices will be adhered prior to and during construction. • Coordination with the cities of Newton and Conover will be maintained during design and construction to locate and minimize impacts to water and sewer lines. • When ROW limits are established, an assessment will be performed of each hazardous materials site and underground storage tanks site within the ROW to the degree necessary to determine the levels of contamination. If necessary, options to remediate the site will be evaluated, along with the associated acquisition costs. Resolution of problems associated with contamination will be coordinated with appropriate agencies and, prior to ROW acquisition, appropriate actions will be taken where applicable. • The proposed roadway will encroach into the floodway of the 100-year floodplain at Conover Creek. It is anticipated these encroachments will require floodway modifications. The floodway modifications, if required, will be coordinated with the local community having land use jurisdictional authority and the Federal Emergency Management Agency during the final design phase of the project. • Coordination with utility companies will be initiated prior to construction to ensure maintenance of services to the area during and following construction of the Preferred Alternative. • The intensive cultural resource assessment completed for the Preferred Alternative identified the potential for unmarked infant burials dating to the 1890's at Site 31CT199**. Prior to construction, the NCDOT will assess the site for the presence of unmarked burials. If such remains are found, they will be relocated according to State guidelines. • The construction contract for this project will include the requirement that sedimentation and erosion control measures be placed outside wetlands unless necessary to adequately control sedimentation. • The NCDOT and its contractors will not excavate, fill, or perform land clearing activities within waters of the United States or any areas under the jurisdiction of the USACE, except as authorized by the USACE. To ensure that all borrow and waste activities occur on high ground, except as authorized by permit, the NCDOT shall require its contractor to identify areas to be used for borrow material or for disposal of dredged or waste material. Documentation of the location and characteristics of all borrow and disposal sites associated with the project will be available to the USACE on request. Mitigation The USACE adopted, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. The purpose of this policy is to restore and maintain the chemical, biological, and physical integrity of the Waters of the United States. Mitigation of wetland and surface water impacts has been defined by the CEQ to include: avoiding impacts, minimizing impacts, rectifying impacts, reducing impacts over time, and compensating for impacts (40 CFR § 1508.20). Executive Order 11990 (Protection of Wetlands) and DOT Order 5660.1A (Preservation of the Nations Wetlands), emphasize protection of the functions and values provided by wetlands. These directives require that new construction in wetlands be avoided as much as possible and all practicable measures are taken to minimize or mitigate impacts to wetlands. The NCDOT is committed to incorporating reasonable and practicable design features to avoid and minimize wetland impacts, and to provide full compensatory mitigation of remaining wetland impacts. Avoidance measures were taken during the planning and EA/FONSI phases; minimization measures were incorporated as part of the project design. Avoidance All wetland and surface water areas not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Impacts to waters of the United States were minimized on all of the project during the preliminary designs by placing the alignment in the most environmentally friendly area, resulting in the minimal amount of wetland and stream impact for this project. Crossings are placed perpendicular to the stream channel to minimize impacts. According to a letter from the North Carolina Department of Environment, Health, and Natural Resources (dated January 31, 1997), the EA sufficiently addresses avoidance and minimization measures utilized during the corridor selection process to limit wetland and stream impacts. Wetland impacts to Site B were avoided in the permitting stage by shifting the limits of a permanent drainage easement to the west of a wetland. Minimization Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts. Minimization techniques were implemented as follows: 1. Slopes: In wetlands the side-slopes have been steepened to the extent possible. 2. Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands. 3. Ditching: It is the policy of the NCDOT to eliminate lateral ditching in wetlands as much as possible, thus preserving the hydrology of adjacent wetlands. 4. Rip Rap: The NCDOT Hydraulics Unit has reduced the amount of rip rap in all stretches of the relocated channel located at Site 4 5. Open Channels: The NCDOT Design Services Branch and Hydraulics Unit has created open channels at Sites 9 and 10. 9 Compensation Mitigation is generally accomplished through a combination of methods designed to replace wetland functions and values lost as a result of construction of the project. Compensation may take the form of mitigation banking, contributions to wetland trust funds, or replacing lost wetland functions and values on-site. Replacing lost wetland functions and values may be accomplished through creating, restoring, enhancing, or preserving similar functions and values in constructed or improved wetlands. When practicable, replacement wetland standards are to provide new wetlands either preceding the wetland losses or concurrently with the losses so that wetlands are functioning at all times during the construction process. There are a total of eight jurisdictional stream sites (Sites 1 through 8) and one jurisdictional wetland site (Site A) in the project study area. Impacts on jurisdictional areas of Section A consist of 0.025 acre fill in wetlands, 0.022 acre wetland impact due to mechanized clearing (Method III), 0.331 acre fill in surface water (stream), 2,236 feet existing channel filled, and 377 feet relocated channel. Of the 2,236 feet existing channel filled, 2,147 feet is classified as perennial stream and 89 feet is classified as intermittent (Site 8). The channel located at Site 8 is an intermittent stream and will not require mitigation. Therefore, a total of 2,147 linear ft of stream impacts will require mitigation. Of this amount, 1,881 feet will require mitigation at a 2:1 ratio and 266 feet will require mitigation at a 1:1 ratio. A segment of relocated channel totaling 377 ft is located at Site 4. This site is thoroughly discussed above (see p. 4), and will serve as on-site mitigation at a 1:1 ratio. Additionally, portions of an existing pipe under the westbound off-ramp and eastbound on-ramp of I-40 will be removed. A total of 197 feet along the I-40 off-ramp (Site 9) and 118 feet along the 1-40 on-ramp on-ramp (Site 10) will be "relocated" in a natural channel at its existing location. These stream segments at Sites 9 and 10 totaling 315 feet will serve as on-site mitigation at a 1:1 ratio. The mitigation needs for this project are summarized below: • A total of 1,881 feet of stream impacts will require mitigation at a 2:1 ratio. Accordingly, NCDOT will require mitigation for a total of 3,762 feet of stream. • A total of 266 feet of stream impacts will require mitigation at a 1:1 ratio. Accordingly, NCDOT will require mitigation for a total of 266 feet of stream. • 'A total of 692 feet of on-site mitigation is available at a 1:1 ratio. • The amount of on-site mitigation subtracted from the total stream amount requiring mitigation at either a 2:1 ratio or a 1:1 ratio is the amount of stream impacts that will require compensatory mitigation. • Therefore, a total of 3,336 feet of stream will require compensatory mitigation. (Note: 3,762+266-692=3,336). NCDOT intends to utilize the North Carolina Wetland Restoration Program to provide mitigation for stream loss at the project. If this is accepted, NCDOT proposes to pay $417,000 to the WRP (at $125 per foot of impact) for compensatory stream mitigation. 10 Wetland impacts at Site A consist of 0.025 acre fill in wetlands and 0.022 acre permanent wetland impact due to mechanized clearing (Method III). Due to the minimal impact of the project, NCDOT will not provide wetland mitigation. This certification authorizes the NCDOT to place fill material in 0.047 acres of jurisdictional wetlands, the discharge of fill material into 89 linear feet of intermittent stream channels, fill 2,236 linear feet of perennial stream channel and the proposed relocation of an additional 377 linear feet of perennial stream channel in Catawba County. The project shall be constructed pursuant to the application filed on the 22nd day of May 2000 to construct a 2.0 mile section of the proposed Newton-Conover Eastern Loop on the east side of Conover, NC. Specifically, this project involves the reconstruction of Thornburg Drive to a four-lane section with a median along its current alignment across SR 1739 (Emanuel Church Road) and US 64-70 to SR 1709 (Rock Barn Road). From SR 1709, the new four-lane median roadway continues on new location to I-40. From I-40, the project terminus at NC 16, north of Conover, the roadway will remain on new location, but as a five-lane facility. As part of this section, the NC 16 interchange with I-40 will be relocated to the new route and the ramps for the existing interchange in Conover will be removed. The application provides adequate assurance that the discharge of fill material into the waters of Town Creek and nine of its unnamed tributaries in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. Should your project change, you are required to notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC -211 .0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) bf Certification: 1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices) shall be utilized to prevent exceedence of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 4. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 5. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this certification without appropriate modification of this certification. Should waste or borrow NORTH CAROLINA - DIVISION OF WATER QUALITY 401 WATER QUALITY CERTIFICATION SUMMARY OF PERMITTED IMPACTS AND MITIGATION REQUIREMENTS In accordance with 15A NCAC 2H.0500, the North Carolina Department of Transportation is authorized to impact the surface waters of the State of North Carolina as indicated below for the purpose of constructing a 2.0 mile section of the proposed Newton-Conover Eastern Loop on the east side of Conover, NC. Plans submitted with the application show that the NCDOT proposes to construct a four- or five-lane curb and gutter highway and reconstruct the existing two-lane SR 2642 (Thornburg Drive) to four lanes around the east sides of the cities of Newton and Conover in Catawba County, North Carolina. The proposed route begins at NC 16 southeast of Newton and proceeds east of Conover, crossing Interstate 40 (I-40), before ending north of existing NC 16 north of Conover. The NC 16 interchange with I-40 will be relocated to the new route and the ramps for the existing interchange in Conover will be removed. The total length of the project is 5.8 miles. This permit request specifically addresses impacts to Section B, which involves the reconstruction of Thornburg Road to a four-lane section with a median along its current alignment across SR 1739 (Emanuel Church Road) and US 64-70 to SR 170-9 (Rock Barn Road). From SR 1709, the new four-lane median roadway continues on new location to I-40. From I-40 to the project terminus at NC Highway 16 north of Conover, the roadway will remain on new location but be a five-lane facility. As part of this section, the NC 16 interchange with I- 40 will be relocated to the new route and the ramps for the existing interchange in Conover will be removed. The total length of Section B is 2.0 miles. The proposed project will result in the filling of 0.047 acre of jurisdictional wetlands. The project will also impact open surface waters at 8 separate locations, involving Mull Creek and Conover Creek and some of its unnamed tributaries. Impacts to surface waters will result from the discharge of fill material into 0.047 acre of jurisdictional wetlands, 89 linear feet of intermittent stream channels with minimal aquatic functions, the discharge of fill material into 2,147 linear feet of perennial streams and will involve the relocation of 377 linear feet of streams within the project limits. The permittee proposes to mitigate for 1,881 linear feet of stream channel impacts at a 2:1 ratio, totaling 3,762 linear feet of stream restoration. The project will also require mitigation at a 1:1 ratio for 266 linear feet. The permittee will be providing 692 linear feet of on-site mitigation at a 1:1 ratio. Accordingly, the permittee intends to utilize the North Carolina Wetland Restoration Program to provide mitigation for remaining 3,336 linear feet of perennial stream channels. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show that the NCDOT proposes to construct a four- or five-lane curb and gutter highway and reconstruct the existing two-lane SR 2642 (Thornburg Drive) to four lanes around the east sides of the cities of Newton and Conover in Catawba County, North Carolina. The proposed route begins at NC 16 southeast of Newton and proceeds east of Conover, crossing Interstate 40 (I-40), before ending north of existing NC 16 north of Conover. The NC 16 interchange with I-40 will be relocated to the new route and the ramps for the existing interchange in Conover will be removed. The total length of the project is 5.8 miles. This permit request specifically addresses impacts to Section B, which involves the reconstruction of Thornburg Road to a four-lane section with a median along its current alignment across SR 1739 (Emanuel Church Road) and US 64-70 to SR 170-9 (Rock Barn Road). From SR 1709, the new four-lane median roadway continues on new location to I-40. From I-40 to the project terminus at NC Highway 16 north of Conover, the roadway will remain on new location but be a five-lane facility. As part of this section, the NC 16 interchange with I- 40 will be relocated to the new route and the ramps for the existing interchange in Conover will be removed. The total length of Section B is 2.0 miles. The proposed project will result in the filling of 0.047 acre of jurisdictional wetlands. The project will also impact open surface waters at 8 separate locations, involving Mull Creek and Conover Creek and some of its unnamed tributaries. Impacts to surface waters will result from the discharge of fill material into 0.047 acre of jurisdictional wetlands, 89 linear feet of intermittent stream channels with minimal aquatic functions, the discharge of fill material into 2,147 linear feet of perennial streams and will involve the relocation of 377 linear feet of streams within the project limits. The permittee proposes to mitigate for 1,881 linear feet of stream channel impacts at a 2:1 ratio, totaling 3,762 linear feet of stream restoration. The project will also require mitigation at a 1:1 ratio for 266 linear feet. The permittee will be providing 692 linear feet of on-site mitigation at a 1:1 ratio. Accordingly, the permittee intends to utilize the North Carolina Wetland Restoration Program to provide mitigation for remaining 3,336 linear feet of perennial stream channels. Finally, the permittee does not propose to mitigate for the 0.025 acre of proposed fill and 0.022 acre of permanent impacts associated with mechanized landclearing of jurisdictional wetlands. The purpose of the work is to improve accessibility and traffic service for residents, business and industry in Newton, Conover, Hickory and surrounding areas. Additionally, the project will provide the opportunity to relocate NC 16 out of the downtown area to the eastern perimeters of Newton and Conover. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. 3 The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions.
