Box 558 Elkin, NC, 28621 Dear Mr. Pettyjohn: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.009 acres of wetlands and 100 linear feet of streams for the purpose of paving SR 1131A (Waterfalls Road) from SR 1130 to 1.61 miles west, near Sparta. The project should be constructed in accordance with your application dated 1 March 2000 (received 23 March 2000). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification corresponds to the Nationwide Permit Number 14 issued by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but net limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit, unless otherwise specified in the Water Quality Certification. The following additional conditions will be required: 1. The double culvert shall be installed in such a manner that the original stream profile is not altered (i.e. the depth of the channel should not be reduced by a widening of the stream bed). 2. The 100 LF of culvert on the intermittent channel shall be installed at least one foot below the channel bed so as to allow passage of water and aquatic life. 3. All work shall be performed during low flow conditions. 4. Care must be utilized such that live (wet) concrete does not enter the stream channel. 5. The presence of equipment in the channels must be minimized. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby - responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Since we are planning to install two pipes for stream crossings, which require a Corps of Engineer Permit Wd. are asking for your review and issuance of a 401 Certification for this work. From the plans, you will see that we plan to install 100 LF of new culvert in stream left of station 27+00+- to station 28+00 in order to improve the typical section of the roadway without relocating the stream channel. Also, we plan to.install a double line of 87°x63" BCCS pipe with a concrete headwall at station 45+65. This pipe is to replace a narrow existing bridge. Your review of these plans and any suggestions which might aide us in accomplishing this work with minimum environmental impact will be appreciated. I look forward to hearing from you. C. Dear Mr. Jolly: hl The North Carolina Department of Transportation, District I Maintenance plans to grade this road primarily along the existing alignment in the 1999 - 2000 Fiscal Year. We will be replacing/extending existing pipes which involve live streams at Station 26+75 - 50' of 24" pipe which results in an additional 20' of impact and at Station 35+85 - 60' of 72" pipe which results in an additional 28' of impact to the stream. We will also be replacing/extending various other pipes throughout the project which do not involve live streams. We will be filling approximately .009 acres of wetland right of station 26+50. We will be encroaching upon the 25' trout stream buffer as follows: 1) Install gabion baskets as a retaining wall to lessen the impact on the stream right of Station 22+55+- and right of Station 23+90+- to Station 24+13+-. These gabion baskets will result in an additional 28' of impact to the stream. 2) Install 100' of new culvert in the stream left of Station 27+00+- to Station 28+00+- in order to improve the typical section of the roadway without relocating the channel. 3) Right of Station 35+90+- to Station 37+05+- construction embankment and 4) Right -of Station 46+00+- to Station 47+50+- construction of embankment. This work is to improve the typical section and the safety of the road. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a straight-line sketch with the proposed erosion control, stream, and cross sections of the affected areas.
