This is to notify you that the requested modification to Certification No. 3066 issued to the North Carolina Department of Transportation on May 21, 1996 is not necessary. The proposed action of placing old bridge decking onto existing authorized pilings will result in impacts to coastal wetlands as a result of shading. The North Carolina Division of Water Quality does not regulate impacts to coastal wetlands due to shading. Therefore, the original 401 Water Quality Certification dated May 21, 1996 and all other corresponding modifications still apply. However, no modification to the existing Certification is required to conduct the proposed activity. Please reference the attached letter from your agency, dated March 12, 1988, which approves the landowner/contractor's request to install pile supported structures over jurisdictional areas. Placement of dismantled bridge sections on permitted pilings over jurisdictional areas As you are aware, the Department's contractor has placed concrete bridge sections onto pilings over jurisdictional areas. Subsequently, the NCDOT was cited for violating C special conditions a and b of Permit No. 199400991. Please reference a previous requester for modification of this permit dated October 18, 1999. The NCDOT recognizes that the contractor has been previously notified by your agency that the placement of material on the site was not a regulated activity. However, the Department also recognizes that the permit to construct a new bridge over the Chowan River and to remove the old structure prohibits the placement of waste material into jurisdictional areas unless approved by a modification to the referenced permit. The Department requests that the existing DOA permit be modified to authorize the recycling of concrete bridge sections onto previously approved, non-regulated pilings in waters of the United States, including wetlands. Each section will be approximately 10.0' x 26.0'. Total surface waters covered by the bridge sections will be 0.84 acres. Drawings of the proposed site are attached. The Department recognizes that this activity will produce shade over the 2.8 acres. However, the hydrologic function will remain intact and the soil will not be compacted or filled. The bridge sections will be placed by crane from existing access roads. Additionally, the area will not be shaded entirely as the concrete will be elevated. Any required compensatory mitigation will be provided by the property owner/contractor (Waff Construction Co.). The contractor will provide specifics about the mitigation directly to the USACE and all issues regarding compensatory mitigation should be coordinated between the USACE and the contractor. This modification is intended only to encompass the area previously requested by the contractor to be used as a storage area as noted in the October 18, 1999 modification request and as depicted in the attached drawings. The remaining material that is currently being stored on high ground is the property of the contractor and the contractor maintains sole responsibility for this material. Any subsequent uses of any bridge material associated with this project within jurisdictional areas will be the responsibility of the contractor. It will be the responsibility of the contractor to obtain any and all regulatory authorizations for such use. The NCDOT will not request further modification to this permit to place bridge material in jurisdictional areas. As a condition, the NCDOT will not be accountable for use of the material in waters of the United states. _ By copy of this letter, we request that the North Carolina Department of Environment and Natural Resources, Division of Water Quality, modify the appropriate Water Quality Certification. A check in the amount of $475.00 is included to cover the processing fee. Please reference the attached letter from your agency, dated March 12, 1988, which approves the landowner/contractor's request to install pile supported structures over jurisdictional areas. Placement of dismantled bridge sections on permitted pilin sg over jurisdictional areas As you are aware, the Department's contractor has placed concrete bridge sections onto pilings over jurisdictional areas. Subsequently; the NCDOT was cited for violating special conditions a and b of Permit No. 199400991. Please reference a previous request for modification of this permit dated October 18, 1999. The NCDOT recognizes that the contractor has been previously notified by your agency that the placement of material on the site was not a regulated activity. However, the Department also recognizes that the permit to construct a new bridge over the Chowan River and to remove the old structure prohibits the placement of waste material into jurisdictional areas unless approved by a modification to the referenced permit. The bridge sections will be placed by crane from existing access roads. Additionally, the area will not be shaded entirely as the concrete will be elevated. Any required compensatory mitigation will be provided by the property owner/contractor (Waff Construction Co.). The contractor will provide specifics about the mitigation directly to,the USACE and all issues regarding compensatory mitigation should be coordinated between the USACE and the contractor. Please reference the attached letter from your agency, dated March 12, 1988, which approves the landowner/contractor's request to install pile supported structures over jurisdictional areas. Subsequently; the NCDOT was cited for violating special conditions a and b of Permit No. 199400991. Please reference a previous request for modification of this permit dated October 18, 1999. The NCDOT recognizes that the contractor has been previously notified by your agency that the placement of material on the site was not a regulated activity. However, the Department also recognizes that the permit to construct a new bridge over the Chowan River and to remove the old structure prohibits the placement of waste material into jurisdictional areas unless approved by a modification to the referenced permit. The Department requests that the existing DOA permit be modified to authorize the recycling of concrete bridge sections onto previously approved, non-regulated pilings in waters of the United States, including wetlands. We are at a loss to understand why mitigation is required for the storage and or reuse of this material. We have current NCDENR and USACOE permits for relieving platforms over wetlands. Our reclamation proposal rejected by NCDOT was based on setting a portion of the bridge decking on existing pilings with all work in full compliance with these existing permits. Construction began in 1998 and was finished in 1999. ' This year represents the first growing season for hydrologic and vegetation monitoring. The Pembroke Creek Mitigation Site, located in Chowan County, is a bottomland forest site divided into two areas. The site was constructed to mitigate for the impacts from the improvements to US 17 in Bertie and Chowan Counties (R- 2512). Hydrologic data was not collected for the entire 1999 growing season. Specific factors precluding data collection include: 1) Installation of monitoring wells after the beginning of the 1999 growing season, 2) Specific monitoring well problems, including: PCR-2 was not activated until late April; therefore, well data was not recorded for approximately one month. In March, some of the wells were "tampered with and had been pulled up at least 4-6 inches. Each of the wells was reset to the correct depth in April. Despite gaps in data, the success criterion was still met for hydrology. One major change in the hydrologic monitoring process is the use of local weather station rainfall data for the site analysis. The daily rainfall on the well data graphs is recorded at the Edenton rain gauge, maintained by the NC State ' Climate Office. This data is being used because the existing on-site rainfall gauges have proven unreliable. These site gauges will be replaced with more reliable equipment prior to the start of the 2000 growing season. I I Pembroke Creek received considerable rainfall during the month of September due to Hurricanes Dennis, Floyd, and Irene. An additional section in the report describes the effects of these hurricanes on the site itself. Hydrologic monitoring indicated that both sites have met success criteria. Vegetation data meet all established success criteria. Based on the monitoring results from the 1999 growing season, NCDOT recommends that monitoring continue. 7.0 INTRODUCTION 1.1 Project Description n 0 11 The site is located adjacent to US 17 in Chowan County (Figure 1). Designed as a bottomland forest, it is to mitigate for the effects of the improvements to US 17 in Bertie and Chowan Counties (R-2512). 1.2 Purpose In order to demonstrate successful mitigation, hydrologic and vegetative monitoring must be conducted for a minimum of three years. Success criteria are based on federal guidelines for wetland mitigation. These guidelines stipulate criteria for both hydrologic conditions and vegetation survival. The following report details the results of hydrologic and vegetation monitoring during the 1999 growing season at the Pembroke Creek Mitigation Site. Included in this report are analyses of both hydrologic and vegetative monitoring results as well as local climate conditions throughout the growing season. The vegetation planted represents Phase I and Phase 2 of the project's construction. (Phase 1) Site Constructed (Phase II) Monitoring Wells Installed Hydrologic Monitoring Site Planted (Phase II) Vegetation Monitoring (1 yr.) 2.0 HYDROLOGY 2.1 Success Criteria ' In accordance with federal guidelines for wetland mitigation, a site meets hydrologic criteria if it is inundated or saturated (within 12" of the surface) by surface or ground water for at least 12.5% of the growing season. However, ' discussions between NCDOT and natural resource agencies have determined that, due to the unique character of this site, the normal guidelines for hydrologic success may not apply. Groundwater levels may vary significantly on a daily ' basis due to a sandy substrate that is in close proximity to a tidally influenced body of water. ' The growing season in Chowan County begins March 13 and ends December 1. These dates correspond to a 50% probability that air temperatures will drop to 28° or lower after March 13 and before December 1.' Thus the growing season ' is 262 days; optimum wetland hydrology requires 12.5% of this growing season, or 32 days. The site must also experience average climatic conditions in order for the hydrologic data to be considered valid. 2.2 Hydrologic Description Eight monitoring wells, one rain gauge, and one surface water gauge were installed on site in February 1999 and data was recorded starting in March 1999 ' (Figure 2). The automatic monitoring wells and rain gauges record the depth to groundwater and rainfall, respectively. Data was collected on a daily basis throughout the growing season. Appendix A contains a plot of the water depth for each monitoring well and surface water gauge in 1999. Precipitation events are included on each graph as ' bars. Though a rain gauge was installed on the site, the daily rainfall events on the graphs were recorded at an Edenton, NC weather station. This data is being used because the existing on-site rainfall gauges have proven unreliable. The ' site gauge will be replaced with more reliable equipment prior to the start of the 2000 growing season. ' 2.3 Results of Hydrologic Monitoring 2.3.1 Site Data The largest number of consecutive days in which the groundwater was within twelve inches of the surface was determined for each well. The number of days ' was then converted into a percentage of the 262-day growing season. Rainfall data recorded at an Edenton weather station during 1999 was compared to the historical 30-70 percentile trends for the area. It is assumed that if the 1999 rainfall totals, represented by bars, fall between the average precipitation values for each month, then the local climate was experiencing average conditions for that particular region. Due to data availability, only rainfall totals through November 1999 are presented. The 2000 Annual Report will include the rainfall total for December 1999. ' With the exception of July, September, and October, Edenton received below average monthly rainfall totals. ' 2.4 Conclusions ' All of the monitoring wells indicated saturation for at least 12.5% of the growing season, even though the months prior to September were, on average, dryer than normal in the Edenton area. The actual numbers of planted trees that occur within the plot are counted. This number is equated to the number within each plot, which ' represents 680 trees per acre (average). The survival monitoring number is compared to the planted number to obtain survival percentage. Initial monitoring indicates success in both hydrology and vegetation survival. In order to demonstrate successful mitigation, hydrologic and vegetative monitoring must be conducted for a minimum of five years or until success criteria are fulfilled. Site construction began in 1998 and was finished in 1999. The year 2001 represents the third year for hydrology and vegetation monitoring. The Pembroke Creek Mitigation Site in Chowan County is a bottomland forest site divided into two areas. The site was constructed to mitigate for the wetland impacts from the improvements to US 17 in Bertie and Chowan Counties (R- 2512). Hydrologic success for this site is based on the mean depth to groundwater of the gauges in the restoration area within 20% of the mean depth to groundwater of the gauges in the respective reference area. One of the four gauges was within 20% of reference gauges. Three gauges (PC-1, PC-2, and PC-3) did not meet this criteria. However, each of the gauges recorded the water table within 12 inches of surface for more than 12.5% of the growing season, which meets the federal guidelines for hydrologic criteria. Therefore, monitoring from the 2001-growing season indicates hydrologic success. Vegetation data collected also met all established success criteria for the 2001 season. Based on the monitoring results from the 2001 growing season, NCDOT will continue hydrologic monitoring until success criteria are met or enough information can be collected on the site that appropriate changes can be made to help in achieving success. 1.0 INTRODUCTION 1.1 Project Description The site is located adjacent to US 17 in Chowan County (Figure 1). Designed as a bottomland forest. The site was constructed to offset impacts of the improvements to US 17 in Bertie and Chowan Counties (R-2512). 1.2 Purpose In order to demonstrate successful mitigation, hydrologic, and vegetative monitoring must be conducted for a minimum of five years. Success criteria are based on federal guidelines for wetland mitigation. These guidelines stipulate criteria for both hydrologic conditions and vegetation survival. The following report details the results of hydrologic and vegetation monitoring during the 2001 growing season at the Pembroke Creek Mitigation Site. Included in this report are analyses of both hydrologic and vegetative monitoring results as gauge as local climate conditions throughout the growing season. The vegetation planted represents Phase I and Phase 2 of the project's construction. However, discussions between NCDOT and natural resource agencies have determined that, due to the unique character of this site, the normal guidelines for hydrologic success may not apply. Groundwater levels may vary significantly on a daily basis due to a sandy substrate that is in close proximity to a tidally influenced body of water The growing season in Chowan County begins March 13 and ends December 1. These dates correspond to a 50% probability that air temperatures will drop to 28° or lower after March 13 and before December 1.' Thus the growing season is 262 days; optimum wetland hydrology requires 12.5% of this growing season, or 32 days. The site must also experience average climatic conditions in order for the hydrologic data to be considered valid. 2.2 Hydrologic Description Eight monitoring gauges (four site gauges, four reference gauges), one rain gauge, and one surface water gauge were installed on site in February 1999 and data was recorded starting in March 1999 (Figure 2). The automatic monitoring gauges and rain gauges record the depth to groundwater and rainfall, respectively. Data was collected on a daily basis throughout the growing season. E € is xi 3 00 2.3.2 Climatic Data Figure 4 is a comparison of 2001 monthly rainfall to historical precipitation for the Edenton area. Rainfall data recorded onsite during the growing season was compared to the historical 30-70 percentile trends for the area. It is assumed that if the 2001 rainfall totals, represented by bars, fall between the average precipitation values for each month, then the local climate was experiencing average conditions for that particular region. As indicated by Figure 4, April, May, and October experienced below normal rainfall totals. Rainfall in March, July, September, and November fell within the average range. All densities are above the minimum of 320 trees per acre required by the success criteria. 13 4.0 OVERALL CONCLUSIONS/ RECOMMENDATIONS Below average precipitation during April and May may have lead to significant drops in water table depth. Several of the gauges including PC-2 and PCR-2 showed increases in depth to the water table during these months. While the water table was within 12 inches (for PC-2) for more than 12.5% of the growing season, it is likely that the number of consecutive days within 12 inches would have increased had rainfall amounts been closer to average. PC-1 did not record data during late August through early October due to a dead battery. Based on water table depth before and after that time frame, as well as rainfall during that period, it is likely that the number of consecutive days within 12 inches would have increased had the unit been working properly. Hydrologic success for this site is based on the mean depth to groundwater of the gauges in the restoration area within 20% of the mean depth to groundwater of the gauges in the respective reference area. One of the four gauges was within 20% of reference gauges. Three gauges (PC-1, PC-2, and PC-3) did not meet this criteria. However, each of the gauges recorded the water table within 12 inches of surface for more than 12.5% of the growing season, which meets the standard hydrologic criteria. Therefore, monitoring from the 2001-growing season indicates success in hydrology based on federal guidelines, however success criteria for this site were not met. The 2001 vegetation monitoring revealed an average density of 460 trees per acre for zone 1, 650 trees per acre for zone 2, 566 for zone 3, and 559 trees per acre for the site's average.
