After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. This approval also valid for the Neuse River buffer rules (15A NCAC 213 .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but no limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If the project is sold you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this approval letter and is thereby responsible for complying with all conditions. This approval will expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this approval, you may ask for an adjudicatory hearing.. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, NC 27611-7447. This approval and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Neuse River Buffer rules. The road project will be crossing the buffer within the Neuse River Basin. The eject as imposed is minimized as great as possible due to cementary on the south of the property- he impact will be less than 150 linear feet of buffer, therefore an allowable activity with the Neuse River Basin. This office recommends issuance of the 401 Certification as well as the Authorization Certificate for the buffer impacts If the Authorisation Certificate needs to come from the region as a seperate document, lease let me know. Here are the latest entries into the Filemaker Pro System; 00-0170, issue no conditions 00-0147, issue no conditions 00-0171, no 401 needed this letter has already gone out from the region, I just wanted to complete the loop of paperwork. 00-0187, issue no conditions. I did offer a comment, according to the consultant they did not list the Pamlico Sound as SA, wrong. X00-0119, this application and approval needs both the 401 certification and an Authorization Ceritificate for the buffer impacts. I told John that if this needs to be issued from the region let me know. 00-0154, this project should be placed on Hold until we can get back out to Ocracoke. John's memo said he needs comments by 3/22 but we are not planning on visiting the island unitl the 27th and 28th. Also I still cannot find the entry for the Beaufort County Hospital. This is one of the projects I think you have already looked for. Let me know if you have any luck locating the entry. If you have any questions let me know.
