Wilson NC DOT PO Box 3279 Asheville, NC 28802 Dear Mr. Wilson: You have our approval, in accordance with the attached conditions, to place fill material in 106 feet of waters for the purpose of extending the culvert at SR 1116, as you described in your application dated February 5, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3102. This Certification allows you to use Nationwide Permit Number 13 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Box 1787 Boone, NC, 28607 Subject: Site evaluation for Community Development Block Urgent Needs Projects Reference is made to your correspondence dated December 7, 1998, in which you requested guidance on DWQ Wetland Rules pertinent to three properties targeted for Urgent Needs in Mitchell County. The Division of Water Quality (DWQ) Wetland Unit is responsible for the issuance of the Section 401 Water Quality Certification for activities impacting waters of the state including wetlands. Please be advised that the following information will be necessary to determine the wetland permit requirements for these properties. 1. A site map for each property illustrating all existing jurisdictional wetlands, ponds and all intermittent and perennial streams is needed. We also recommend inclusion of a narrative discussing the types of wetlands onsite, along with wetland determination forms. 2. Maps showing the proposed configuration of wetlands, ponds and streams according to the site plans. A table listing the acreage amounts of fill in wetlands and ponds, along with stream impacts listed by linear distance of stream, is also needed for each property. In accordance with the EPA's 404(b)(1) Guidelines, any applicant is required to demonstrate that fill in waters has been avoided and minimized to the extent practical. Please note that you should include justification for all impacts requested. If a stream relocation is requested and is justifiable, then it must be relocated so that it maintains its functions and values. The stream should not simply be diverted into an armored channel. Rather, the applicant should be able to demonstrate that a stable stream can be created to mimic the width/depth ratio of the existing stream and to provide vegetative cover along the banks. 4. Where wetland and stream impacts cannot be avoided and minimized, mitigation may be required. Total project impacts exceeding 1.0 acre of wetlands and/or 150 feet linear distance of any single perennial stream will require mitigation in accordance with DWQ Wetland Rules 115A NCAC 2H.0506(b)(6)1. If mitigation is required, the Wetland Restoration Program will be available to use for stream and/or wetland mitigation. P.O. Fees for "Major Water Quality Certification" (defined as those with greater than or equal to one acre of wetland or water fill or equal to 150 feet of stream impact) will have a fee of $475.00. "Minor Water Quality Certifications" (defined as less than one acre of wetland or less than 150 fee of stream impact) will have a fee of $200.00. Please note that the U.S. Army Corps of Engineers will determine which 404 (Individual or a type of Nationwide) Permit is applicable to the proposed work. DWQ is responsible for the issuance of the matching Individual or General 401 Water Quality Certification. When specific details of wetland and stream impacts are known, the Corps will be able to determine which type of permit is required. Issuance of a 401 Water Quality Certification requires satisfaction of water quality concerns, to ensure that water quality standards are met and no wetland or stream uses are lost.
